Justice T.R.RAMACHANDRAN NAIR\n\n Dated :\/  \/\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR, J\n            --------------------------------------------------\n                W.P.(C) No. 7211 of 2009\n           ---------------------------------------------------\n           Dated this the 13th day of March, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>     The writ petitioner is presently working as Assistant<\/p>\n<p>Director of Agriculture at Nedumkandam in Idukki District. He<\/p>\n<p>has approached this Court challenging Ext.P1 order by which he<\/p>\n<p>was transferred to Thalassery in Kannur District in an existing<\/p>\n<p>vacancy. This year he had requested for a suitable posting in<\/p>\n<p>Kottayam     District.    The third respondent who has been<\/p>\n<p>promoted as Assistant Director of Agriculture stands posted in<\/p>\n<p>his place in Nedumkandam. Even though on 5.03.2009, while<\/p>\n<p>admitting the writ petition an order of status-quo was passed by<\/p>\n<p>this Court, subsequently, when the matter came up for hearing<\/p>\n<p>on 6.03.2009, the learned counsel appearing for the petitioner<\/p>\n<p>submitted that the third respondent has assumed charge on<\/p>\n<p>5.03.2009 FN. Notice was ordered by Special Messenger to her<\/p>\n<p>on 06.03.2009 and the case was ordered to be posted today for<\/p>\n<p>hearing.\n<\/p>\n<p>     2. The third respondent appeared in person today before<\/p>\n<p>this Court.   It is submitted by her orally that she being a<\/p>\n<p>promotee she is willing to be posted as Assistant Director in<\/p>\n<p>wpc:7211 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>Thalasserry instead of the petitioner being transferred to<\/p>\n<p>Thalasserry. The above submission is recorded. Appropriate<\/p>\n<p>orders will be passed by the second respondent within a period<\/p>\n<p>of ten days from the date of receipt of a copy of this judgment.<\/p>\n<p>The third respondent will give in writing her consent before the<\/p>\n<p>second respondent in tune with the submission made before this<\/p>\n<p>Court also.
