Nos. 25-26<br \/>\nin<\/p>\n<p>CIVIL APPEAL NOS. 8815-8816 OF 2003 <\/p>\n<p> \tThese applications have been filed purported to be under Section 152<br \/>\nof the Code of Civil Procedure, 1908 for corrections of certain typographical<br \/>\nerrors in the judgment of this Court dated 29.08.2006.\n<\/p>\n<p> \tOne of the typographical errors which has crept in is in line 3 of<br \/>\ndirection (iii) of the findings insofar as in stead and place of the word<br \/>\n&#8220;respondents&#8221; after the words &#8220;belonging to&#8221; and before the words &#8220;on usual<br \/>\nterms&#8221;, the words &#8220;Respondent No. 7&#8221; should appear.  There is no<br \/>\nopposition to the aforementioned prayer.\n<\/p>\n<p> \tThere is also no opposition in regard to the prayer for deleting the<br \/>\nwords &#8220;Or M\/s. Ramdev Exports Arvindbhai Group&#8221; appearing in the<br \/>\naforesaid direction as the firm does not manufacture any product.\n<\/p>\n<p> \tThe respondents, however, opposed the prayer of the applicant in<br \/>\nregard to the deletion of the word &#8220;manufactured&#8221; after the words &#8220;This<br \/>\nproduct&#8221; and before the words &#8220;and marketed by M\/s. Ramdev Masala<br \/>\n(Arvindbhai Group)&#8221;.\n<\/p>\n<p> \tWith a view to appreciate the rival contentions of the parties, which<br \/>\nwould be noticed hereinafter, we may set out herein direction (iii) which<br \/>\nreads as under:\n<\/p>\n<p>&#8220;(iii)\tThe appellant shall, as and when demands<br \/>\nare made, supply spices produced by it for retail<br \/>\nsale thereof to seven outlets belonging to<br \/>\nrespondents on usual terms, and in respect of such<br \/>\narticles on the labels\/pouches, on the reverse<br \/>\nthereof, the following shall be mentioned in the<br \/>\nminimum permissible size in terms of the<br \/>\nprovisions of Weights and Measures Act and<br \/>\nPrevention of Food Adulteration Act:\n<\/p>\n<p>&#8220;This product is manufactured and marketed<br \/>\nby M\/s. Ramdev Masala (Arvindbhai<br \/>\nGroup) (Or M\/s. Ramdev Exports<br \/>\nArvindbhai Group) having no relationship<br \/>\nwhatsoever with Ramdev Food Products<br \/>\nPvt. Ltd.&#8221;&#8221;\n<\/p>\n<p> \tSubmission of Mr. Ashok H. Desai, learned senior counsel appearing<br \/>\non behalf of the applicant is that the direction (iii) read in its entirety may be<br \/>\nmisunderstood to mean that the respondents have been permitted to<br \/>\nmanufacture and market spices in the name and style of M\/s. Ramdev<br \/>\nMasala.\n<\/p>\n<p> \tSubmission of Mr. Ranjit Kumar, learned senior counsel appearing on<br \/>\nbehalf of the respondents, is that the said direction is to be read in the<br \/>\ncontext of the mutual obligations of the parties as noticed by this Court at<br \/>\npage 47 of the judgment as also the observations made by this Court that the<br \/>\nrespondents were entitled to sell also their own products from the said<br \/>\noutlets.  The said paragraph reads as under:\n<\/p>\n<p>&#8220;What were the mutual obligations of the parties<br \/>\nis a matter which can be considered only at the<br \/>\ntrial or in any other appropriate proceeding, but<br \/>\nprima facie it goes without saying that the first<br \/>\nrespondent, in any event, was entitled to sell also<br \/>\nhis own products from the said outlets.  The parties<br \/>\nfor the said purpose thought of remaining mutually<br \/>\ndependent as it was stipulated that while also<br \/>\ncompeting with each other they would see to it that<br \/>\nby action of one, the other is not harmed at least<br \/>\nwhile exporting the materials.  It is, thus, not a<br \/>\ncase where the appellant having taken advantage<br \/>\nof the terms of the MOU had resiled therefrom and<br \/>\nin that view of the matter the principle of estoppel<br \/>\ncannot be said to have any application in the<br \/>\ninstant case.&#8221;\n<\/p>\n<p> \tA judgment, as is well-known, must be read in its entirety.  The<br \/>\nrespondents have been permitted to carry on their business in any other<br \/>\nname insofar as manufacturing of spices is concerned.\n<\/p>\n<p> \tKeeping in view the directions issued by this Court vis-`-vis the<br \/>\nquestions decided, we are of the opinion, for the sake of clarity, directions\n<\/p>\n<p>(ii) and (iii) may be substituted by the following:\n<\/p>\n<p>(ii) \tThey may, however, carry on their business in any other name insofar<br \/>\nas manufacturing of spices is concerned and in respect of such articles on the<br \/>\nlabels\/pouches on the reverse thereof, the following shall be mentioned in<br \/>\nthe minimum permissible size in terms of the provisions of the Standards of<br \/>\nWeights and Measures Act and the Prevention of Food Adulteration Act:<br \/>\n&#8220;This product is manufactured and marketed by M\/s Ramdev Masala<br \/>\n(Arvindbhai Group) having no relationship whatsoever with Ramdev  Food<br \/>\nProducts Pvt. Ltd.&#8221;\n<\/p>\n<p>(iii) The appellant shall, as and when demands are made, supply spices<br \/>\nproduced by it for retail sale thereof from the seven outlets belonging to<br \/>\nRespondent No. 7 on usual terms.\n<\/p>\n<p> \tThese applications are disposed of with the aforementioned directions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ramdev Food Products Pvt.
