JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 03\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThese<br \/>\ngroup of petitions have been filed by the petitioners who were<br \/>\nappointed as Vidya Sahayaks and whose appointments have been<br \/>\ncancelled and the petitioners have been discharged from services.<br \/>\nSpecial Civil Application No.4969 of 2011, which is the lead matter,<br \/>\nhas been filed with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tThat<br \/>\nthis Honourable Court may be pleased to issue a writ of mandamus or<br \/>\nany other appropriate writ, order or direction quashing and setting<br \/>\naside the impugned order at Annexure-A dated 7.1.2011 and be further<br \/>\npleased to direct the respondents, their servants, agents and<br \/>\nsubordinates to reinstate the petitioners in service as Vidya Sahayak<br \/>\nwith continuity of service with all other consequential benefits;\n<\/p>\n<p>(B)\tPending<br \/>\nadmission, hearing and till final disposal of this petition, the<br \/>\nHonourable Court may be pleased to stay implementation and operation<br \/>\nof the impugned order at Annexure-A dated 7.1.2011 and be pleased to<br \/>\ndirect the respondents to keep the said post vacant till the final<br \/>\ndisposal of this petition;\n<\/p>\n<p>(C)\tBe<br \/>\npleased to Award costs of this petition;\n<\/p>\n<p>(D)\tBe<br \/>\npleased to grant such other and further relief\/s that may be deemed<br \/>\nto fit, just and proper in the interest of justice;&#8221;\n<\/p>\n<p>2.\tRespondent<br \/>\nNo.4, District Primary Education Officer, issued an advertisement for<br \/>\nappointment of Vidya Sahayaks in District Jamnagar. Pursuant thereto,<br \/>\nthe petitioners applied in the prescribed form, along with necessary<br \/>\ndocuments and were given appointments as Vidya Sahayaks. Certain<br \/>\ncomplaints were received by the authorities regarding purported<br \/>\nirregularities in the process of selection of Vidya Sahayaks.<br \/>\nPursuant thereto, the Director of Primary Education ordered an<br \/>\ninquiry to be conducted. The said inquiry was conducted by the Deputy<br \/>\nDirector of Primary Education. The Inquiry  Officer submitted his<br \/>\nReport on 28-7-2010. After receipt thereof, the Director of Primary<br \/>\nEducation instructed the District Primary Education Officer to<br \/>\ninitiate proceedings, based upon the findings in the Inquiry Report.<br \/>\nThe District Primary Education<br \/>\nOfficer issued show cause notices to  84 persons named in the Report,<br \/>\nincluding the petitioners. The noticees<br \/>\nwere given personal hearing and their statements were recorded.<br \/>\nThereafter, by the impugned order dated 07-01-2011 passed by the<br \/>\nDistrict Primary Education Officer (Respondent No.4), the services of<br \/>\n84 persons, including the petitioners, were terminated. Aggrieved<br \/>\nthereby, the petitioners have approached this Court by filing the<br \/>\npresent petition.\n<\/p>\n<p>3.\tMr.N.D.\n<\/p>\n<p>Gohil, learned advocate for the petitioners has submitted that the<br \/>\nimpugned order has been passed without giving sufficient opportunity<br \/>\nof hearing to the petitioners to defend their cases. That the<br \/>\nremoval of the petitioners from services amounts to a major<br \/>\npunishment which can  only be imposed after holding regular<br \/>\ndepartmental inquiry and after adducing evidence. However, in the<br \/>\npresent case, no such procedure has been followed before passing the<br \/>\nimpugned order. That the action on the part of respondent No.4 is<br \/>\nmalafide, illegal and arbitrary and clearly in violation of  the<br \/>\nprinciples of natural justice. That the certificates\/photographs<br \/>\nsubmitted by the petitioners are genuine and the respondents cannot<br \/>\ncome to the conclusion,  straightaway, that the said Certificates are<br \/>\nnot genuine, without any detailed inquiry and without leading any<br \/>\nevidence or giving  an opportunity of hearing to the petitioners, to<br \/>\ndefend their cases.