{"id":146055,"date":"2009-06-11T00:00:00","date_gmt":"2009-06-10T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/dr-amit-sen-gupta-vs-election-commission-of-india-on-11-june-2009"},"modified":"2015-04-13T14:11:59","modified_gmt":"2015-04-13T08:41:59","slug":"dr-amit-sen-gupta-vs-election-commission-of-india-on-11-june-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/dr-amit-sen-gupta-vs-election-commission-of-india-on-11-june-2009","title":{"rendered":"Dr. Amit Sen Gupta vs Election Commission Of India &#8230; on 11 June, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Dr. Amit Sen Gupta vs Election Commission Of India &#8230; on 11 June, 2009<\/div>\n<pre>                       CENTRAL INFORMATION COMMISSION\n                        Appeal No. CIC\/WB\/A\/2009\/00559 dated 11-5-2009\n                           Right to Information Act 2005 - Section 19\n\nAppellant:                  Dr. Amit Sen Gupta\nRespondent:                 Election Commission of India (ECI)\n\n\nFACTS<\/pre>\n<p>           On receipt of a complaint from Shri Somnath Chatterjee MP, the<br \/>\nthen Speaker, Lok Sabha that an appeal filed before the CIC on 14-6-<br \/>\n2006 challenging the decision of the Appellate Authority in the Election<br \/>\nCommission of India has not been disposed of, a fresh appeal was<br \/>\nregistered and comments sought from the Election Commission of India.<br \/>\nThis was followed up with a complaint received through a letter of 8-5-09<br \/>\nof Shri Parsanna Kumar OSD with the Hon&#8217;ble Speaker submitting as<br \/>\nfollows:\n<\/p>\n<blockquote><p>           &#8220;This has reference to the Chief Information Commissioner&#8217;s<br \/>\n           recent tele-conversation with the Hon&#8217;ble Speaker, Lok<br \/>\n           Sabha when he had told the Hon&#8217;ble Speaker that there was<br \/>\n           no record available with the Central Information Commission<br \/>\n           with regard to an appeal filed by Dr. Amit Sen Gupta<br \/>\n<span class=\"hidden_text\">           1<\/span><br \/>\n             before the CIC on 14th June 2006 challenging the decision<br \/>\n           of the Appellate Authority in the Election Commission of<br \/>\n           India.\n<\/p><\/blockquote>\n<blockquote><p>           Please find enclosed a copy of the acknowledgment\/ receipt<br \/>\n           given by the CIC while receiving the appeal filed by Dr. Sen<br \/>\n           Gupta on 14th June 2006.&#8221;<\/p><\/blockquote>\n<p>         The genesis of the appeal of Dr. Amit Sen Gupta had arisen as<br \/>\nfollows:\n<\/p>\n<blockquote><p>           &#8220;It appeared from the media that the Hon&#8217;ble Rashtrapatiji, has<br \/>\n           forwarded an alleged complaint supposed to have been made by<br \/>\n           Shri Mukul Roy against some Members of Parliament and the same<br \/>\n           has been referred to the Election Commission of India. As on<br \/>\n           adequate information was available in this regard, I duly submitted<br \/>\n           a request in writing on 27th March, 2006, addressed to the Public<br \/>\n           Information Officer (PIO), Election Commission of India, seeking<br \/>\n           relevant information and particulars and copies of the document or<br \/>\n           documents relating to this matter, under the provisions of the RTI<br \/>\n           Act 2005 (copy of my petition is enclosed). Subsequently, reminded<br \/>\n<span class=\"hidden_text\">1<\/span><br \/>\n    Emphasis added clarifying that the appeal was not from Hon&#8217;ble Shri Chatterjee.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                  1<\/span><\/p>\n<blockquote><p>       the PIO of my request in the telephonic conversations I had with<br \/>\n      him and also in writing through my letters dated 29th March, 2006<br \/>\n      and 5th April 2006 (copies enclosed).\n<\/p><\/blockquote>\n<blockquote><p>      In response, I have received a purported communication (No.<br \/>\n      4\/RTI\/25\/2006\/JS-II) dated 13th April 2006 from the PIO in his<br \/>\n      capacity as the Under Secretary of the Election commission stating<br \/>\n      that &#8220;The Commission has decided that copies of documents,<br \/>\n      decisions or pleadings relating to such reference cases can not be<br \/>\n      supplied until opinion is tendered and the President&#8217;s Order in the<br \/>\n      matter is published. Accordingly, your request referred to in the<br \/>\n      above mentioned letter cannot be acceded to&#8221;.<\/p><\/blockquote>\n<p>     After tracing the trajectory of this application through its first appeal,<br \/>\nDr Sen Gupta therefore, concluded his appeal before us with the following<br \/>\nremarks:\n<\/p>\n<blockquote><p>      &#8220;With these facts placed before you, Sir, I pray for setting<br \/>\n      aside the order No. 4 \/RTI\/2006\/JS-II\/VOL-II\/17 dated 1st<br \/>\n      June 2006 issued by Shri K. F. Wilfred, Appellate Authority<br \/>\n      under the RTI Act, 2005 in the ECI and for issuances of<br \/>\n      orders upholding my right to ask for and get the said<br \/>\n      information.