DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/06\/2010 \n\n \n\n \nCOMMON\nORAL ORDER<\/pre>\n<p>\tThe<br \/>\nchallenge in these petitions under Articles 226 and 227 of the<br \/>\nConstitution of India is the orders dated 20.05.2010 passed by the<br \/>\nlearned Additional Sessions Judge, Bhavnagar in Criminal Revision<br \/>\nApplication Nos.35 &amp; 36 of 2010 whereby the orders passed by the<br \/>\nlearned Magistrate are confirmed by which custody of the livestock of<br \/>\n16 bullocks is refused to the petitioners, who are facing offences<br \/>\npunishable under Section 11 of the Prevention of Cruelty to Animals<br \/>\nAct and under Sections 119 of the Bombay Police Act and under<br \/>\nSections 91 and 92 of the Motor Vehicle Act in complaint being II-CR<br \/>\nNo.19 of 2010.\n<\/p>\n<p>\tThat<br \/>\nthe ownership of the livestock in question i.e. 16 bullocks of the<br \/>\npetitioners is not disputed.  Even the representatives of the<br \/>\nPanjrapole had no objection if the interim custody of the livestock<br \/>\nis handed over to the petitioners.  In spite of the above fact, the<br \/>\ncourts below have refused to exercise discretionary jurisdiction in<br \/>\nfavour of the petitioners and thereby refused to hand over custody of<br \/>\nthe livestock.\n<\/p>\n<p>\tIn<br \/>\nthese petitions, rule is already issued on 28.05.2010.\n<\/p>\n<p>\tHaving<br \/>\nheard learned advocates for the parties and considering the facts and<br \/>\ncircumstances of the case, I am of the opinion that during the<br \/>\npendency of criminal case against the petitioners, custody of<br \/>\nlivestock of 16 bullocks is to be handed over to the petitioners, and<br \/>\ntherefore, Gadhada Mahajan Panjrapole, Gadhada is directed to hand<br \/>\nover 16 bullocks to the petitioners.\n<\/p>\n<p>\tDuring<br \/>\nthe pendency of criminal cases, applicants will maintain record of<br \/>\nthe livestock viz. 16 bullocks and shall seek permission in case of<br \/>\nsale, transfer etc. of the same.\n<\/p>\n<p>\tThis<br \/>\norder is passed since no objection of the representatives of Gadhada<br \/>\nMahajan Panjrapole, Gadhada, is recorded by the courts below.\n<\/p>\n<p>\tAccordingly,<br \/>\nboth these petitions are allowed.
