{"id":146018,"date":"2010-12-13T00:00:00","date_gmt":"2010-12-12T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/nalini-vs-ahmedabad-on-13-december-2010"},"modified":"2015-06-29T04:11:17","modified_gmt":"2015-06-28T22:41:17","slug":"nalini-vs-ahmedabad-on-13-december-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/nalini-vs-ahmedabad-on-13-december-2010","title":{"rendered":"Nalini vs Ahmedabad on 13 December, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Nalini vs Ahmedabad on 13 December, 2010<\/div>\n<div class=\"doc_author\">Author: Jayant Patel,&amp;Nbsp;<\/div>\n<pre>   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nSCA\/6\/2007\t 4\/ 4\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 6 of 2007\n \n\n \n=========================================================\n\n\n \n\nNALINI\nHARESH SHAH - Petitioner(s)\n \n\nVersus\n \n\nAHMEDABAD\nMUNICIPAL CORPORATION &amp; 10 - Respondent(s)\n \n\n=========================================================\nAppearance : \nMR\nJASWANT K SHAH for Petitioner(s) : 1, \nMR\nPRASHANT G DESAI for Respondent(s) : 1 - 3. \nDS AFF.NOT FILED (N)\nfor Respondent(s) : 4 - 5,5.2.2 - 7, 11, \nNone for Respondent(s) :\n5, \nMR PRABHAKAR UPADYAY for Respondent(s) : 8 - 10. \nMR\nRAJESHWAR J DAVE for Respondent(s) : 8 -\n10. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2007 \n\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpetitioner has preferred the petition for the relief inter alia to<br \/>\n\tchallenge the action of the Corporation for the grant of approval<br \/>\n\tfor construction of the building plan.\n<\/p>\n<p>Heard<br \/>\n\tMr. Champaneri with Mr. Shah for the petitioner, Mr. Shelat, Senior<br \/>\n\tAdvocate appearing with Mr.Asthavadi for Mr.Desai for the<br \/>\n\tCorporation and its officers and Mr.Rajeshwar Dave for respondent<br \/>\n\tNos. 8 to 10.\n<\/p>\n<p>Upon<br \/>\n\thearing the learned advocates appearing for both the sides, it<br \/>\n\tappears that there is no dispute on the point that after the<br \/>\n\tentertainment of this petition and the interim order passed by this<br \/>\n\tCourt dated 03.01.2007, the Corporation has suspended the<br \/>\n\tconstruction permission which is subject matter of this petition and<br \/>\n\tthe Corporation has called upon the applicant who submitted the plan<br \/>\n\tto produce the documents including the trustees of the Trust,<br \/>\n\trespondent Nos. 8 to 11 herein, and the Corporation is yet to<br \/>\n\tconsider the matter as to whether the permission granted should be<br \/>\n\trevoked or not.\n<\/p>\n<p>The<br \/>\n\tlearned advocate appearing for both the sides under the instruction<br \/>\n\tof their clients are in agreement on the point that if the<br \/>\n\tCorporation or the competent officer of the Corporation is to decide<br \/>\n\tthe matter and if the petitioner as well as the trustees of the<br \/>\n\ttrust who have purchased the property, are given opportunity of<br \/>\n\thearing and the Corporation is put to the liberty of passing<br \/>\n\tappropriate order\/s in accordance with law, their respective clients<br \/>\n\thave no objection for such purpose, of course without prejudice to<br \/>\n\tthe rights and contentions of either side to challenge the order in<br \/>\n\tthe event the concerned person is aggrieved by the decision of the<br \/>\n\tCorporation.\n<\/p>\n<p>Under<br \/>\n\tthe above circumstances, I find that when the matter is yet to be<br \/>\n\tconsidered before the Corporation on the aspects of revocation of<br \/>\n\tthe plan or otherwise, the petitioner can raise the contentions<br \/>\n\twhich are raised in the present petition seeking revocation of the<br \/>\n\tpermission and\/or cancellation of the permission.  At the same time,<br \/>\n\tthe trustees of the trust, either after purchase of the property or<br \/>\n\tthe applicant who made the application for construction permission<br \/>\n\tin the capacity as Power of Attorney holder, can pursue the matter<br \/>\n\tbefore the Corporation for continuing with the construction<br \/>\n\tpermission already granted.\n<\/p>\n<p>I<br \/>\n\tfind that it may not be necessary for this Court to examine the<br \/>\n\tquestion including on the aspects of the authority of the person who<br \/>\n\tapplied for construction permission and at this stage it should<br \/>\n\tbetter be left to the authority of the Corporation for exercise of<br \/>\n\tthe power in accordance with law.  At the most, if the decision of<br \/>\n\tthe Corporation is against either side, they may resort to the<br \/>\n\tremedy as may be permissible in law.\n<\/p>\n<p>Under<br \/>\n\tthe above circumstances, I find that the following direction shall<br \/>\n\tmeet with the ends of justice :\n<\/p>\n<p>\t\tThe<br \/>\n\tpetitioner as well as the trustees of the trust or the original<br \/>\n\tapplicant before the Corporation may make their suitable<br \/>\n\trepresentation either for cancellation\/ revocation of the<br \/>\n\tconstruction permission and\/or continuing with such permission, as<br \/>\n\tthe case may be, within a period of two weeks from today.\n<\/p>\n<p>\tThe<br \/>\n\tcompetent officer of the Corporation shall take appropriate decision<br \/>\n\tin accordance with law on the aspects as to whether the construction<br \/>\n\tpermission granted should be revoked\/cancelled or should be<br \/>\n\tcontinued and the officer of the Corporation may also give<br \/>\n\topportunity of hearing to the aforesaid concerned parties. Such<br \/>\n\tdecision shall be taken preferably within a period of six weeks from<br \/>\n\tthe receipt of the order.\n<\/p>\n<p>\tThe<br \/>\n\torder which may be passed by the competent officer of the<br \/>\n\tCorporation shall not be implemented for a period of two weeks from<br \/>\n\tthe date of its communication to the petitioner as well as to the<br \/>\n\tapplicant before the Corporation or trustees of the trust.\n<\/p>\n<p>\tIt<br \/>\n\tis made clear that if the either party is aggrieved by the decision<br \/>\n\tof the Corporation, they may resort to the remedy as may be<br \/>\n\tpermissible in law against the said decision.\n<\/p>\n<p>8.\tPetition<br \/>\nis disposed off in terms of the aforesaid directions.
