DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-33 of 2011 with Ankleshwar Rural Police Station,<br \/>\nDistrict:Bharuch, for the offences punishable under Sections 409,<br \/>\n204, 114, 467, 120(B) of the Indian Penal Code, Sections 13(1)(c),\n<\/p>\n<p>(d)(2) of the Prevention of Corruption Act, 1988 and Section-3(B) of<br \/>\nPrevention of Damage to Public Property Act.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the applicant submits that the ONGC initiated in-house<br \/>\ninquiry fixing liability of the officer, negligence is attributed to<br \/>\none Shri Shahjahan.  Besides the reference about demand draft and<br \/>\nnumbers allegedly sent to the son of the applicant studying at VIT<br \/>\nare in dispute, the accused may be enlarged on bail imposing suitable<br \/>\nconditions, as other co-accused are enlarged on bail.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\nallegations and  role attributed to the applicant,  without<br \/>\ndiscussing the evidence in detail, prima facie, this Court is of the<br \/>\nopinion that this is a fit case to exercise the discretion to enlarge<br \/>\nthe applicant on bail.\n<\/p>\n<p>\tHence,<br \/>\nthe application is allowed and the applicant is ordered to be<br \/>\nreleased on bail in connection with  first information report<br \/>\nregistered at C.R.No.I-33 of 2011 with Ankleshwar Rural ACB Police<br \/>\nStation, District:Bharuch, on his executing a bond of Rs.5,000\/-<br \/>\n(Rupees five thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. and 3 p.m till commencement of the<br \/>\n\ttrial.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case. At the trial, the trial court shall not<br \/>\nbe influenced by the observations of preliminary nature, qua the<br \/>\nevidence at this stage, made by this Court while enlarging the<br \/>\napplicant on bail.