\n<\/p>\n<p>4.\tA<br \/>\nsimilar issue arose in Special Civil Application No.823 of 2011,<br \/>\nwhich has been finally decided by order dated 15-03-2011. In the said<br \/>\npetition, Mr.Maulik G.Nanavati, learned Assistant Government Pleader,<br \/>\nupon instructions from Mr.R.C.Rawal, Director, Primary<br \/>\nEducation, Government of Gujarat, had stated that:\n<\/p>\n<p>\t&#8220;&#8230;..\n<\/p>\n<p>a Committee comprising of three Officers, including one Officer from<br \/>\nthe Office of the Director, Primary Education, one Officer from the<br \/>\nEducation Department not below the rank of Under Secretary, and the<br \/>\nDistrict Primary Education Officer,Jamnagar who is the appointing<br \/>\nauthority, shall be constituted by the State Government. The said<br \/>\nCommittee will issue individual show cause notices to all 84<br \/>\nindividuals, whose names figure in the Inquiry Report, including the<br \/>\npetitioner, specifying the allegations against them and annexing a<br \/>\ncopy of the Inquiry Report as well as copies of any other documents<br \/>\nrelied upon against them. The concerned individuals may file written<br \/>\nreplies to the show cause notices. Thereafter, each individual shall<br \/>\nbe afforded an opportunity of personal hearing. The personal hearing<br \/>\nshall take place at Jamnagar. Thereafter, individual orders shall be<br \/>\npassed which shall be communicated to the concerned persons by<br \/>\nRegistered Post. Till such time, as the final order is passed, 84<br \/>\nposts of Vidya Sahayaks would be kept vacant in District Jamnagar by<br \/>\nthe District Primary Education Officer.&#8221;\n<\/p>\n<p>5.\tThere<br \/>\nis consensus amongst the learned advocates for the respective parties<br \/>\nthat the petitioners are one of the 84 Vidya Sahayaks in respect of<br \/>\nwhom the above statement was made.\n<\/p>\n<p>6.\tMr.\n<\/p>\n<p>N.D. Gohil, learned advocate for the petitioners states that in case<br \/>\nthe petitioners are found innocent and are absolved of all charges by<br \/>\nthe Committee, they shall claim only continuity of services as though<br \/>\nthe termination had not taken place.\n<\/p>\n<p>7.\tMr.Maulik<br \/>\nG.Nanavati, learned Assistant Government Pleader, in response to the<br \/>\nabove statement of the learned advocate for the petitioners states,<br \/>\nupon instructions that in case the petitioners are found innocent and<br \/>\nare absolved of all the charges by the Committee, an appropriate<br \/>\ndecision regarding continuity of service shall be taken by the<br \/>\nCommittee.\n<\/p>\n<p>8.\tSpecial<br \/>\nCivil Application No.823 of 2001 has been disposed of, with the<br \/>\nfollowing directions:\n<\/p>\n<p>&#8220;(a)\tAs<br \/>\nthe order dated 07-01-2011 suffers from inherent contradictions,<br \/>\ninasmuch as it is stated in the  first paragraph thereof that the<br \/>\nSports Certificates of the petitioner were not appended to the<br \/>\napplication and  in the second paragraph it is stated that the Sports<br \/>\nCertificates have not been certified, whereas, in the third paragraph<br \/>\nit is stated that the Sports Certificates have been submitted<br \/>\nlater on; it clearly appears that the said order has been passed<br \/>\nwithout proper application of mind. It is also not clear from the<br \/>\nsaid order whether one, or all, of the alleged defects  have been<br \/>\nfound in the case of the petitioner as the order is identical in all<br \/>\ncases. It is further noticed that in the said  order it is mentioned<br \/>\nthat the High Court, by order dated 15-9-2010, passed in Special<br \/>\nCivil Application No.8875 of 2010 with Special Civil Application<br \/>\nNo.9412 of 2010, has directed that 84 candidates be  proceeded<br \/>\nagainst, pursuant to the Inquiry Report. However, upon perusal of the<br \/>\nsaid order of this Court, it is found that it contains no such<br \/>\ndirection. The observations made in paragraph 3 of the said order,<br \/>\nwhich appear to have been misunderstood by the respondent, have since<br \/>\nbeen clarified by the Division Bench,  in order dated 31-01-2011,<br \/>\npassed in Letters patent Appeal (St.) No.145 of 2011, wherein it has<br \/>\nbeen stated that such observations cannot be read as a mandate or a<br \/>\ndirection by the High Court to the authority for cancellation of the<br \/>\nappointment.