SIRI JAGAN, J.\n                  ------------------------------------\n                    W.P.(C)No.10332 OF 2007\n               ----------------------------------------\n               Dated this the 15th day of October, 2008\n\n                             JUDGMENT\n<\/pre>\n<p>      The petitioner is the owner of an autorickshaw.            The<\/p>\n<p>autorickshaw was seized on allegations of commission of an<\/p>\n<p>abkari offence using that vehicle. Confiscation proceedings were<\/p>\n<p>initiated, which resulted in Ext.P2 order confiscating the vehicle<\/p>\n<p>to the Government.        The petitioner approached this Court by<\/p>\n<p>filing a writ petition, in which the appellate authority was directed<\/p>\n<p>to dispose of the appeal filed by the petitioner. Pursuant thereto,<\/p>\n<p>the appellate authority passed Ext.P5 order, whereby the<\/p>\n<p>petitioner&#8217;s appeal was rejected and the confiscation was<\/p>\n<p>confirmed with some modification to the effect that the vehicle<\/p>\n<p>may be returned on payment of the market value of the vehicle.<\/p>\n<p>The Excise Commissioner passed a further proceedings, Ext.P6<\/p>\n<p>rejecting a petition dated 8.1.2007 filed by the petitioner in this<\/p>\n<p>regard. There is a dispute as to whether the petitioner had filed<\/p>\n<p>an application dated, 8.1.2007 or not.             According to the<\/p>\n<p>petitioner, the petitioner filed Ext.P7 revision dated 10.10.06. I<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.29835\/08               2<\/span><\/p>\n<p>need not consider that dispute in so far as the Supreme Court<\/p>\n<p>has finally held that no revision is maintainable against the<\/p>\n<p>appellate order under the Abkari Act in the decision <a href=\"\/doc\/1546846\/\">State of<\/p>\n<p>Kerala V. Avinasiappan<\/a> [2004(1) KLT 867]. The incident,<\/p>\n<p>which led to the confiscation proceedings happened as<\/p>\n<p>follows:-\n<\/p>\n<p>      2.    The vehicle was apprehended along with 2.5 litres<\/p>\n<p>of arrack at a time when three persons and the driver were<\/p>\n<p>allegedly consuming liquor inside the autorickshaw.         Since<\/p>\n<p>possession of arrack is prohibited under the Abkari Act and<\/p>\n<p>consumption of liquor in a public vehicle is an offence under<\/p>\n<p>the Abkari Act, confiscation proceedings were initiated which<\/p>\n<p>resulted in the impugned orders.\n<\/p>\n<p>      3.    The petitioner&#8217;s contention is that the petitioner had<\/p>\n<p>specifically contended that she had no knowledge about the<\/p>\n<p>use of the vehicle for commission of the offence alleged and<\/p>\n<p>she had taken all precautions against such illegal use of the<\/p>\n<p>vehicle    and    in  such   circumstances,     the  confiscation<\/p>\n<p>proceedings are unsustainable.\n<\/p>\n<p>      4.    The respondents have filed a counter affidavit<\/p>\n<p>supporting the impugned orders.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.29835\/08               3<\/span><\/p>\n<p>      5.    It is not disputed before me that the autorickshaw<\/p>\n<p>contained 2.5 litres of arrack and that three persons were<\/p>\n<p>consuming liquor in the autorickshaw. Of course, originally,<\/p>\n<p>the allegation was that the driver also consumed liquor, but in<\/p>\n<p>the criminal proceedings, the driver had been acquitted and<\/p>\n<p>the other three persons were convicted.       That being so, it<\/p>\n<p>cannot now be disputed that the autorickshaw in question had<\/p>\n<p>been used in the commission of an abkari offence. In such<\/p>\n<p>circumstances, the confiscation proceedings can be challenged<\/p>\n<p>by the petitioner only by proving the ingredients of Section<\/p>\n<p>67C(2) of the Abkari Act.     Under Section 67C(2) in order to<\/p>\n<p>avoid the confiscation proceedings, the petitioner must prove<\/p>\n<p>that the transportation of the arrack and consumption of the<\/p>\n<p>same in the autorickshaw were without the knowledge or<\/p>\n<p>connivance of the owner or her agent and the person in charge<\/p>\n<p>of the vehicle and that each of them had taken all reasonable<\/p>\n<p>and necessary precautions against such illegal use. The onus<\/p>\n<p>of proving the same is squarely on the petitioner.        So the<\/p>\n<p>minimum the petitioner had to do, to avoid the confiscation<\/p>\n<p>proceedings, was to prove the ingredients of Section 67C(2) of<\/p>\n<p>the Abkari Act. In this case, apart from filing an objection, the<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.29835\/08               4<\/span><\/p>\n<p>petitioner had not taken any steps in that regard. She did not<\/p>\n<p>even offer to give oral evidence in support of her case that she<\/p>\n<p>had no knowledge or connivance in the commission of the<\/p>\n<p>offence and that she had taken all necessary precautions<\/p>\n<p>against such illegal use of the vehicle. Without proving the<\/p>\n<p>same, the petitioner cannot succeed in the challenge against<\/p>\n<p>the impugned orders.        Admittedly, apart from filing the<\/p>\n<p>objections, no proof whatsoever was offered by the petitioner<\/p>\n<p>in this regard.      That being so, the onus cast upon the<\/p>\n<p>petitioner under Section 67C(2) of the Abkari Act has not been<\/p>\n<p>discharged.      Without discharging the same, the petitioner<\/p>\n<p>cannot successfully challenge the impugned orders.<\/p>\n<p>      Therefore, I do not find any merit in this writ petition and<\/p>\n<p>accordingly the same is dismissed.\n<\/p>\n<\/p>\n<p>                                       S.
