A revision filed under s.  482  of\n\tthe  Criminal  Procedure Code 1973 on the  ground  that\t the\n\tallegations in the complaint did not constitute any  offence\n\twarranting the cognizance was dismissed in limine.\n\tOn appeal by special leave to this Court,\n\t    HELD: Where the allegations set out in the complaint  or\n\tthe charge-sheet do not constitute any offence, it is compe-\n\ttent to the High Court exercising its inherent\tjurisdiction\n\tunder s. 482 of the Code of Criminal Procedure 1973 to quash\n\tthe order passed by the Magistrate taking cognizance of\t the\n\toffence.  [359B]\n\t    The\t instant case was clearly one where the\t allegations\n\tcontained  in the complaint did not constitute\tany  offence\n\tand  the  Sub-Divisional Magistrate was in error  in  taking\n\tcognizance of it and the High Court also ought not to  have,\n\tin  the\t circumstances,\t rejected the  application   of\t the\n\tappellant  for\tquashing  the order  of\t the  Sub-Divisional\n\tMagistrate.  [360E]\n\t    No offence under s. 54(1)(a) could be said to have\tbeen\n\tcommitted  on the allegations contained in the complaint  in\n\tthe  absence  of specific allegation of\t the  two  essential\n\tingredients  of the offence under s. 54(1)(a) read  with  s.\n\t25(2)  and also for want of an averment that either  of\t the\n\ttwo  women who were performing the cabaret was\temployed  or\n\tpermitted  to  be employed by the Club or  that\t liquor\t was\n\tbeing  consumed\t by the public in the part of  the  Club  in\n\twhich the cabaret was being performed.\t[359D-F]\n\t    The\t allegation contained in the complaint could not  be\n\tsaid to constitute an offence under s. 57(c), in the absence\n\tof  an allegation as to which condition of the\tlicence\t was\n\tbroken by the Club or the appellant in allowing a cabaret to\n\tbe performed in the Club premises and more so, when no\tsuch\n\tcondition  in  the licence itself could be  pointed  out  on\n\tbehalf of the State. Singh, for the respondent.<br \/>\n\tThe Judgment of the Court was delivered by<br \/>\n\t    BHAGWATI, J. There is a club in Patna called   Bankipore<br \/>\n\tClub. The appellant is the Honorary Secretary of that  Club.<br \/>\n\tIt  appears that at about 10.25 p.m. on 31st December,\t1975<br \/>\n\twhen  the New Year eve was being celebrated at the  Club,  a<br \/>\n\traid  was carried out by the Assistant Commissioner  of\t Ex-<br \/>\n\tcise, Inspector of Excise and  SubInspector (Excise) and  it<br \/>\n\twas  found  that  two women and five men  were\tsinging\t and<br \/>\n\tdancing in the club premises.  The Excise Inspector filed  a<br \/>\n\tcomplaint against the appellant on 2nd January, 1976  charg-<br \/>\n\ting  him  with\thaving\tcommitted  offences  under   Section<br \/>\n\t54(1)(a)  and Section 57 (c) of the Bihar and Orissa  Excise<br \/>\n\tAct  1915.\t The allegations on the basis of  which\t the<br \/>\n\tcomplaint was filed  are   material and we may set them\t out<br \/>\n\tin extenso:\n<\/p>\n<blockquote><p>\t\t\t     &#8220;A\t Cabaret  dance with  women  was  in<br \/>\n\t\t      progress\tat  Banki-  pore Club,\tPatna.\t Two<br \/>\n\t\t      women  and five men were singing and  dancing.<br \/>\n\t\t      This  dance  was being  performed\t inside\t the<br \/>\n\t\t      premises of the Bankipore Club, Patna before a<br \/>\n\t\t      large gather-\n<\/p><\/blockquote>\n<blockquote><p>\t\t      ing  of  men and women.  I  asked\t Dr.  Sharda<br \/>\n\t\t      Prasad  Singh,\tHonorary Secretary  and\t his<br \/>\n\t\t      Manager  Sri  Banke  Bihari   Prasad Sinha  to<br \/>\n\t\t      show the permission  obtained  from\t the<br \/>\n\t\t      District Magistrate or from any other authori-<br \/>\n\t\t      ty  for organising the Cabaret  dance  because<br \/>\n\t\t      licence vending &#8216;Off&#8217; foreign liquor is  given<br \/>\n\t\t      to  Bankipore  Club in form 2.   The  validity<br \/>\n\t\t      period of licence is from 1-4-75 to  31-3-1976<br \/>\n\t\t      and   under  Section  25\t(2),  conducting  of<br \/>\n\t\t      Cabaret  dances  without obtaining  the  prior<br \/>\n\t\t      permission from any proper authority is  ille-<br \/>\n\t\t      gal.  