    Petitioner, the accused in C.C.No.5\/2000 on the<\/p>\n
file of Judicial First Class Magistrate’s Court-<\/p>\n
III, Ernakulam, filed this revision challenging the<\/p>\n
concurrent   conviction    and   sentence.    First<\/p>\n
respondent  lodged   the   complaint   before   the<\/p>\n
Magistrate  alleging  that   petitioner,  for  his<\/p>\n
business, borrowed Rs.2,80,000\/- and towards its<\/p>\n
repayment, issued   five  cheques  and  Exhibit  P1<\/p>\n
cheque for Rs.75,000\/- is one among the cheques<\/p>\n
issued by the petitioner in the account maintained<\/p>\n
by  him  in  the  bank  and  when  the  cheque  was<\/p>\n
presented for encashment, it was dishonoured for<\/p>\n
the  reason  of  “insufficient  funds  and  account<\/p>\n
closed”. It was intimated under Exhibits P2 and P3<\/p>\n
to the first respondent. First respondent sent the<\/p>\n
original of Exhibit P8 notice to the petitioner at<\/p>\n
his official address as well as in the residential<\/p>\n

address,     evidenced by Exhibit P4 series postal<\/p>\n
receipts and when the postal acknowledgment cards<\/p>\n
were not received back, the counsel, who sent the<\/p>\n
notices, sent Exhibit P5 complaint to the postal<\/p>\n
authorities,   for   which,  Exhibit P7  reply  was<\/p>\n
received stating that both the notices were served<\/p>\n
on the petitioner. But, he failed to pay the<\/p>\n
amount. Therefore, it is alleged that petitioner<\/p>\n
committed    the  offence   under  Section 138   of<\/p>\n
Negotiable Instruments Act.\n<\/p>\n
     2. Learned Magistrate took cognizance of the<\/p>\n
offence.    Petitioner  pleaded  not guilty.  First<\/p>\n
respondent examined himself as PW1 and the Manager<\/p>\n
of the Bank as PW2 and Post Masters as PWs 3 and 4<\/p>\n
and marked Exhibits P1 to P10. Petitioner was<\/p>\n
examined as DW2 and the Manager of the Bank was<\/p>\n
examined as DW1 and Exhibit D1, the ledger folio of<\/p>\n
his bank account, was also marked.\n<\/p>\n
     3. Learned Magistrate, on the evidence, found<\/p>\n
that Exhibit P1 cheque was issued by the petitioner<\/p>\n
towards discharge of an existing liability and it<\/p>\n

was    dishonoured   as   the   account  was   closed<\/p>\n
subsequent    to  the  issuance  of  the  cheque  and<\/p>\n
Exhibit P8 notice was served on the petitioner, but<\/p>\n
he   failed   to   pay  the  amount  and  petitioner,<\/p>\n
thereby, committed the offence under Section 138 of<\/p>\n
Negotiable Instruments Act. He was sentenced to<\/p>\n
simple     imprisonment  for   three  months  and   a<\/p>\n
compensation    of   Rs.50,000\/-.  Though  petitioner<\/p>\n
challenged    the  conviction   and  sentence  before<\/p>\n
Sessions    Court,  Ernakulam  in  Crl.A.No.637\/2001,<\/p>\n
learned     Additional   Sessions   Judge,   on   re-<\/p>\n
appreciation of evidence, confirmed the conviction<\/p>\n
and   sentence   and  dismissed  the  appeal.  It  is<\/p>\n
challenged in the revision.\n<\/p>\n
     4. Learned counsel appearing for the petitioner<\/p>\n
and first respondent were heard.\n<\/p>\n
     5. Learned counsel appearing for the petitioner<\/p>\n
challenged    the  conviction  and  sentence  on  the<\/p>\n
ground that no notice as provided under Section 138<\/p>\n
(b) of Negotiable Instruments Act was served on the<\/p>\n
petitioner. Argument of the learned counsel is that<\/p>\n

there    is  no  evidence to  prove  that a  notice<\/p>\n
demanding the amount covered by the dishonoured<\/p>\n
cheque was served on the petitioner within the<\/p>\n
statutory period and therefore, the conviction is<\/p>\n
bad.\n<\/p>\n
     6. Learned counsel appearing for the first<\/p>\n
respondent    pointed out  that  Exhibit P4  series<\/p>\n
postal receipts with Exhibit P8, the office copy of<\/p>\n
the notice, establish that notice swere sent by<\/p>\n
registered post in the correct address of the<\/p>\n
petitioner    to  his  office as  well  as  to  the<\/p>\n
residence and Exhibit P7 reply received from the<\/p>\n
postal     authorities establishes  that  both  the<\/p>\n
notices     were  served  on  the   petitioner  and<\/p>\n
therefore, the contention is only to be rejected.<\/p>\n
     7. Learned Magistrate and learned Additional<\/p>\n
Sessions Judge appreciated the evidence in the<\/p>\n
proper perspective. Though it is contended that<\/p>\n
Exhibit P1 cheque was issued only as a security, on<\/p>\n
the evidence of PW1 and DW1, courts below rightly<\/p>\n
found that Exhibit P1 cheque was issued towards<\/p>\n

