No.35613 of 2008\n          ------------------------------------------------\n          Dated this the 3rd day of December, 2008\n\n                        JUDGMENT\n<\/pre>\n<p>    Heard the counsel for the petitioners.<\/p>\n<p>    2. This Writ Petition is filed assailing<\/p>\n<p>Ext.P5  order      passed          by       the        court below<\/p>\n<p>refusing to stay the suit O.S.41\/03 on its<\/p>\n<p>file under Section 10 of the C.P.C.<\/p>\n<p>    3. Petitioners who are defendants 1, 3, 4<\/p>\n<p>and  5  in  the       suit        filed        I.A.3388\/08     for<\/p>\n<p>staying the suit under Section 10 of the C.P.C<\/p>\n<p>till disposal of A.S.176\/02 and it is that<\/p>\n<p>I.A. that was dismissed vide Ext.P5 order<\/p>\n<p>refusing to stay the suit as prayed for.<\/p>\n<p>Counsel for the petitioners submits that the<\/p>\n<p>petitioners are not parties in A.S.176\/02. If<\/p>\n<p>the petitioners are not parties to the said<\/p>\n<p>suit the fact that the said appeal is pending<\/p>\n<p>is not a matter of concern for the petitioners<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.35613 of 2008          -2-<\/span><\/p>\n<p>      and a disposal of that appeal will not be<\/p>\n<p>      having         any   bearing in  the present suit,<\/p>\n<p>      O.S.41\/03. Counsel further submits that the<\/p>\n<p>      suit O.S.11\/97 from the judgment against which<\/p>\n<p>      is A.S.176\/02 filed was a suit filed under<\/p>\n<p>      Section 90 of the C.P.C and under Order I Rule<\/p>\n<p>      8 and that the suit being in a representative<\/p>\n<p>      capacity the finding in that suit will have<\/p>\n<p>      bearing on the issues involved for decision in<\/p>\n<p>      O.S.41\/03 as well. All the same, he submits<\/p>\n<p>      that        it     was  for non-compliance of  the<\/p>\n<p>      requisite formalities to be complied with in a<\/p>\n<p>      suit under Order I Rule 8 C.P.C that the said<\/p>\n<p>      suit O.S.11\/97 was dismissed. If so, obviously<\/p>\n<p>      there is no meaning in saying that the said<\/p>\n<p>      suit was a representative suit. The court<\/p>\n<p>      below has observed in para 4 of Ext.P5 order<\/p>\n<p>      as follows:-\n<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.35613 of 2008                -3-<\/span><\/p>\n<blockquote><p>                      &#8220;The subject matter and relief sought for in this<br \/>\n              suit is different from O.S.11\/97. So the final decision in<br \/>\n              the previous suit would not operate as res judicata in<br \/>\n              the subsequent suit. Cause of action in both suits are<br \/>\n              also different. So there is no possibility of two<br \/>\n              divergent and contradictory verdicts by one and same<br \/>\n              court in respect of the same relief. So I find no<br \/>\n              compelling circumstances to stay this suit u\/s 10 CPC<br \/>\n              till disposal of A.S.176\/02 pending before the Hon&#8217;ble<br \/>\n              High Court.&#8221;<\/p><\/blockquote>\n<p>              4.      The    dismissal       of     I.A.3388\/08         vide<\/p>\n<p>      Ext.P5 order in the circumstances, cannot be<\/p>\n<p>      faulted and there is no merit in this Writ<\/p>\n<p>      Petition.\n<\/p>\n<pre>              5.
