(J)\n\nCITATION:\n 1988 AIR 1085\t\t  1988 SCR  (3) 436\n 1988 SCC  Supl.  485\t  JT 1988 (2)\t 21\n 1988 SCALE  (1)640\n\n\nACT:\n     Punjab Village Common Lands (Regulation) Act, 1961: ss.\n13(a) (i), 13(a) (ii) and 13B-Effect of amendment by Haryana\nAct 2  of 1981\tomitting s.  13B with  retrospective effect-\nCivil Court  barred from  adjudicating upon question whether\nany land  or immovable\tproperty is  or is not Shamilat deh-\nShamilat deh  in adverse  possession-Civil Court whether has\njurisdiction to determine ownership.\n\n\n\nHEADNOTE:\n%\n     Section  13B   of\tthe   Punjab  Village  Common  Lands\n(Regulation) Act,  1961 inserted  therein by the Haryana Act\n34 of  1974 mandated  transfer of  all suits  pending in any\ncivil court  against the  panchayat relating to the question\nas to  whether the  suit land was excluded from the ambit of\nshamilat deh,  to and  institution of  fresh proceedings  in\nsuch   cases   before\tthe   Assistant\t  Collector   having\njurisdiction over the village.\n     The suit filed by the appellants for a declaration that\nthey were  the owners  of  the\tland  in  dispute  in  their\npossession and that the respondent Gram Sabha had nothing to\ndo with\t the same, was transferred by the trial court to the\nAssistant Collector  under s.  13B of  the Act. The revision\napplication filed by them was dismissed by the High Court.\n     During the\t pendency of  the appeal by special leave in\nthis Court  the Act  was further  amended by  Act 2  of 1981\ndeleting s.  13B with retrospective effect from November 12,\n1974. Amended  s. 13(a)\t barred jurisdiction of civil courts\nto entertain or adjudicate upon the question (i) whether any\nland or\t other immovable property is or is not shamilat deh,\nand (ii) whether the suit land vests or does not vest in the\nPanchayat.\n     It was  contended for  the appellants that there was no\ndispute as  to\tthe  question  whether\tthe  suit  land\t was\nshamilat deh  or not.  The only\t question  that\t has  to  be\ndecided in  the suit was whether the appellants had acquired\ntitle to the suit land by adverse possession, and therefore,\ns. 13(a)(i) was not applicable.\n437\n     Dismissing the appeal,\n^\n     HELD: The\tsuit instituted\t by the appellants cannot be\nheard and  disposed of\tby the\tcivil court.  The  Assistant\nCollector  to\twhom  the  suit\t has  been  transferred\t has\njurisdiction to\t dispose of  the same in accordance with the\nprovisions of the Act as amended. [440AB]\n     The  trial\t court\thad  transferred  the  suit  to\t the\nAssistant  Collector  on  a  finding  that  the\t controversy\nbetween the  parties related  to the  question as to whether\nthe suit land was excluded from the ambit of shamilat deh as\ndefined in s. 2(g) of the Act. The said finding has not been\nchallenged either  before the  High Court  or in the special\nleave petition.\t Therefore, the\t civil court  will  have  no\njurisdiction to\t try the  suit instituted  by the appellants\ninvolving the  decision on  the question  as contained in s.\n13(a)(i) of the Act. [439F-G]\n     Even assuming  that s.  13(a)(i) is  not applicable and\nthat the  question to  be decided in the suit is whether the\nappellants had\tacquired title\tto the\tsuit land  which  is\nShamilat deh within the meaning of s. 2(g) of the Act, still\nthe civil court will have no jurisdiction to try the suit in\nview of\t s. 13(a)(ii)  of the Act, for the question would be\nwhether the  suit land\tvests or  does not  vest in the Gram\nsabha. In this appeal by special leave the appellants<br \/>\nhave challenged\t the constitutional  validity of section 13B<br \/>\nof the\tPunjab Village\tCommon Lands (Regulation) Act, 1961,<br \/>\nhereinafter referred to as &#8216;the Act&#8217;.