repayment of Rs.75,000\/- borrowed. Evidence also<\/p>\n
establish that the cheque was dishonoured as there<\/p>\n
was no sufficient amount in the account and the<\/p>\n
account was closed before its dishonour. The only<\/p>\n
question is whether first respondent has complied<\/p>\n
with    the   provisions  of  Sections   138(b)   of<\/p>\n
Negotiable Instruments Act.\n<\/p>\n
     8. Section 138(b) of Negotiable Instruments Act<\/p>\n
mandates that the payee has to demand the amount<\/p>\n
covered by the dishonoured cheque in writing from<\/p>\n
the drawer of the cheque. The drawer of the cheque<\/p>\n
has to pay the amount covered by the cheque within<\/p>\n
fifteen days of receipt of the demand. So also, the<\/p>\n
complaint is to be filed within thirty days from<\/p>\n
the date of cause of action. The cause of action<\/p>\n
would arise on the expiry of fifteen days from<\/p>\n
receipt of the demand in writing.     Exhibit P8 is<\/p>\n
the office copy of the notice sent through the<\/p>\n
counsel by the first respondent. Exhibit P4 series<\/p>\n
of postal receipts establish that notices were sent<\/p>\n
in   the    official address as   well  as  in  the<\/p>\n

residential address of the petitioner by registered<\/p>\n
post. Though the postal acknowledgment cards were<\/p>\n
not received, Exhibit P5 letter sent by the counsel<\/p>\n
establishes   that  he  has  complained  about  non<\/p>\n
receipt of the postal acknowledgment cards. Exhibit<\/p>\n
P7 reply establishes that an enquiry was conducted<\/p>\n
on receipt of Exhibit P5 complaint and the Deputy<\/p>\n
Superintendent intimated the Senior Superintendent,<\/p>\n
R.M.S., Ernakulam Division that both the registered<\/p>\n
notices, which were registered as 2607 and 2608,<\/p>\n
were    delivered  respectively on   16.6.1998  and<\/p>\n
13.6.1998. By Exhibit P7, the counsel appearing for<\/p>\n
the   first   respondent  was  intimated  that  the<\/p>\n
registered notices were delivered on 16.6.1998 and<\/p>\n
13.6.1998. In spite of Exhibit P7 reply, when<\/p>\n
examined as DW2, petitioner did not depose that he<\/p>\n
did not receive the registered notices sent under<\/p>\n
Exhibit P4 series of postal receipts or that the<\/p>\n
information furnished to the counsel for the first<\/p>\n
respondent that notices were properly served on the<\/p>\n
petitioner is not correct. In such circumstances,<\/p>\n

it is futile for the petitioner to contend that no<\/p>\n
notice was served on him. Evidence establishes that<\/p>\n
in spite of receipt of notice, petitioner did not<\/p>\n
pay the amount. In such circumstances, conviction<\/p>\n
of the petitioner for the offence under Section 138<\/p>\n
of Negotiable Instruments Act is perfectly legal.<\/p>\n
     9. Then the only question is regarding the<\/p>\n
sentence. Learned counsel appearing for the first<\/p>\n
respondent submitted that the total amount borrowed<\/p>\n
is Rs.2,80,000\/-. Though Exhibit P1 cheque is for<\/p>\n
Rs.75,000\/-, the balance was also not received, as<\/p>\n
the account was closed. Learned counsel appearing<\/p>\n
for the petitioner submitted that the cheque is for<\/p>\n
Rs.75,000\/- alone and in the interest of justice,<\/p>\n
the     sentence be   modified    awarding   proper<\/p>\n
compensation to the first respondent. Considering<\/p>\n
the entire facts and circumstances of the case,<\/p>\n
interest of justice will be met if the sentence is<\/p>\n
modified to imprisonment till rising of court and<\/p>\n
adequate compensation to the first respondent.<\/p>\n

     Revision is allowed in part. Conviction of the<\/p>\n
petitioner for the offence under Section 138 of<\/p>\n
Negotiable Instruments Act is confirmed. Sentence<\/p>\n
is     modified.  Petitioner    is   sentenced   to<\/p>\n
imprisonment    till   rising  of   court   and    a<\/p>\n
compensation of Rs.80,000\/- and in default, simple<\/p>\n
imprisonment   for  three   months.  Petitioner  is<\/p>\n
directed to appear before Judicial First Class<\/p>\n
Magistrate-III,    Ernakulam  on   11.08.2010.    If<\/p>\n
petitioner has deposited any amount before the<\/p>\n
Magistrate   as  directed   by  this  Court,   while<\/p>\n
suspending the sentence, he need deposit only the<\/p>\n
balance amount and first respondent is entitled to<\/p>\n
withdraw the amount in deposit. The Magistrate is<\/p>\n
directed to execute the sentence.<\/p>\n
