3. By the impugned judgement and order, the<\/p>\n
Commissioner has granted compensation of ?.1,01,664\/- with<\/p>\n
interest at 12% p.a. from 30 days after the accident.  <\/p>\n
4. Aggrieved by that, the <\/p>\n
Company has \ufb01led this appeal.\n<\/p>\n
5. In brief, the facts are; The 15fArespcndentecfairriant<\/p>\n
was working as a driver in the’}orryV”be’a1’ing”V1\\\u00a7oi.’1\u00ab31B;3383iC’<\/p>\n
belonging to the 2nd respondent.____d:}i’hat,on  the 13′<\/p>\n
respondent was retuming””to’ pHa.sS3’3.VI:1.uR’Qf1TB..M.ROad, in front<\/p>\n
of APMC Yard;  the bus bearing No.
\nKA–13-F~13’1.1′.= \u00abof that, the 1st respondent<\/p>\n
sustained. _ inj1i’ries=.vand Vclairned compensation. The<\/p>\n
“has ayifarded a sum of ?.1,01,644\/– with<\/p>\n
inte–reVst~  from 30 days after the accident.<\/p>\n
dw\ufb01ggrieyed by  the appeI1ant–Insurance Company has filed<\/p>\n

6. The Learned Counsel for the appe1Iant–Ins_nrance
\nCompany contended that the Commissioner in
\ntaking the loss of earning capacity of the 15′
\n25%. He also submitted that the doctor..has.’_”de_poVsIed.”that
\nfirst respondent has suffered permaf1.erit_ddisabtilityyvctf
\nrespect of the Whole body and’\u00abth’erefore;__ .theVd:’Cao:m’n1’is’sionerit
\nwas not justified in takingypthe  earpning ‘capacity of the
\nfirst respondent at 25%}  that the
\nCommissioner   at 12% PR1.\n<\/p>\n

of the body. ‘IV;h-ed dvoctor Ah.as..-deposed that the first respondent<\/p>\n
 permar1entA’disabi1ity of 18% in respect of the<\/p>\n
who1e’..:C’f’ommissioner has taken the loss of earning<\/p>\n
Vi”n….vcapacity”at v;25′?’g’iVWhich is not correct. The Commissioner<\/p>\n
-4 should haveptaken the loss of earning capacity at 18% in View<\/p>\n
pV”the_p_d’octor’s evidence. Therefore, the loss of earning<\/p>\n
“fcapa_city is taken at 18%. If the loss of earning capacity is<\/p>\n

taken at 18% and the relevant factor of 169.44 is applied to
\n60% of the wages 1.e., ‘\u20ac2,400\/~. the compensation payable<\/p>\n
comes to ?.?’3,198\/– and it is rounded off to \u20ac73,200\/;;c\u00ab\u00abealp”i_<\/p>\n
10. The Commissioner has awarded 112% 2 <\/p>\n
p.a. from 30 days after the accident whichplijs <\/p>\n
