    Petitioner is the plaintiff in O.S.No.29\/04 on<\/p>\n
the file of the Munsiff’s Court, Haripad.        He<\/p>\n
instituted the said suit against the respondents<\/p>\n
for fixation of boundary, for permanent prohibitory<\/p>\n
injunction  as  also   for  mandatory   injunction.<\/p>\n
Another suit O.S.No.46\/04 was filed by defendants 1<\/p>\n
and  3  in  O.S.No.29\/04  against  the  petitioner\/<\/p>\n
plaintiff for declaration of prescriptive easement<\/p>\n
right of way. A counter claim was also advanced in<\/p>\n
O.S.No.29\/04 aforesaid.  The two cases were being<\/p>\n
jointly tried treating O.S.No.29\/04 as the leading<\/p>\n
case.\n<\/p>\n
    2.   In the course of trial, the petitioner\/<\/p>\n
plaintiff  filed  a   commission  application   for<\/p>\n
measurement of the properties with the assistance<\/p>\n
of a surveyor.  The prayer was to measure out the<\/p>\n
properties on the basis of partition Deed No.655\/<\/p>\n
1104 M.E. of Sub Registry Office, Karthikappally.<\/p>\n

Respondents also requested the court to ascertain<\/p>\n
matters, which they set out in their objections<\/p>\n
filed to the commission application. The trial<\/p>\n
court allowed that prayer.  The Commissioner filed<\/p>\n
a report wherein, he has stated that even though<\/p>\n
the old survey plan regarding plaint A, B and C<\/p>\n
schedule properties was produced before him, that<\/p>\n
was not a sub division plan and therefore, he could<\/p>\n
not measure out the properties on the basis of old<\/p>\n
survey plan and that therefore, he measured out the<\/p>\n
properties on the basis of re-survey plan. He also<\/p>\n
expressed his inability to measure out the property<\/p>\n
on the basis of the old survey plan.  However, the<\/p>\n
petitioner filed an application (I.A. No.486\/08) to<\/p>\n
set aside the commission report. It was alleged<\/p>\n
therein that the Commissioner refused to measure<\/p>\n
out the properties on the basis of old survey plan<\/p>\n
even though such a plan was produced before the<\/p>\n
Commissioner.\n<\/p>\n

     3.    The court below observed that there is no<\/p>\n
serious allegation regarding measurement of the<\/p>\n
properties based on re-survey plan and therefore,<\/p>\n
without setting aside the commission report, he<\/p>\n
directed    the  Commissioner  to  measure  out  the<\/p>\n
properties on the basis of old survey plan and<\/p>\n
partition deed and ascertain items 1 to 4 mentioned<\/p>\n
in I.A.No.1113\/06. Accordingly, the Commissioner<\/p>\n
filed another supplementary report wherein also, he<\/p>\n
expressed his inability to locate the properties on<\/p>\n
the basis of old survey plan.    The court below was<\/p>\n
of   the    view  that   the  stand  taken   by  the<\/p>\n
Commissioner is true. The trial court, therefore,<\/p>\n
disallowed the request to set aside that report as<\/p>\n
well and observed that he is not prepared to direct<\/p>\n
the   Commissioner  to  do  an  impossible  act  and<\/p>\n
dismissed    the   application  for   remitting  the<\/p>\n
commission report again. It was also observed that<\/p>\n
both the cases are ripe for trial and are included<\/p>\n
for trial in the special list to 4.2.2009 and that<\/p>\n

at the time of trial, if the petitioner\/plaintiff<\/p>\n
succeeds in producing more evidence to show that it<\/p>\n
is possible to locate the properties on the basis<\/p>\n
of old survey plan, his prayer for measuring out<\/p>\n
the properties on the basis of old survey plan will<\/p>\n
be   considered    at   that   stage.  It   is   being<\/p>\n
dissatisfied with the said order, dismissing I.A.<\/p>\n
No.1688\/08,     that  the   petitioner\/plaintiff   has<\/p>\n
approached this Court seeking to have Exhibit P15<\/p>\n
order set aside and to direct the court below to<\/p>\n
appoint a new Commissioner for ascertaining the<\/p>\n
matters requested for in Exhibit P3 application and<\/p>\n
also to prepare a report and plan in accordance<\/p>\n
with old survey plan with the assistance of a Taluk<\/p>\n
surveyor.\n<\/p>\n
     4.    It is vehemently contended before me by the<\/p>\n
learned counsel for the petitioner that Exhibits<\/p>\n
P11 and P12 are sub division plans as per old<\/p>\n
survey numbers and that the Commissioner could have<\/p>\n
relied on on those sub division plans for the<\/p>\n

purpose of measuring out the properties as per old<\/p>\n
survey plan.   It is seen that both, in Exhibits P11<\/p>\n
and P12, the Assistant Director of Survey and Land<\/p>\n
Records, Central Survey office, Thiruvananthapuram<\/p>\n
has endorsed that those are copies prepared during<\/p>\n
the year 1959 by the concerned officials of Survey<\/p>\n
Department, but not authenticated to be correct and<\/p>\n
that    for  verifying  with   the  originals,   the<\/p>\n
originals are not available now. Such being the<\/p>\n
endorsement on Exhibits P11 and P12, it is futile<\/p>\n
to contend that measurement as per old survey plan<\/p>\n
and sub division sketch should have been made on<\/p>\n
the basis of Exhibits P11 and P12 survey plans.<\/p>\n
There is, thus, no merit in advancing a contention<\/p>\n
that the commission report has to be set aside and<\/p>\n
that a fresh commission has to be issued when the<\/p>\n
petitioners are not able to furnish or cause to be<\/p>\n
produced any plan in relation to the properties as<\/p>\n
per old survey plan.   However, the court below has<\/p>\n
observed    that at  the  time  of  trial,  if   the<\/p>\n

plaintiff succeeds in producing more evidence to<\/p>\n
show that it is possible to locate the property on<\/p>\n
the basis of old survey plan, his prayer for<\/p>\n
measuring out the properties on the basis of old<\/p>\n
survey plan will be considered at that stage.    For<\/p>\n
the said relief, proper application can be moved<\/p>\n
before the trial court if at all circumstances<\/p>\n
enable the petitioners to move such a petition<\/p>\n
producing more evidence.\n<\/p>\n
     This writ petition, as matters stand, is devoid<\/p>\n
of merit and is dismissed.\n<\/p>\n
