Bibhutipur District Samastipur.\n                                         Versus\n                  1. The State Of Bihar\n                  2. Arbind Jha @ Bishan Jha son of Mahendra Jha\n                  3. Shiv Jha son of Mahendra Jha, both resident of village Shakh Mohan\n                 ,P.S- Bibhutipur, district- Samastipur      -----------\n\n\n2   24.06.2011<\/pre>\n<p>                Heard the learned counsel for the appellant.<\/p>\n<p>                              The appellant is aggrieved with the judgment dated<\/p>\n<p>                  17.4.2011 in Sessions Trial No.315 of 2002 arising out of<\/p>\n<p>                  Bibhutipur P.S.Case No. 127 of 1997 corresponding to GR Case<\/p>\n<p>                  No. 483 of 1997, passed by Additional Session Judge F.T.C V<\/p>\n<p>                  Samastipur by which respondent nos. 2 and 3 have been<\/p>\n<p>                  acquitted from charges.\n<\/p>\n<p>                              Allegation was that the son of the informant was<\/p>\n<p>                  forcibly, taken away by the accused person and later on his dead<\/p>\n<p>                  body with injuries was found.\n<\/p>\n<p>                              The defence of the accused person was that<\/p>\n<p>                  according to allegation the son of the complainant was taken<\/p>\n<p>                  away on20.6.1997 but complaint petition was filed on 23.6.1997.<\/p>\n<p>                  Further defence was that the son of the complainant died on<\/p>\n<p>                  account of a road accident.\n<\/p>\n<p>                              The Trial Court after considering the defence version<\/p>\n<p>                  and other materials on record came to the conclusion that the<\/p>\n<p>                  prosecution has not been able to prove the charges beyond the<\/p>\n<p>                  shadow of all reasonable doubts and accordingly acquitted the<\/p>\n<p>                  accused person.\n<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>                     We find that the judgment based on sound reasoning<\/p>\n<p>         and so it requisites no interference by this court.<\/p>\n<p>                     Accordingly this appeal is dismissed.<\/p>\n<pre>\n\n\n\n                                         (Shyam Kishore Sharma, J.)\n\n\n\nNamita                                   , ( Rajendra Kumar Mishra J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Pawan Devi vs The State Of Bihar &amp; Ors on 24 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