\n<\/p>\n<p>     Section  13B  of  the  Act,  as  it  stood\t before\t its<br \/>\namendment, provides inter alia that all suits pending in any<br \/>\nCivil Court  in respect\t of  any  land\tor  other  immovable<br \/>\nproperty wherein relief has been claimed on<br \/>\n<span class=\"hidden_text\">438<\/span><br \/>\nthe ground  of its  being excluded  from shamilat  deh under<br \/>\nclause (g)  of section\t2 or on any of the grounds mentioned<br \/>\nin sub-section\t(3) of\tsection 4  of the  Act\tagainst\t the<br \/>\nPanchayat,  shall   stand  transferred\t to  and  the  fresh<br \/>\nproceedings for\t seeking relief\t on  the  aforesaid  grounds<br \/>\nshall be  instituted before  the Assistant  Collector of the<br \/>\nFirst Grade having jurisdiction over the village wherein the<br \/>\nland or other immovable property is situate.\n<\/p>\n<p>     The appellants have filed a suit before the Subordinate<br \/>\nJudge, First Class, Kurukshetra, for a declaration that they<br \/>\nare the\t owners of  the land  in dispute measuring about 124<br \/>\nacres in their respective possession and the respondent Gram<br \/>\nSabha Buhavi  has nothing  to do  with the same. The learned<br \/>\nSubordinate Judge,  transferred the  suit to  the  Assistant<br \/>\nCollector, First  Grade, Thanesar, under section 13B, upon a<br \/>\nfinding that  the controversy between the parties relates to<br \/>\nthe question  as to  whether the suit land was excluded from<br \/>\nthe ambit of shamilat deh, as defined in section 2(g) of the<br \/>\nAct. The  appellants, being  aggrieved by  the said order of<br \/>\ntransfer, filed an application for revision against the same<br \/>\nbefore the  Punjab &amp;  Haryana High  Court. The High Court by<br \/>\nthe impugned  judgment dismissed  the revisional application<br \/>\nand upheld  the\t order\tof  the\t learned  Subordinate  Judge<br \/>\ntransferring the  suit\tto  the\t Assistant  Collector  under<br \/>\nsection 13B of the Act. Hence this appeal by special leave.\n<\/p>\n<p>     It\t is   not  necessary   for  us\t to   consider\t the<br \/>\nconstitutional validity of section 13B of the Act, as during<br \/>\nthe pendency  of the  appeal in\t this  Court,  the  Act\t was<br \/>\namended by  the Haryana Act 2 of 1981. Section 5 of Act 2 of<br \/>\n1981  omitted\tsections  13A  of  13B\tfrom  the  Act\twith<br \/>\nretrospective effect from November 12, 1974, that is to say,<br \/>\nthe date  on which  they were  inserted in  the Act  by\t the<br \/>\nHaryana Act  34 of  1974. Section 4 of Act 2 of 1981 amended<br \/>\nsection 13  of the  Act. The  amended section 13 provides as<br \/>\nfollows:\n<\/p>\n<blockquote><p>\t  &#8220;S. 13.  Bar of  jurisdiction-No Civil Court shall<br \/>\n\t  have jurisdiction\n<\/p><\/blockquote>\n<blockquote><p>\t  (a)\tto entertain or adjudicate upon any question<br \/>\n\t       whether\n<\/p><\/blockquote>\n<blockquote><p>\t       (i)   any land or other immovable property is<br \/>\n\t\t    or is not shamilat deh;\n<\/p><\/blockquote>\n<blockquote><p>\t       (ii) any\t land or other immovable property or<br \/>\n\t\t    any right,\ttitle or  interest  in\tsuch<br \/>\n\t\t    land or other immovable<br \/>\n<span class=\"hidden_text\">439<\/span><br \/>\n\t\t    property vests or does not vest in under<br \/>\n\t\t    this Act;\n<\/p><\/blockquote>\n<blockquote><p>\t  (b)  in respect  of any  matter which\t any revenue<br \/>\n\t       court, officer  or authority  is empowered by<br \/>\n\t       or under this Act to determine, or\n<\/p><\/blockquote>\n<blockquote><p>\t  (c)  to question  the legality of any action taken<br \/>\n\t       or  matter  decided  by\tany  revenue  court,<br \/>\n\t       officer or authority empowered to do so under<br \/>\n\t       this Act.