    This petition is filed under Article 226 of<\/p>\n
the Constitution of India praying for a writ of<\/p>\n
mandamus or any other appropriate direction<\/p>\n
commanding third respondent to consider the<\/p>\n
grievance of the petitioner before issuing any<\/p>\n
direction based on the request of the interpol<\/p>\n
to extradit him and to issue a writ of mandamus<\/p>\n
commanding the fifth respondent to keep in<\/p>\n
abeyance any proceeding initiated against the<\/p>\n
petitioner  for  extradition     until    third<\/p>\n
respondent   makes   any    order   on   merits<\/p>\n
considering the grievance of the petitioner.<\/p>\n
    2.    Petitioner  contended   that  he  was<\/p>\n
working in Dubai and while so he as   nominee a<\/p>\n
hotel business was started by name and style<\/p>\n
“Pappy Corner Restaurant\/L.L.C along with his<\/p>\n

wife,         one   Ajith  Kumar  and Mr.Jayadevan   and<\/p>\n
petitioner was entrusted with the management of<\/p>\n
hotel.      In July 2008, he decided to have a short<\/p>\n
visit     to    India  and  at  that  time Ajith   Kumar<\/p>\n
requested        to  have  a  signed  cheque  from   the<\/p>\n
petitioner to borrow money in case of          emergency<\/p>\n
for business by giving the cheque.        Accordingly he<\/p>\n
issued a signed cheque to Ajithkumar.          The said<\/p>\n
Ajithkukumar told the petitioner that if a fixed<\/p>\n
amount is written and so much amount is not with<\/p>\n
the borrower, the cheque amount be used              and<\/p>\n
therefore the amount       was not written and an entry<\/p>\n
was made not over 25000\/- (AED).        It is contended<\/p>\n
that the said cheque was misused and to avoid jail<\/p>\n
sentence         petitioner   issued   a   cheque    for<\/p>\n
Rs.1,75,000\/- AED encashable after three months and<\/p>\n
another cheque for Rs.25,000\/- AED encashable on<\/p>\n
8.10.2008 to Dubai police.       As the dispute is over<\/p>\n
in January 2009,        he returned to India and before<\/p>\n
his entry to Dubai,        cheque for Rs.1,75,000\/- was<\/p>\n
presented before the bank and got it returned back<\/p>\n

by Ajithkumar and a fresh case was ignited before<\/p>\n
the Dubai Police and it was a trap       set up to book<\/p>\n
the petitioner as and when he lands in Dubai.        It<\/p>\n
is contended that subsequent to the registration of<\/p>\n
the    Crime,     Ajithkumar arrived in India and he was<\/p>\n
granted bail by Judicial First Class Magistrate-II,<\/p>\n
Mavelikara in Crime No.400\/2009 of Nooranad Police<\/p>\n
and    as     a   counterblast,    he  initiated   crime<\/p>\n
No.351\/2009 for the offence under section 420 read<\/p>\n
with section 34 of Indian Penal Code. Even the wife<\/p>\n
of the petitioner, who is now in Dubai,         was not<\/p>\n
spared     and    on  a  request  from  Abudabi   Police<\/p>\n
forwarded to Central Bureau of Investigation, New<\/p>\n
Delhi to locate the petitioner,       Inspector General<\/p>\n
of Police Crime Branch, Thiruvananthapuram        who is<\/p>\n
also the State Interpol Liason Officer, based on<\/p>\n
the request of CBI       directed  the Superintendent of<\/p>\n
Police, Pathanamthitta to locate the petitioner and<\/p>\n
Superintendent of Police, Pathanamthitta        made an<\/p>\n
inquiry by Special Branch police and       located   the<\/p>\n
petitioner        and  forwarded  the  report   to   the<\/p>\n

Inspector         General   of   Police.      In   such<\/p>\n
circumstances, a writ of mandamus as prayed for was<\/p>\n
sought.      It is contended that under Article 6(2)(c)<\/p>\n
of the India -United Arab Emirates Extradition<\/p>\n
Treaty,      if a person whose extradition is sought is<\/p>\n
being investigated or tried in the        State for the<\/p>\n
same     offence      for  which   his  extradition  is<\/p>\n
requested,        the  authority  can refuse  the  said<\/p>\n
request made through INTERPOL.        It is the case of<\/p>\n
the petitioner that as          cases are pending    in<\/p>\n
respect of the same offence in India           Union of<\/p>\n
India could refuse to extradit the petitioner and<\/p>\n
therefore direction is to be issued.<\/p>\n
     3.         A  statement  is  filed  by  the  fifth<\/p>\n
respondent, Central Bureau of Investigation stating<\/p>\n
that the National Central Bureau-India which is a<\/p>\n
part of Central Bureau of Investigation,        acts as<\/p>\n
an    interface      between  various  law  enforcement<\/p>\n
agencies of India and National Central Bureau of<\/p>\n
other countries for mutual co-operation to combat<\/p>\n
crime     and     trace  fugitives.   National  Central<\/p>\n

Bureau, New Delhi received a request from the NCB-<\/p>\n
Abu Dhabi to locate the petitioner in India, who is<\/p>\n
wanted by the authorities of United Arab Emirates<\/p>\n
for the offence of issuing in bad faith,       a cheque<\/p>\n
dishonoured for Rs.1,75,000\/- and the address of<\/p>\n
the accused was also provided           which was   in<\/p>\n
Kerala.          NCB, New Delhi requested the Inspector<\/p>\n
General of Police, Crime Branch CID, Kerala only to<\/p>\n
locate the accused. Petitioner was located and on<\/p>\n
the basis of the report of Inspector General of<\/p>\n
Police, CBCID, Kerala NCB-India      informed  Interpol<\/p>\n
Abu Dhabi that petitioner       is occasionally staying<\/p>\n
in Kanukumpallil, Koodal, Pathanamthitta District<\/p>\n
in connection with the construction of his house at<\/p>\n
Koodal and other times he is staying in lodges.      It<\/p>\n
is    also      stated   that  NCB  has  not   received<\/p>\n
extradition request\/papers      from the authorities of<\/p>\n
Interpol-Abu Dhabi so far.\n<\/p>\n
     4. In the light of the statement of the fifth<\/p>\n
respondent,       it  is  clear  that  no  request  for<\/p>\n
extradition of the petitioner was received from<\/p>\n

UAE.     In such circumstances,     I find no reason to<\/p>\n
issue any direction as sought for.       Once a request<\/p>\n
is received from Interpol, Union of India can act<\/p>\n
only as provided under the provisions       United Arab<\/p>\n
Emirates         Extradition Treaty executed with the<\/p>\n
United Arab Emirates.        Union of India is entitled<\/p>\n
to   proceed      as  provided  under the  United  Arab<\/p>\n
Emirates Extradition Treaty. If any representation<\/p>\n
is made by the petitioner to the Union of India, it<\/p>\n
shall also be considered.\n<\/p>\n
     Petition is disposed.\n<\/p>\n<\/p>\n
