 A.  This appeal by the claimants is directed against<\/p>\n

appellants 2 and 3  and claimants 4

\nthis Co1n*t.1″p_\u00ab\u00ab..4   ‘ appellants that, the
\ndeceased:_G.  aged about 32 years as on
\nthegdatelof the accident and was the owner cum driver<\/p>\n
 antoricksh-aw. That on 19th October 2004, at<\/p>\n
V  when the deceased was coming from<\/p>\n
 nvatiyleiizplace by riding his motor cycle bearing<\/p>\n
 Registration No.KA–O2\/EL–7898 near Deepak Factory,<\/p>\n
  Bangalore, a Tata Sumo bearing Registration<\/p>\n
__5No.KA–01\/N-4942 belonging to first respondent, was<\/p>\n
\/<\/p>\n
driven by its driver in a rash and negligent manner and<\/p>\n
dashed against the deceased. As a result of<\/p>\n
accident, he fell down and sustained grievous’<\/p>\n
and on account of the serious\u00bblA\u00bbinj4uriels  ‘hex’<\/p>\n
succumbed to the same on 20th;\u00b0Qc:tober    <\/p>\n
3. On account of ‘the.V..deatla ‘of, thelhdaeceasedl <\/p>\n
View of the grievous injuries_llls11s’tained “i\u00abn__thgei\u00a7 accident,
\nthe appellants herein ._t1\u00a7.\u00a2i~ p’aVr:ents_of the deceased
\n(not parties before   claim petition
\nbefore  \u00ab.se_el;ing compensation of a sum of
\nthe respondents. The said claim<\/p>\n
petition “had Vcorneu  for consideration before the<\/p>\n
   il’Si’v—-November .2005. The Tribunal, after<\/p>\n
T  relevant material available on tile and<\/p>\n
after a_pprl\u00a7:c’iation of the oral and documentary evidence,<\/p>\n
 allowed the claim petition in part, awarding a sum of<\/p>\n
 ‘VRsl.’.-‘1,56,O0O\/~ with interest at 6% per annum from the<\/p>\n
Mandate of petition till the fate of realization. Being<\/p>\n
\/<\/p>\n
dissatisfied with the quantum of compensation awarded
\nby the Tribunal, the appellants are in appeal before this<\/p>\n
Court, seeking enhancement of compensation,  —  A.<\/p>\n
4. The learned coun~se’1″–\u00abf0r <\/p>\n
submitted that, the   <\/p>\n
arriving at the loss of depe-ntiencyV.,  bimonthly’<\/p>\n
income of the deceased — even ‘though the
\ndeceased was  owner of the<\/p>\n
autorickshaw ‘ “end   earning. . _…h&1f1dSOII1\u20ac income.<\/p>\n
Therefo’1*c.,,:’i?1e”:”s}:s;1’bn1i.tted’that} having regard to this
\naspect, ll  ‘trea-syoieiable income of the deceased
\nmaybe taker; fQlT  at the loss of dependency.<\/p>\n
  As’ Aiagainst this, the learned counsel for the<\/p>\n
‘Insuirance.:\u00b0Company, inter alia. contended and<\/p>\n
 that the judgment and award passed by<\/p>\n
the Tfiibunal is just and reasonable and does not call<\/p>\n
  interference. However, he fairly submitted that,<\/p>\n

the learned counselzior the—parties, after…eValuation of
\nthe original records    after perusal of<\/p>\n
the impugned   passed by the<\/p>\n

\ncommitted  the monthly income of the<\/p>\n
deceasediat”RsV.’3,(J–(l0;l”;. It is not in dispute that, the<\/p>\n

‘   a sum of Rs.6,200\/- per month apart<\/p>\n

 View that, it would be just and reasonable to take the<\/p>\n
fffionthly income of the\ufb01eased at Rs.4,000\/–. There<\/p>\n