Dr. Sharda Prasad Singh who is  Honorary<br \/>\n\t\t      Secretary\t  of   Patna Bankipore Club did\t not<br \/>\n\t\t      show any permission of the    District  Magis-<br \/>\n\t\t      trate or of any other authority for conducting<br \/>\n\t\t      the  Cabaret and he said that he had  not\t ob-<br \/>\n\t\t      tained any such  permission.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t   Therefore,\tDr.  Sharda  Prasad   Singh,<br \/>\n\t\t      Honorary Secretary<br \/>\n\t\t      is  guilty of the aforesaid. offence.   It  is<br \/>\n\t\t      therefore,   prayed  that\t Dr.  Sharda  Prasad<br \/>\n\t\t      Singh,  Honorary Secretary be prosecuted in  a<br \/>\n\t\t      Court of law for violating Section  54(a)\t and<br \/>\n\t\t      Section  57(c) of the Excise Act for which   I<br \/>\n\t\t      have  been<br \/>\n\t\t      authorised  to submit charge sheet to  him  by<br \/>\n\t\t      the  District<br \/>\n\t\t      Magistrate, Patna&#8221;.\n<\/p><\/blockquote>\n<p>\tThese  allegations according to the appellant did not\tcon-<br \/>\n\tstitute\t any offence and hence the appellant filed an appli-<br \/>\n\tcation in the High Court of  Patna under Section 482 of\t the<br \/>\n\tCode of Criminal Procedure for quashing the order passed  by<br \/>\n\tthe Sub-Divisional  Magistrate,\t Patna taking cognizance  of<br \/>\n\tthe offences charged against the appellant.  The<br \/>\n<span class=\"hidden_text\">\t359<\/span><br \/>\n\tHigh  Court by an order dated 4th February,  1976  summarily<br \/>\n\trejected the application.  The appellant thereupon preferred<br \/>\n\tan application to the High Court for leave to appeal to this<br \/>\n\tCourt,\tbut this application was also rejected by  the\tHigh<br \/>\n\tCourt  on  the ground  that the allegations set out  in\t the<br \/>\n\tcomplaint made out a prima-facie case against the appellant.<br \/>\n\tThis  led to the filing of the present appeal  with  special<br \/>\n\tleave obtained from this Court.\n<\/p>\n<p>\t    It is now settled law that where the allegations set out<br \/>\n\tin  the complaint or the charge-sheet do not constitute\t any<br \/>\n\toffence,   it is competent to the High Court exercising\t its<br \/>\n\tinherent  jurisdiction\tunder  Section 482 of  the  Code  of<br \/>\n\tCriminal Procedure to quash the\t order passed by the  Magis-<br \/>\n\ttrate taking cognizance of the offence.\t The question which,<br \/>\n\ttherefore,  arises for consideration is whether the  allega-<br \/>\n\ttions  set  out\t in the\t complaint  constitute\tany  offence<br \/>\n\tagainst\t the  appellant. The offences  charged\tagainst\t the<br \/>\n\tappellant  are under Section 54(1)(a) and Section 57 (c)  of<br \/>\n\tthe  Act.  Section 54(1) (a) provides that if  any  licensed<br \/>\n\tvendor or any person in his employ and acting on his behalf,<br \/>\n\tin  contravention  of Section 25, employs or permits  to  be<br \/>\n\temployed,  in any part of his licensed premises referred  to<br \/>\n\tin   that section  any person under the age of 18  years  or<br \/>\n\tany  women, he shall be\t liable to fine which may extend  to<br \/>\n\tRs.500\/-.   It\tis an essential ingredient of  this  offence<br \/>\n\tthat  the  licensed  vendor should employ or  permit  to  be<br \/>\n\temployed  any women in any part of his licensed premises  in<br \/>\n\tcontravention of Section 25.  Now there can be no doubt that<br \/>\n\tthe  Bankipore Club was a licensed vendor since it  held  an<br \/>\n\t&#8220;OFF&#8221;  licence in Form No. 2 given in the Bihar\t and  Orissa<br \/>\n\tExcise Rules.  We will also assume for the purpose of  argu-<br \/>\n\tment  that  the place where the cabaret was going on  was  a<br \/>\n\tpart  of the licensed premises.. But in order that  the\t al-<br \/>\n\tleged  cabaret\tshould constitute an offence  under  Section<br \/>\n\t54(1) (a), it was necessary that the women who were perform-<br \/>\n\ting  the cabaret should be employed or permitted to  be\t em-<br \/>\n\tployed by the Club and moreover that should in contravention<br \/>\n\tof   Section 25.  Section 25. sub-section (2) provides\tthat<br \/>\n\tno  person who is licensed to sell foreign liquor  for\tcon-<br \/>\n\tsumption on his premises shall, without the  previous  writ-<br \/>\n\tten  permission\t of the Board, during the hours\t  in   which<br \/>\n\tsuch  premises are kept open for business, employ or  permit<br \/>\n\tto be employed, either with or without any remuneration, any<br \/>\n\twoman, in any part of such premises in which such liquor  is<br \/>\n\tconsumed by th.e  public.  