(ORAL)\n<\/pre>\n<p>              Replication to the written statement filed on behalf of<\/p>\n<p>respondent No.3 has been handed over to us in Court today. Copy thereof<\/p>\n<p>has also been furnished to the learned counsel for respondent No.3. The<\/p>\n<p>same is taken on record, subject to all just exceptions. A separate replication<\/p>\n<p>to the written statement filed on behalf of respondent No.4 has also been<\/p>\n<p>handed over to us in Court today. Copy thereof has also been furnished to<\/p>\n<p>the learned counsel for respondent No.4. The same is also taken on record,<\/p>\n<p>subject to all just exceptions.\n<\/p>\n<p>              During the course of hearing, it emerged that there were<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.1901 of 2009                                      2<\/span><\/p>\n<p>disputed questions of fact. According to learned counsel representing the<\/p>\n<p>respondents, the tender submitted by the petitioner was defective for three<\/p>\n<p>reasons. These defects have been noticed in paragraph 3 of the preliminary<\/p>\n<p>submissions contained in the written statement filed on behalf of respondent<\/p>\n<p>No.3. In order to demonstrate their fairness to this Court, learned counsel<\/p>\n<p>for respondent No.3, i.e. Municipal Corporation, Ludhiana stated that the<\/p>\n<p>Finance and Contract Committee of the Municipal Corporation, Ludhiana<\/p>\n<p>had taken a decision not to accept any bid which was less than the bid<\/p>\n<p>tendered by the petitioner, namely Rs.7.2 crores.\n<\/p>\n<p>              Despite the fact that the disputed questions of fact were<\/p>\n<p>involved in the controversy raised by the petitioner, yet having examined<\/p>\n<p>the averments made in the instant writ petition as also in the two<\/p>\n<p>replications filed on behalf of the petitioner, we are of the view that there<\/p>\n<p>was a &#8220;possibility&#8221; that the assertions made on behalf of the petitioner<\/p>\n<p>&#8220;might&#8221; be truthful. It is therefore, that we enquired from the respondents<\/p>\n<p>particulars of the highest bid, out of valid tenders submitted by the<\/p>\n<p>interested parties on 23.1.2009. We were informed that the highest bid was<\/p>\n<p>made by respondent No.4, who had agreed to pay a sum of Rs.5 crores.<\/p>\n<p>              We enquired from the learned counsel for the petitioner<\/p>\n<p>whether the petitioner would be interested in hiking its bid amount, during<\/p>\n<p>the process of negotiations, if he was allowed to participate in the same. In<\/p>\n<p>response to our query, learned counsel for the petitioner having obtained<\/p>\n<p>instructions told us, that the petitioner would comfortably enhance the bid<\/p>\n<p>amount to Rs.7.6 crores, but with some difficulty he was willing to enhance<\/p>\n<p>it even to Rs.8 crores, but not beyond that.\n<\/p>\n<p>              Learned counsel for respondent No.4, on instructions received,<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.1901 of 2009                                        3<\/span><\/p>\n<p>states that respondent No.4 is ready and willing to hike the bid amount<\/p>\n<p>depicted in the tender submitted by respondent No.4 to Rs.8.05 crores (as<\/p>\n<p>respondent No.3 i.e. Municipal Corporation, Ludhiana had taken a decision<\/p>\n<p>not to accept the bid less than the bid of the petitioner in his tender namely<\/p>\n<p>Rs.7.2 crores). This offer made by respondent No.4 to us in Court will be<\/p>\n<p>deemed to be binding on respondent No.4, specially because the instant<\/p>\n<p>petition is being disposed of on the basis of the undertaking given by<\/p>\n<p>respondent No.4. In case respondent No.4 backs out from the amount<\/p>\n<p>mentioned here-in-above namely Rs.8.05 crores, his earnest money shall<\/p>\n<p>stand forfeited.\n<\/p>\n<p>              In view of the factual position noticed here-in-above, we are<\/p>\n<p>satisfied and have arrived at a conclusion, that even if the tender documents<\/p>\n<p>submitted by the petitioner were valid, the petitioner would not have been<\/p>\n<p>favoured with the contract in question as he would not have been the<\/p>\n<p>highest bidder even if an opportunity was available to him to compete for<\/p>\n<p>the contract. As such, we are satisfied that no further action is called for in<\/p>\n<p>the facts and circumstances of the present case.\n<\/p>\n<p>              Accordingly, the instant writ petition is disposed of with the<\/p>\n<p>clear understanding that respondent No.4 has enhanced his bid amount to<\/p>\n<p>Rs.8.05 crores. The bid of respondent No.4 and others who participate in the<\/p>\n<p>process of negotiations (if any) will be disposed of in accordance with law.<\/p>\n<p>Obviously, if no other tenderer makes an offer in excess of Rs.8.05 crores, it<\/p>\n<p>will be open to the Municipal Corporation, Ludhiana to accept the bid of<\/p>\n<p>respondent No.4.\n<\/p>\n<p>              Learned counsel for respondent No.3 states that it be clarified<\/p>\n<p>(in view of the interim order passed by this Court on 5.2.2009) that it will be<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.1901 of 2009                                      4<\/span><\/p>\n<p>open to the Municipal Corporation, Ludhiana to finalize the matter in view<\/p>\n<p>of the fact that the Finance and Contract Committee of the Municipal<\/p>\n<p>Corporation, Ludhiana is scheduled to meet on 20.2.2009.
