Senior Civil Judge and J.M.F.C.,<br \/>\nJamnagar below application Exs.6 and 28 filed by the appellant<br \/>\nherein, original plaintiff.\n<\/p>\n<p>\tBetween<br \/>\nthe appellant and the respondent, i.e. plaintiff and defendant,<br \/>\ncertain agreements to sell castor oil seeds  had  taken place in the<br \/>\nyear 2004.  Towards the margin money for the transaction in question,<br \/>\nthe appellant had paid a sum of Rs.1,56,00,000\/-. Subsequently,<br \/>\nhowever, legal disputes arise between the parties.  It is the case of<br \/>\nthe defendant that the plaintiff did not lift the goods since the<br \/>\nprice of castor oil seeds in the meantime crashed.   However, it is<br \/>\nthe case of the plaintiff that the defendant  had supplied<br \/>\nconsignment of castor oil seeds which was of  inferior  quality and<br \/>\nas a commission agent when the plaintiff had supplied the same to the<br \/>\nconsumer, he had received complaint and had to bear the entire cost<br \/>\nof the consignment.\n<\/p>\n<p>\tFor<br \/>\nthe  said legal controversy, the plaintiff    filed Special Civil<br \/>\nSuit No.94\/07.  In the said suit, he filed interim applications Ex.6<br \/>\nand Ex.28.  In application Ex.6, the plaintiff made the following<br \/>\nprayers:\n<\/p>\n<p> (A)\tKindly<br \/>\npass an order of injunction against the Defendant and in favour of<br \/>\nthe Plaintiff and it be ordered that the Defendant or its agent<br \/>\nservant etc. are prohibited for transferring the goods i.e. Caster<br \/>\nSeeds and Jiru lying at  Parth Oil Mill Compound, known as old R.T.<br \/>\nMill, near Kapad Mill Compound, Bedeshwar, Jamnagar where the<br \/>\nDefendant has kept its above goods till the final disposal of the<br \/>\nsuit without obtaining the previous order   from this Hon&#8217;ble Court<br \/>\nin the interest of justice.\n<\/p>\n<p>(B)\tKindly<br \/>\nalso pass an order to the Defendant to furnish the solvent security<br \/>\nof the suit amount to the satisfaction of this Hon&#8217;ble Court before<br \/>\ndisposing its property above mentioned  in the interest of justice.\n<\/p>\n<p>(C)\tAny<br \/>\nother ancillary relief for which the plaintiff is found entitled at<br \/>\nlaw may kindly be  granted.\n<\/p>\n<p>In<br \/>\nApplication Ex.28, the prayers made by the plaintiff read as follows:\n<\/p>\n<p> (A)\tKindly<br \/>\npass an order of injunction against the Defendant and in favour of<br \/>\nthe Plaintiff and it be ordered that the Defendant or its agent<br \/>\nservant etc. are prohibited for transferring the goods i.e. Caster<br \/>\nSeeds and Jiru lying at  Laxmi Cold Storage, Plot No.104, Phase -4,<br \/>\nG.I.D.C., Naroda, Ahmedabad and R.K.Industries, Plot No.55, Phase 2,<br \/>\nG.I.D.C. Naroda, Ahmedabad where the Defendant has  kept its above<br \/>\ngoods till the final disposal of the suit without obtaining the<br \/>\nprevious order   from this Hon&#8217;ble Court in the interest of justice.\n<\/p>\n<p>(B)\tKindly<br \/>\nalso pass an order to the Defendant to furnish the solvent security<br \/>\nof the suit amount to the satisfaction of this Hon&#8217;ble Court before<br \/>\ndisposing its property    above mentioned  failing which attachment<br \/>\norder of the properties lying at Laxmi Cold Storage  &amp; R.K.<br \/>\nIndustries be passed in  the interest of justice.\n<\/p>\n<p>(C)\tKindly<br \/>\nalso pass urgent ex-party orders for injunction etc. against the<br \/>\ndefendant pending hearing and final disposal of this application in<br \/>\nthe interest of justice.\n<\/p>\n<p>(D)\tAny<br \/>\nother ancillary relief for which the plaintiff is found entitled at<br \/>\nlaw may kindly be  granted.\n<\/p>\n<p>These<br \/>\napplications came to be heard together and came to be  dismissed by<br \/>\nthe Trial Court by a common order.  The plaintiff is before this<br \/>\nCourt in appeals.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Shri Dagli appearing for the appellant at the outset<br \/>\nsubmitted that prayer (A) in both the applications had become<br \/>\ninfructuous   by the time  the suit was filed.  He, however,<br \/>\nsubmitted  that the Court below  erred in not granting protection to<br \/>\nthe plaintiff by requiring the defendant to give bank guarantee  or<br \/>\nsome other security.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocates appearing for  the parties and having<br \/>\nperused the order under consideration, I find that  long before the<br \/>\npresent appellant filed the above-mentioned suit, the respondent  had<br \/>\ninstituted Special Civil Suit No.191\/94  on 27th December<br \/>\n2004 with respect to the same transaction and had claimed damages<br \/>\nfrom the appellant herein.  The appellant did not take  any legal<br \/>\nsteps for nearly three years thereafter.  Long after the suit of the<br \/>\npresent respondent came to be instituted, the appellant has<br \/>\napproached  the Trial Court and filed a suit seeking  recovery of the<br \/>\namount paid and in the meantime  has prayed for protection in the<br \/>\nform of bank-guarantee or such other security from the respondent<br \/>\ni.e. defendant in the said suit.\n<\/p>\n<p>\tI<br \/>\nfind that there are number of disputed questions which need to be<br \/>\ngone into before rights of the parties can be finalized. There is no<br \/>\npossibility of granting the prayer made by the appellant. The same<br \/>\nwould amount to  granting attachment before judgment. When the<br \/>\ndefendant has prima facie made out a case that he had sent letters<br \/>\nand communications urging the plaintiff to lift the goods and when<br \/>\nthe defendant herein has also instituted suit claiming damages for<br \/>\nthe very same transaction which was filed in the year 2004, I do not<br \/>\nfind that the appellant can succeed in getting the prayers made in<br \/>\napplications Ex.6  and Ex.28.\n<\/p>\n<p>\tThe<br \/>\nCourt below has gone into all aspects of the matter and found it<br \/>\nappropriate not to grant the prayers.  I see no infirmity or<br \/>\nillegality in such an order.  The defence of the defendant seems<br \/>\nplausible.  No case for attachment before judgment is made out.  The<br \/>\nCourt below was therefore justified in not granting  such prayers.\n<\/p>\n<p>\tNeedless<br \/>\nto  state that the above observations are  only for dealing with the<br \/>\ninterim applications and  would  prejudice  neither parties  in<br \/>\npursuing all contentions available in  the  pending suit.\n<\/p>\n<p>\tSubject<br \/>\n to the  above observations, appeals are disposed of.
