As these appeals are arising out of a common<\/p>\n
 ”  judgment and award of the Tribunal, they are heard<\/p>\n
together and disposed of by this common judgment.<\/p>\n

2. For the sake of convenience parties are referred to<\/p>\n
as they are referred to in the claim petition beforethe<\/p>\n
Tribunal.\n<\/p>\n
3. Brief facts of the case ashdpieadeid <\/p>\n
petition are:\n<\/p>\n
That on 19~01~06. ‘When th’e._V_  ‘was it<\/p>\n
proceeding on K.R.   overxonv the ieft

\nover, a  ‘pcarne  negligent manner
\nfrom  As a result, the
\ndeceased’_’sdnstaj:ned* and died in Mallya
\nHospit\ufb02pjon  Wife and two major children<\/p>\n
 a cliaimupetition before the MACT, Bangalore,<\/p>\n
  compensation of Rs.5,00,000\/-. The Tribunal<\/p>\n
  judgment and award has awarded<\/p>\n
cornplensatlon of Rs.5\/\u00a30,788\/~ with interest at 6% p.a.<\/p>\n
it ” and Tafter deducting 20% towards contributory<\/p>\n

 BMTC to pay 80% of the Compensation.

4. Aggrieved by the judgment and award, BMTC has
\npreferred MFA No.101\u00e9i8\/O8 challenging the award
\nboth on the ground of negligence as well as quantum.<\/p>\n
Claimants have also preferred MFA No.<\/p>\n
challenging the award both on the ground__A'<i;.fH<\/p>\n
as well as quantum.\n<\/p>\n
5. Learned Counsel appe’a1iIi_g’~’; for  <\/p>\n
submits, deceased was ‘supposed” to croVssV._;’iv’lysore 4%<\/p>\n
Bangalore road at Kalasipalyafn. market”by…using under<\/p>\n
pass meant for pedestriarisjiVjirlel submits, the<\/p>\n
fact that he’jwalsf:,;suffering from”‘liver cirrhosis shows, he
\nwas lunld\u00e9er’ the,” of alcohol at the time of<\/p>\n
accident and he ‘dashed against the BMTC bus and<\/p>\n
   no negligence on the part of the driver of BMTC<\/p>\n
  ‘Tribunal is not right in holding that the<\/p>\n
C bus has contributed for the accident<\/p>\n

  n6.*- Per contra, the learned Counsel appearing for the<\/p>\n
Atcilaimants submits, no doubt it is true there is under<\/p>\n
l pass and deceased could have used it to cross the road,<\/p>\n
but it does not mean that driver of the BMTC bus could
\ndrive the bus in a rash and negligent manner and<\/p>\n
dashed against the deceased. if the driver ofgthhetgbus<\/p>\n
had driven the same with a little care, hej”coul~d._: h_;_1ve<\/p>\n
avoided the accident.\n<\/p>\n
7. Deceased sustained inju’r.ites_in a_-.r”oarl if<\/p>\n
accident occurred on 19–1\u00a5'{l\u20acT3:, He died as<\/p>\n
evident from the death_ certificateVVLEx.P.6.”””I’he body of
\nthe deceased was not rnortem and<\/p>\n
cause of deat’h1is’notkno-vvn’;vvh:ether\u00e9it is on account of<\/p>\n
ir1juries’=sustained “de-ceased in a road traffic
\naccident’ pron’ of__the fact that he was suffering
\nfrom liVe1″‘\u00abcirrhosisf.~., ‘ <\/p>\n
  the folair:.1a,r1ts who are the wife and children of<\/p>\n
\u00bb Vitheg deceas:e’d___should not be made to suffer and lose<\/p>\n
 this Court directed the learned Counsel<\/p>\n
 for to use his good of\ufb01ce and \ufb01nd out from his<\/p>\n
‘A   whether they could pay 50% of the compensation<\/p>\n
awarded by the Tribunal. At the same time, learned<\/p>\n
Counsel for the claimants was asked to \ufb01nd out<\/p>\n
whether the claimants agree to take 50% of the<\/p>\n
compensation awarded by the Tribunal.<\/p>\n
9. On instruction from the respective clients-{learned<\/p>\n
Counsel for the BMTC submits, his client  to. <\/p>\n

as per the letter addresse’d__to   <\/p>\n

10. The..V.<leaVi':ned appearing for the parties
\nhave \ufb01l_ed  erzellosing a copy of the letter
\ndatec1"1_9"–1_1;io  the BMTC in favour of their<\/p>\n
Cdunsel andthey are taken on record.<\/p>\n
  the appeals are disposed of. The<\/p>\n
 "are entitled to a total compensation of<\/p>\n
Rs.2,l'r3,315\/– as against Rs.4,32,630\/– which forms<\/p>\n
  of Rs.5,40,788\/~ awarded by the Tribunal. Out of<\/p>\n
 the amount deposited in nationalised Bank pursuant to<\/p>\n
the order of this Court, a sum of Rs.2,16,3l5\/– with<\/p>\n
 .\n<\/p>\n
interest at 6% p.a. from the date of claim petition till
\nthe date of realisation is ordered to be released in
\nfavour of the claimants. The remaining amonnt is
\nordered to be released in favour of <\/p>\n
Bangalore.\n<\/p>\n
