Justice K.HEMA\n\n Dated :07\/07\/2010\n\n O R D E R\n                                K.HEMA, J.\n                            ------------------\n                        B.A. No. 3277 of 2010\n                  ------------------------------------\n                 Dated this the 7th day of June, 2010\n\n                                O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2.   The alleged offences are under Sections 143, 147, 148,<\/p>\n<p>149, 452, 323 and 324 of the Indian Penal Code.        According to<\/p>\n<p>prosecution, petitioners(accused nos. 1 to 5) formed themselves<\/p>\n<p>into an unlawful assembly and committed house trespass into the<\/p>\n<p>house of the de facto complainant and assaulted de facto<\/p>\n<p>complainant and thereby committed the various offences. Stone<\/p>\n<p>was used for the commission of the offences.<\/p>\n<p>      3. Learned counsel for petitioners submitted that there was a<\/p>\n<p>scuffle between de facto complainant and his brother        in their<\/p>\n<p>house. Petitioner went to the house and intervened in the quarrel<\/p>\n<p>but the petitioners are implicated as an accused. Petitioners are<\/p>\n<p>neighbours of the de facto complainant. Petitioners were prepared<\/p>\n<p>to appear before the investigating officer and explained their<\/p>\n<p>innocence and this court directed them to appear before the<\/p>\n<p>investigating officer and they were also questioned.<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3277 \/ 2010               2<\/span><\/p>\n<p>      4. Learned Public Prosecutor submitted that petitioners were<\/p>\n<p>questioned by the investigating officer when they appeared before<\/p>\n<p>them under the directions from this court. He also submitted that<\/p>\n<p>stones allegedly used for the offences are already seized. This<\/p>\n<p>petition is not opposed.\n<\/p>\n<p>      5. On hearing both sides, I am satisfied that petitioners can<\/p>\n<p>be granted anticipatory bail on the conditions. Hence, the following<\/p>\n<p>order is passed:\n<\/p>\n<blockquote><p>            1.   Petitioners shall, in the event of their arrest<\/p>\n<p>                  be    released on    bail  on their executing<\/p>\n<p>                  bond for Rs. 10,000\/- with two solvent<\/p>\n<p>                  sureties each for the like sum to the<\/p>\n<p>                  satisfaction of the arresting officer on the<\/p>\n<p>                  following conditions:\n<\/p><\/blockquote>\n<blockquote><p>                      i).  Petitioners shall report before<br \/>\n                           the investigating officer as and<br \/>\n                           when directed and co-operate<br \/>\n                           with the investigation.\n<\/p><\/blockquote>\n<blockquote><p>                      ii). Petitioners shall not influence or<br \/>\n                           intimidate any witness or tamper<br \/>\n                           with the evidence.\n<\/p><\/blockquote>\n<blockquote><p>            2). This order will be in force only for a period<br \/>\n                  of 15 days from today and the petitioners<br \/>\n                  shall seek regular bail from the court<br \/>\n                  concerned within such time.\n<\/p><\/blockquote>\n<blockquote><p>      This petition is allowed.<\/p>\n<p>                                          K.
