Case (C).No.1444 OF 2008\n                  -------------------------------------------\n             Dated this the 31st day of October, 2008\n\n\n                              JUDGMENT\n<\/pre>\n<p>     This contempt case is filed with reference to judgment in<\/p>\n<p>W.P(C).21891\/08. The petitioner herein is the writ petitioner.<\/p>\n<p>Reference hereinafter is made on the basis of the status of<\/p>\n<p>parties in the writ petition.\n<\/p>\n<\/p>\n<p>     The third respondent is a primary co-operative bank. It had<\/p>\n<p>advanced a loan to one person by name Reghunath. He did not<\/p>\n<p>repay. The third respondent, therefore, initiated proceedings<\/p>\n<p>under the CARD Bank Act. A portion of the property was sold in<\/p>\n<p>auction.     The institution represented by the petitioner<\/p>\n<p>purchased that item. With that, the provisions of the CARD Bank<\/p>\n<p>Act operate and the purchaser gets title. It appears that after<\/p>\n<p>the mortgage was created in favour of the third respondent,<\/p>\n<p>there was certain criminal proceedings against the debtor<\/p>\n<p>Reghunath and the learned Magistrate has issued an order of<\/p>\n<p>COC.1444\/08<\/p>\n<p>                          Page numbers<\/p>\n<p>attachment as a distress action, by which, the property is under<\/p>\n<p>attachment of a criminal court. Obviously therefore, there will<\/p>\n<p>be some confusion regarding the registration of the transfer in<\/p>\n<p>favour of the petitioner. Under such circumstances, no case of<\/p>\n<p>contempt of court comes out, though the third respondent bank<\/p>\n<p>has to take effective steps to clear the muddle by moving the<\/p>\n<p>competent civil court in relation to the attachment and obtain<\/p>\n<p>orders.