&#8221;<\/p><\/blockquote>\n<p>      He has then gone on to describe in detail the grounds for his plea. On<br \/>\nthis basis the comments of the Election Commission were sought, in response<br \/>\nto which Shri Ho Ram, CPIO &amp; Under Secretary, Election Commission of India<br \/>\nhas after a brief description of the background submitted as follows:\n<\/p>\n<blockquote><p>      &#8220;It appears from the contents of the documents enclosed<br \/>\n      vide your above said notice dated 13.5.2009 that your office<br \/>\n      has missed the record of the above said case. And, I am of<br \/>\n      the view that as the CIC had already decided the matter and<br \/>\n      the follow up action had also been taken by the then CPIO,<br \/>\n      there is noting to be added on part of the Commission in the<br \/>\n      matter.\n<\/p><\/blockquote>\n<blockquote><p>      However, you are requested to intimate the further course of<br \/>\n      action, if any, that needs to be taken on part of the<br \/>\n      Commission, before 11.6.2009.&#8221;<\/p><\/blockquote>\n<p>      We find that we have indeed disposed of this appeal by our decision<br \/>\nnotice of 26-12-2006 as follows:\n<\/p>\n<blockquote><p>      Since the documents have been sought at a time when the<br \/>\n      matter was under investigation by no less than Hon&#8217;ble<br \/>\n      President of India, the Election Commission of India cannot<br \/>\n      be faulted for withholding it. Under Article 103(2) of the<br \/>\n      Constitution in deciding on questions of disqualification of<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><br \/>\n       members; &#8220;Before giving any decision on any such question,<br \/>\n      the President shall obtain the opinion of the Election<br \/>\n      Commission and shall act according to such opinion.&#8221; Since<br \/>\n      the matter in question was at the time under investigation,<br \/>\n      and concerned sitting MPs the public authority could have<br \/>\n      examined whether disclosure would have been in breach<br \/>\n      either of Sec 8(1) (c) or (h). Appellate Authority has instead<br \/>\n      chosen recourse to only Sec 8 (1) (e) in describing the<br \/>\n      relationship between President and ECI in dealing with<br \/>\n      matters under Article 103(2) of the Constitution, and holding<br \/>\n      the information sought exempt. This has been further<br \/>\n      explained in the response received by us to the appeal<br \/>\n      Notice through Secretary, ECI&#8217;s letter of 30\/11\/&#8217;06. The<br \/>\n      argument now becomes largely hypothetical as the<br \/>\n      information now being available; it may be made available to<br \/>\n      Dr. Sen Gupta appellant on payment of the requisite fee,<br \/>\n      provided he is still interested in obtaining it, since he did not<br \/>\n      appear before us in the hearing.\n<\/p><\/blockquote>\n<blockquote><p>      The only remaining issue is whether the responses sent by<br \/>\n      PIO and appellate authority to appellant Dr Sen Gupta were<br \/>\n      in violation of Sec 7(1). Although transgression of time limit<br \/>\n      is not cited as the basis of relief sought in appellant&#8217;s appeal<br \/>\n      before us that is stated in the supporting documents<br \/>\n      submitted with the 2nd appeal. The RTI request was made<br \/>\n      on 27\/3\/&#8217;06. We find that the response from PIO, was<br \/>\n      completed by 18\/4\/&#8217;06, with two letters dated 13\/4 and 18\/4.<br \/>\n      The appeal dated 1\/5\/&#8217;06 has been disposed of on 1\/6\/&#8217;06. In<br \/>\n      his response to our Appeal Notice, Shri Wilfred has indicated<br \/>\n      that the appeal was in fact received by him on 2\/5\/&#8217;06, thus<br \/>\n      addressing a possible charge of a day&#8217;s delay beyond the<br \/>\n      thirty days mandated. We cannot find any grounds to invoke<br \/>\n      penalty u\/s 20.&#8221;<\/p><\/blockquote>\n<p>      As is clear from the above, appellant Dr. Amit Sen Gupta had opted not<br \/>\nto appear in the hearing of the appeal. In the present case we had issued a<br \/>\nhearing notice for 11th June, 2009, the copy was also endorsed to Dr. Amit Sen<br \/>\nGupta, in case he wished to appear. None of the parties are present, although<br \/>\nwe have the written response of ECI quoted above.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>      Since the appeal of Dr. Amit Sen Gupta stands disposed of through our<br \/>\ndecision of 26-12-2006, a decision moreover that has remained unchallenged,<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><br \/>\n we find the present complaint\/appeal infructuous and it is hereby filed.<br \/>\nAnnounced in the hearing.\n<\/p>\n<p>      Notice of this decision be given free of cost to the parties.
