JUSTICE<br \/>\nR.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nAppeal preferred under Clause 15 of the Letters Patent arises from<br \/>\nthe judgment and order dated 30th September 2009 passed by<br \/>\nthe learned single Judge in above Special Civil Application<br \/>\nNo.7594\/2009.\n<\/p>\n<p>\tThe<br \/>\nmatter at dispute is the recruitment for appointment to the post of<br \/>\nPolice Sub Inspector (Unarmed).\n<\/p>\n<p>\tIn<br \/>\nanswer to the advertisement dated 28th<br \/>\n April 2005 published by<br \/>\nGujarat Sub-ordinate Services Selection Board (hereinafter referred<br \/>\nto as  the Board ) for recruitment of 186 Police Sub Inspectors<br \/>\n(Unarmed), the appellant had applied for selection and appointment as<br \/>\nPolice Sub Inspector.  On completion of the recruitment process, on<br \/>\n19th<br \/>\nSeptember 2007 the Board published the select list of 186 successful<br \/>\ncandidates and a wait list of next 20 candidates.  The appellant did<br \/>\nnot find place in 186 selected candidates. However, he was placed at<br \/>\nSr.No.9 in the wait list.\n<\/p>\n<p>\tBefore<br \/>\nthe learned single Judge, it was the grievance of the appellant that<br \/>\nthough the wait list was operated upto Sr.No.8, the appellant who was<br \/>\nat Sr.No.9 on the wait list was not offered appointment. Though<br \/>\nselect list of 186 candidates was drawn, everybody did not accept the<br \/>\nappointment to the post of Police Sub Inspector. The resultant<br \/>\nvacancies were filled in by operating the wait list. Amongst those<br \/>\nwho accepted the appointment and joined the training, some resigned<br \/>\nfrom training within a few days.    However, the respondent<br \/>\nauthorities arbitrarily decided not to operate the wait list to fill<br \/>\nin the vacancies arose on account of resignation of two newly<br \/>\nrecruited trainee police sub inspectors.\n<\/p>\n<p>\tThe<br \/>\nlearned single Judge has rejected the contention.  It is held that<br \/>\nthe vacancies that arose on account of resignation of trainees are<br \/>\nrequired to be filled in by proper recruitment procedure and cannot<br \/>\nbe offered to the wait list candidates.  Therefore, the present<br \/>\nAppeal.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Kotia has appeared for the appellant.  He  has submitted<br \/>\nthat the action of the respondents   authorities is high handed,<br \/>\narbitrary and discriminatory.  Mr. Kotia has submitted that if all<br \/>\n186 candidates do not report for duty in pursuance of their selection<br \/>\nor some of those who join the duty, resign later, all these vacancies<br \/>\nare equal and are required to be treated equally and to be filled in<br \/>\nby operating the wait list.\n<\/p>\n<p>\tWe<br \/>\nare unable to agree with Mr. Kotia.  It is settled law that wait list<br \/>\nis required to be operated only in case when the selected candidates<br \/>\ndo not accept the appointment.  The wait list cannot be operated to<br \/>\nfill in vacancies arising on account of resignation of newly<br \/>\nrecruited personnel.  Such posts falling vacant on account of<br \/>\nresignation are required to be filled in by proper recruitment<br \/>\nprocess and not by operating the wait list.\n<\/p>\n<p>\tBesides,<br \/>\nas indicated in the result declared by the Board, the wait list was<br \/>\noperative for a period of two years or till the next select list is<br \/>\nready, whichever be the earlier.  The results were declared on 19th<br \/>\nSeptember 2007.  The wait list in question has expired on 18th<br \/>\nSeptember 2009.  It is not the case of the appellant that any person<br \/>\non the wait list below the<br \/>\nappellant has been appointed superseding the appellant.\n<\/p>\n<p>\tThe<br \/>\naction of the respondents in not operating the wait list to fill in<br \/>\nthe posts falling vacant on account of resignation cannot be said to<br \/>\nbe arbitrary or discriminatory. The learned single Judge has rightly<br \/>\nrejected the writ petition.  No case for interference is made out.<br \/>\nThe Appeal is dismissed in limine.\n<\/p>\n<p>\tCivil<br \/>\nApplication stands disposed of.\n<\/p>\n<p> (M.D.\n<\/p>\n<pre>Shah, J.)\t\t\t\t(Ms. R.M.
