Special Civil Application No. 7549 of 1999\n          MR BM MANGUKIYA for Petitioner No. 1-8\n          MR MK VAKHARIA for Respondent No. 1\n          MR SUNIL K SHAH for Respondent No. 2-5\n          .......... for Respondent No. 6-10\n\n\n     --------------------------------------------------------------\n\n\n              CORAM : MR.JUSTICE M.S.SHAH\n\n\n              Date of Order: 06\/07\/2001\n\n\nORAL ORDER<\/pre>\n<p>     The respondent-bank filed Arbitration Suit before<br \/>\n     the Board of Nominees for recovering dues from the<br \/>\n     petitioner being Arbitration Suit No.361\/95.   Thereafter<br \/>\n     the respondent Bank filed restoration application which<br \/>\n     came to be rejected. The respondent-plaintiff Bank filed<br \/>\n     another restoration application No.147\/97 which came to<br \/>\n     be allowed by the Board of Nominees on 3-8-1998. The<br \/>\n     petitioner therefore filed an application before the<br \/>\n     Board of Nominees for recalling the aforesaid order<br \/>\n     setting aside the order of dismissal of the suit for<br \/>\n     default.    The Board of Nominees rejected the said<br \/>\n     application of the petitioner-defendant on 15-3-1999.<br \/>\n     The   petitioner&#8217;s Appeal No.522\/98 also came to be<br \/>\n     dismissed by the Gujarat State Cooperative Tribunal on<br \/>\n     25-8-1999. Hence, this petition.\n<\/p>\n<p>     Mr. B.M.     Mangukiya, learned counsel for the<br \/>\n     petitioner has vehemently submitted that when the first<br \/>\n     restoration application filed by the Bank was dismissed,<br \/>\n     the Board of Nominees had no authority to hear and decide<br \/>\n     the second restoration application.\n<\/p>\n<p>     On the other hand, learned counsel for the<br \/>\n     respondent-Bank has submitted that the petitioner     had<br \/>\n borrowed the loan from the respondent-Bank between 1983<br \/>\nand 1994 . However, the petitioner did not repay the<br \/>\namounts and, therefore, the arbitration suit was required<br \/>\nto be filed. It is further submitted that when the suit<br \/>\nwas fixed for hearing on 21-7-1987 before the Board of<br \/>\nNominees, one officer from the respondent plaintiff Bank<br \/>\nwas present. When the matter was called out at 11-30<br \/>\na.m. the Officer as well as the learned advocate for the<br \/>\npetitioner had requested the Board of Nominees that the<br \/>\nOfficer who is going to give deposition would be arriving<br \/>\nat 12-30. However, the Board of Nominees dismissed the<br \/>\nsuit for default. Thereafter the Officer who was to give<br \/>\ndeposition had arrived in the Court at 1-00 p.m. and<br \/>\napplication was made for setting aside the order of<br \/>\ndismissal of the suit for default which was not granted.<br \/>\nHence, a separate    Misc.      Civil   Application   for<br \/>\nrestoration of the suit was made which came to be granted<br \/>\nby the Board of Nominees. It is submitted that the Board<br \/>\nof Nominees as well as the Tribunal have given concurrent<br \/>\nfindings   that   there was sufficient cause for the<br \/>\nnonappearance of the plaintiff&#8217;s witness. In view of the<br \/>\nabove, this petition may be dismissed.\n<\/p>\n<p>Having heard the learned counsel for the parties,<br \/>\nit appears that when the witness came to the Court, an<br \/>\napplication was given merely stating that the witness has<br \/>\ncome for giving evidence, therefore, the order          of<br \/>\ndismissal for default may be recalled. That application<br \/>\nappears to have been rejected with one word `rejected&#8217;.<br \/>\nThereafter,   the   plaintiff-bank    filed   a   detailed<br \/>\napplication   for   restoration    giving   reasons    for<br \/>\nnonappearance of the witness particularly it was pointed<br \/>\nout that after the suit was filed, the hearing of the<br \/>\nsuit   was adjourned on a number of occasions and,<br \/>\ntherefore the learned advocate for the Bank as well as<br \/>\nthe officer of the Bank had requested the Court that the<br \/>\nwitness will be coming shortly. It thus appears that the<br \/>\nwitness was not present at 11-30 on 26-8-1997 because the<br \/>\nhearing of the suit had been adjourned on a number of<br \/>\nprevious occasions and, therefore, the witness was to<br \/>\ncome as and when there was some certainty that the<br \/>\nevidence will be recorded. Considering the fact that the<br \/>\nsuit was filed by the Bank for recovery of its dues and<br \/>\nthat the witness had reported for recording evidence on<br \/>\nthe day on which the suit was fixed for hearing albeit<br \/>\nthe witness was late by a few hours, in the facts and<br \/>\ncircumstances of the case, it cannot be said that the<br \/>\nBoard of Nominees committed any jurisdictional error in<br \/>\nrestoring the suit to file.\n<\/p>\n<p>As regards the contention that   since   the   first<br \/>\n application was rejected and, therefore, the second<br \/>\napplication should not have been entertained by the Board<br \/>\nof Nominees, assuming that the first application was<br \/>\nrejected, and assuming that there was an illegality on<br \/>\nthe part of the Board of Nominees, as per the well<br \/>\nsettled legal position, the writ jurisdiction under<br \/>\nArticle 226 and 227 is discretionary and this Court would<br \/>\nnot issue a writ merely upon the petitioner showing that<br \/>\nthere has been an illegality without showing that there<br \/>\nis also injustice. This is well settled as per the<br \/>\ndecision of the Apex Court in AIR 1957 SC 226, and in the<br \/>\nfacts and circumstance of the case, if at all there is<br \/>\ninjustice it was to the plaintiff Bank when the suit was<br \/>\ndismissed for default even when the learned advocate for<br \/>\nthe Bank as well as another Officer present had requested<br \/>\nthe Board of Nominee to keep back matter for some time so<br \/>\nthat the witness would be reaching the Court.\n<\/p>\n<p>The petition is therefore dismissed.   Notice   is<br \/>\ndischarged.\n<\/p>\n<p>(M.S.
