2. Learned counsel for the petitioner Sri. Rajshekar
\nH. Angadi submitted that this Court by an order dated<\/p>\n
16\/04\/2008 in C.P.33\/2008 had allowed the petitioiiifiled<\/p>\n
by the respondentwwife and transferred <\/p>\n
M.C.No.92\/2006 and 4\/2008 to be clubbed aeefl heardiiibgibilgii’<\/p>\n
the learned Civil Judge(Junior Division)’ Kumtar <\/p>\n
in accordance with law. Despite the  ord’erV,\u00bb_iithe’~_<\/p>\n
respondent again moved the Qourt below’   for V<\/p>\n
transfer of the Very same. ..casesl’frorri*I{ii;mta toliarwiar. It is,
\ntherefore, submitted thatiithe  in the petition<\/p>\n
before this Court earlier’ and the grounds<\/p>\n
urged 1,”beielreii5\u00bb,g.,ti;e7’3.flceiiei eeegv in the present Civil
\nMiscellaneous  and 117\/ 2009 being one and<\/p>\n
the same, iitlzeiv below could not have allowed the<\/p>\n
 by Hth’e”‘Wife and transferred the cases from<\/p>\n
  Kdrnta to Karwaij again.\n<\/p>\n
 other hand learned counsel for the<\/p>\n
resi\ufb01ondentwirife submitted that the respondent has got a<\/p>\n
h  child who is a diabetic and the respondent is also pursuing<\/p>\n
B.Ed. studies and as such transfer sought which was
\nallowed by the Court below cannot be held to be agains-t___law.<\/p>\n
The impugned order of the Court below also <\/p>\n

4. Having thus .heardp_bo:th_sides and perusal of
\nthe order passed by Coi11g.rt?.:.gii;;1u”Ciifs,4i:’Petition 33\/2008
\nwhich was the pp-etition””\ufb01ied’A by\ufb02gtheiiiirespondent-wife, this
\nCourt, after.  iilness and the child of
\nthe respondent eras of the View that the case
\nshould be   44Ii{umta Court for disposal in<\/p>\n
accordance wit1″1\u00ab.law. The very same grounds which were<\/p>\n
 iurged  the earlier C.P.33\/2008 are the grounds put<\/p>\n
iii’fori}.r.ard”\u00a7ay=_v..the””IVearned counsel for the respondent. Under<\/p>\n
these ci.rcurnstances, I am of the View that the impugned<\/p>\n
 giorder cannot be sustained in law and apart from the above<\/p>\n
it  ‘reasonings, the submission made by the learned counsel for<\/p>\n
 -\u00abthe petitioner is that the cases have reached the stage of<\/p>\n
cross–exaInination before the Court at Kumta and PW–  who<\/p>\n
is the husband, has been examined by clubbing<\/p>\n
cases and at this stage, once again transferring the[‘,:”casve.,li~<\/p>\n
back to Karwar is not warranted eV.e1’1_in the “in’te_rest=o’f.the <\/p>\n
parties.\n<\/p>\n
5. As regards the con.ten,tions”raised  thee-learned * it<\/p>\n
counsel for the respondent reie:i’riI1g,_Vgtoihthebprgiirision of
\nSection 115 of the c\u00a2d\u00a77’0f  is concerned,
\nSection 115 sub vjclaussviilthe scope for
\ninterference.   ithiat any one of the 3

\nthe Court ‘the notice of the order passed
\nby this Courtin  33\/ 2008 and despite the very<\/p>\n
