Mohammad Kalim And Ors. vs The State Of Bihar on 30 March, 2011<\/div>\n
                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                             CR. APP (SJ) No.63 of 2011\n                           MOHAMMAD KALIM AND ORS.\n                                          Versus\n                               THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n
3\/   30.3.2011              Heard learned counsel for the parties on the prayer of the<\/p>\n
                 appellants for bail after receipt of lower court records.<\/p>\n
                           The contention is that all the witnesses were turning<\/p>\n
                 hostile. Whatever was the statement of the witnesses, that was not<\/p>\n
                 going to indicate any circumstance that the appellants had either<\/p>\n
                 instigated the deceased to commit suicide or had created the<\/p>\n
                 circumstances in that behalf for her.\n<\/p>\n
                           The appellants have been convicted under section 306\/34<\/p>\n
                 of the IPC.\n<\/p>\n
                           Let appellants, Mohammed Kalim, Jubaida khatoon,<\/p>\n
                 Mohammed Rafique and Mohammed Hanif, during the pendency of<\/p>\n
                 the appeal,     be released on bail on furnishing bail bond of<\/p>\n
                 Rs.10000\/(ten thousand) each with two sureties of the like amount<\/p>\n
                 each to the satisfaction of Additional Sessions Judge, FTC 4,<\/p>\n
                 Samastipur in S.T. No. 128 of 2007.\n<\/p>\n
                           As regards sentence of fine, realization thereof shall<\/p>\n
                 remain stayed during the pendency of the appeal.<\/p>\n