&#8221;<\/p><\/blockquote>\n<p>     In view  of the  fact that section 13B has been omitted<br \/>\nwith   retrospective\teffect,\t  the\t question   of\t the<br \/>\nconstitutional\tvalidity   of  that  section  is  no  longer<br \/>\nrelevant. The  only question  that now arises is whether the<br \/>\nCivil Court  has jurisdiction to hear the suit instituted by<br \/>\nthe appellants. Section 13(a)(i), as substituted by Act 2 of<br \/>\n1981, takes  away the  jurisdiction of\tthe Civil  Court  to<br \/>\nentertain or  adjudicate upon  any question whether any land<br \/>\nor immovable property is or is not shamilat deh.\n<\/p>\n<p>     It is,  however, submitted\t by Mr. Harbans Lal, learned<br \/>\ncounsel appearing on behalf of the appellants, that there is<br \/>\nno dispute  as to  the question\t whether the  suit  land  is<br \/>\nshamilat deh or not. The appellants admit that the suit land<br \/>\nis shamilat deh. The only question that has to be decided in<br \/>\nthe suit  is whether  the appellants  have acquired title to<br \/>\nthe suit  land by  adverse possession.\tAccordingly,  it  is<br \/>\ncontended that\tsection 13(a)(i) is not applicable and Civil<br \/>\nCourt will  have jurisdiction  to decide the suit instituted<br \/>\nby the appellants.\n<\/p>\n<p>     It\t has   been  already   noticed\tthat   the   learned<br \/>\nSubordinate Judge  transferred the  suit  to  the  Assistant<br \/>\nCollector on  a finding\t that the  controversy\tbetween\t the<br \/>\nparties related\t to the question as to whether the suit land<br \/>\nwas excluded  from the\tambit of shamilat deh, as defined in<br \/>\nsection 2(g)  of the  Act. The\tsaid finding  of the learned<br \/>\nSubordinate Judge  has not been challenged either before the<br \/>\nHigh Court  or in  the special\tleave petition. In our view,<br \/>\ntherefore, the\tCivil Court will have no jurisdiction to try<br \/>\nthe suit instituted by the appellants involving the decision<br \/>\non the question as contained in section 13(a)(i) of the Act.\n<\/p>\n<p>     Even assuming  that section  13(a)(i) is not applicable<br \/>\nand that  the question\tto be decided in the suit is whether<br \/>\nthe appellants have acquired title to the suit land which is<br \/>\nshamilat deh  within the meaning of section 2(g) of the Act,<br \/>\nstill the Civil Court will have no jurisdiction<br \/>\n<span class=\"hidden_text\">440<\/span><br \/>\nto try the suit in view of section 13(a)(ii) of the Act, for<br \/>\nthe question  would be\twhether the  suit land vests or does<br \/>\nnot vest  in the Gram Sabha. In the circumstances, we are of<br \/>\nthe view  that the  suit instituted by the appellants cannot<br \/>\nbe heard  and disposed\tof by the learned Subordinate Judge,<br \/>\nand the\t Assistant Collector  to  whom\tthe  suit  has\tbeen<br \/>\ntransferred   by   the\t learned   Subordinate\t Judge\t has<br \/>\njurisdiction to\t dispose of  the suit in accordance with the<br \/>\nprovisions of the Act as amended.\n<\/p>\n<p>     For the  reasons aforesaid,  this appeal  is dismissed.<br \/>\nThere will,  however, be no order as to costs.