\n<\/p>\n<p>(b)\tIt<br \/>\nhas also been submitted by the learned Senior Advocate<br \/>\nfor the petitioner that before passing the impugned order neither the<br \/>\ndocuments relied upon against the petitioner nor a copy of the<br \/>\nInquiry Report have been given to him. This aspect is not denied<br \/>\nby the learned advocate for respondent No.4 by submitting that the<br \/>\npetitioner did not demand the documents or the Inquiry Report,<br \/>\ntherefore, they were not supplied. The reason for not supplying the<br \/>\ndocuments relied upon against the petitioner and a copy of the<br \/>\nInquiry Report, cannot be countenanced  by this Court.  It is a<br \/>\nsettled position of law that no action entailing adverse, or civil<br \/>\nconsequences, can be taken  without affording the person concerned a<br \/>\nproper and adequate opportunity to meet with the allegations levelled<br \/>\nagainst him. When the copy of the Inquiry Report and documents relied<br \/>\nupon against the petitioner have  not been supplied to him, it cannot<br \/>\nbe  said that an effective or  adequate opportunity of hearing has<br \/>\nbeen afforded. In such circumstances, calling the petitioner for<br \/>\npersonal hearing would amount to a mere formality.\n<\/p>\n<p>(c)<br \/>\nAs the impugned order dated 07-01-2011 has been passed in violation<br \/>\nof the principles of natural justice,<br \/>\nthe same cannot be sustained. It is, therefore, quashed and set<br \/>\naside. As a result thereof, the consequential order dated 04-03-2011<br \/>\n(and any other such order) directing recovery of salary<br \/>\nwould also, not stand. The petitioner shall now appear before the<br \/>\nCommittee to be constituted by the State Government, at the time, and<br \/>\non the date, as shall be intimated by respondent No.4 on behalf of<br \/>\nthe Committee. All communications addressed to the petitioner shall<br \/>\nbe by Registered Post, at the addresses to be supplied by Mr. Saurabh<br \/>\nMehta,  learned advocate who is appearing with the learned Senior<br \/>\nAdvocate for the petitioner, to the learned Assistant Government<br \/>\nPleader and learned advocate for respondents Nos.3 and 4, within a<br \/>\nperiod of  one week from today.\n<\/p>\n<p>(d)\tInsofar<br \/>\nas individuals, other than the petitioner are concerned, the<br \/>\ncommunications would be sent at the addresses mentioned in their<br \/>\napplications,as submitted by the learned Assistant Government<br \/>\nPleader.\n<\/p>\n<p>(e)\tThe<br \/>\nCommittee,  constituted in this regard, shall complete the inquiry,<br \/>\npreferably, within a period of three months from the date of receipt<br \/>\nof a copy of this order. As stated by the learned Assistant<br \/>\nGovernment  Pleader, these 84 posts of Vidya Sahayaks in District<br \/>\nJamnagar shall be kept vacant till the conclusion of the proceedings<br \/>\nof the Committee. In case the order passed by the Committee is<br \/>\nadverse to the petitioner, the same shall not take effect for a<br \/>\nperiod of thirty days from the date of communication of the said<br \/>\norder.&#8221;\n<\/p>\n<p>9.\tIn<br \/>\nview of the consensus amongst the learned advocates for the<br \/>\nrespective parties that the cases of the petitioners are similar to<br \/>\nthe case of the petitioner of Special Civil Application No.823 of<br \/>\n2011, and that the same directions would cover the present case, it<br \/>\nis directed that the directions issued in Special Civil Application<br \/>\nNo.823 of 2011, vide order dated 15-3-2011, shall apply to the cases<br \/>\nof the present petitioners, as well.\n<\/p>\n<p>10.\tThe<br \/>\npetitions are disposed of, as above.\n<\/p>\n<p>  (Smt.