It will be seen that this  provi-<br \/>\n\tsion also comes into play only\twhen  a woman is employed or<br \/>\n\tpermitted  to be employed by a person licensed to sell\tfor-<br \/>\n\teign  liquor.  Moreover, the  employment of the woman should<br \/>\n\tbe  &#8220;in\t any part of such premises in which such  liquor  is<br \/>\n\tconsumed  by  the public.&#8221;  It is  therefore,  obvious\tthat<br \/>\n\tthere  could be no offence under Section 54(1)(a) read\twith<br \/>\n\tSection\t 25(2) unless  it could be shown by the\t prosecution<br \/>\n\tthat the women who were performing the cabaret were employed<br \/>\n\tor  permitted  to  be employed by  the Club  and  they\twere<br \/>\n\tperforming  the\t cabaret in a part of the club\tpremises  in<br \/>\n\twhich  liquor  was being consumed: by the public.   We\t may<br \/>\n\tpoint  out that it was contended on behalf of the  appellant<br \/>\n\tthat subsection (2) of Section 25 can have no application in<br \/>\n\tcase of a person who is holding an &#8220;OFF&#8221; licence as distinct<br \/>\n\tfrom  an  &#8220;ON AND OFF&#8221; licence in form No. 3 and  since\t the<br \/>\n\tappellant in the present case was<br \/>\n\t7&#8211;1546 SCI\/76<br \/>\n<span class=\"hidden_text\">\t360<\/span><br \/>\n\tholding an &#8220;OFF&#8221; licence, he could not be guilty of  contra-<br \/>\n\tvention of Section 25, sub-sect\/on (2) and hence no question<br \/>\n\tof offence under Section 54(1)(a) could arise.\tBut we\twill<br \/>\n\tassume\tfor the purpose of argument that the  appellant\t was<br \/>\n\tcovered\t by  Section 25,  subsection (2) and he was bound to<br \/>\n\tobey  the  prohibition contained in that  sub-section.\t But<br \/>\n\teven  so we find that the two essential ingredients  of\t the<br \/>\n\toffence\t under\tSection 54(1)(a) read with Section  25\tsub-<br \/>\n\tsection\t (2)  were not even alleged in the  complaint.\t The<br \/>\n\tcomplaint did not aver that either of the two women who were<br \/>\n\tperforming  the\t cabaret  was employed or  permitted  to  be<br \/>\n\temployed  by the club or that liquor was being\tconsumed  by<br \/>\n\tthe public in that part of the club in which the cabaret was<br \/>\n\tbeing  performed.  No offence  under Section 54(1)(a)  could<br \/>\n\tin  the circumstances be said to have been committed on\t the<br \/>\n\tallegations contained in the complaint.\n<\/p>\n<p>\t    Equally,  it  is difficult to see  how  the\t allegations<br \/>\n\tcontained  in  the complaint could be said to constitute  an<br \/>\n\toffence\t under Section 57(c) That section provides  that  if<br \/>\n\tany  holder  of\t a licence  granted  under the\tAct  or\t any<br \/>\n\tperson\tin his employ or acting on his behalf wilfully\tdoes<br \/>\n\tany act in breach of the condition of the licence for  which<br \/>\n\ta  penalty is not prescribed elsewhere in the Act, he  shall<br \/>\n\tbe  liable to fine which may extend to Rs.500\/-.   The\tcom-<br \/>\n\tplaint does not allege as to which condition of the  licence<br \/>\n\twas broken by the club or the appellant in allowing a  caba-<br \/>\n\tret  to\t be performed in the club premises.  Nor  could\t the<br \/>\n\tlearned\t counsel appearing on behalf of the State point\t out<br \/>\n\tany  such  condition of the licence.  The  allegations\tcon-<br \/>\n\ttained\t in the complaint manifestly did not  constitute  an<br \/>\n\toffence\t under\tSection 57(c).\n<\/p>\n<p>\t    This  was, therefore, clearly a case where\tthe  allega-<br \/>\n\ttions  contained  in the complaint did\tnot  constitute\t any<br \/>\n\toffence\t and the Sub-Divisional Magistrate was in  error  in<br \/>\n\ttaking\tcognizance  of it.  The High Court  in\tthe  circum-<br \/>\n\tstances\t ought not to have rejected the application of\t the<br \/>\n\tappellant  for\tquashing  the order  of\t the  Sub-Divisional<br \/>\n\tMagistrate.\n<\/p>\n<p>\tWe accordingly allow the appeal, set aside the order of\t the<br \/>\n\tHigh  Court  and quash the proceedings in Case No.  2(2)  76<br \/>\n\tTrial No. 285\/76 pending  in the Court in  Mr. S.S.P.
