With the consent of the parties the matter is taken\nup for hearing today. \n\n \n\n \n\n\n \n\n2.\t\tBoth\nthese appeals arise out of the common order passed by the learned\nCity Civil Court, Ahmedabad in  order below Notice of Motion Exh.6\/7\nfiled in Civil Suit No. 614 of 2008 and  Chamber Summons Exh. 21\/22\nfiled in Civil Suit No. 1145 of 2008, whereby the Notice of Motion\nExh.6\/7 was dismissed and Chamber Summons Exh. 21\/22 was partly\nallowed directing the defendant of Civil Suit No. 1145 of 2008 to\ndeposit mesne profit of Rs.6,000\/- per month from the date of\nfiling of the Civil Suit No. 614 of 2008 and regularly every month\ntill further order.\n \n\n \n\n\n \n\n3.\t\tHeard\nlearned counsel for the respective parties.  During the course of\nhearing, a consensus has been arrived at between the parties and on\nthat basis, the following order is passed.\n \n\n \n\n\n \n\n4.\t\tOn\nthe facts an circumstances of the case, the trial Court ought not to\nhave decided the issue of mesne profit in Notice of Motion\nproceedings. The appropriate course for the trial Court was to keep\nthe issue of mesne profit pending and render its decision\nwhile disposing the suit finally. Hence, the directions regarding the\npayment of mesne profit is quashed and set aside. However, so\nfar as the payment of mesne profit of Rs.6,000\/- is concerned,\nthe same is modified to the extent that out of the said, an amount of\nRs.3,500\/-shall be paid to the original owner-respondent herein\ntowards the rent every month and the balance amount of Rs.2,500\/-\nshall be deposited in any Nationalized Bank every month.  Such\ndeposit shall be made on or before 10th of every month. \nIt is, however, directed that the trial Court shall consolidate both\nthe suits and dispose of the suits in question expeditiously.
