Justice V.RAMKUMAR\n\n Dated :20\/03\/2007\n\n O R D E R\n                            V.RAMKUMAR, J.\n\n                            ----------------------------\n\n                     Bail Application No. 1471\/2007\n\n                            -----------------------------\n\n                  Dated this  20th day of March, 2007\n\n\n                                  O R D E R\n<\/pre>\n<p>             The   petitioner   who   is   the   accused   in   Crime<\/p>\n<p>No.36\/2007   of   Margoa   Town   Police   Station   for   an   offence<\/p>\n<p>punishable under   Section 364 IPC for allegedly kidnapping his<\/p>\n<p>own daughter, Anisha, now aged 18, seeks anticipatory bail.\n<\/p>\n<p>      2.     The learned counsel for the petitioner   had   asserted<\/p>\n<p>that   the   petitioner&#8217;s   daughter,   Anisha,     had   come   from   Goa   to<\/p>\n<p>the house of the petitioner  at Fort Kochi on her own accord and<\/p>\n<p>that she has attained majority.  In view of the above submission,<\/p>\n<p>the   petitioner   was   directed   to   produce   the   girl   before   the<\/p>\n<p>concerned Magistrate who was directed to record the statement<\/p>\n<p>of     Anisha   and   forward   the   same   to   this   Court.     Accordingly,<\/p>\n<p>Anisha was produced before the J.F.C.M-I, Kochi,   on 14.3.2007<\/p>\n<p>who recorded the statement of Anisha.   The said statement has<\/p>\n<p>been forwarded to this Court.  It show that the girl has attained<\/p>\n<p>majority and she came to Fort Kochi on her own accord to meet<\/p>\n<p>her   father   and   she   is   not   under   the   forcible   custody   of   any<\/p>\n<p>person and that she had left her house at Margoa without telling<\/p>\n<p>her mother.\n<\/p>\n<p>B.A.1471\/2007<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>       3.       Such   being   the   position,   I   am   inclined   to   grant<\/p>\n<p>anticipatory   bail   to   the   petitioner.       Accordingly,   a   direction   is<\/p>\n<p>issued to the   Investigating Officer   to release the petitioner on<\/p>\n<p>bail for a period of three    months   in the event of his arrest in<\/p>\n<p>connection with the above case on his executing a bond for Rs.\n<\/p>\n<p>10,000\/-   (Rupees   ten  thousand   only)     with   two   solvent   sureties<\/p>\n<p>each   for   the   like   amount   to   the   satisfaction   to   the   said   officer<\/p>\n<p>and subject to the following conditions:\n<\/p>\n<blockquote><p>             (a).      The   petitioner   shall   make     himself<\/p>\n<p>                 available   for   interrogation   as   and   when<\/p>\n<p>                 required by the  Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>              (b).     The   petitioner   shall   not   influence   or<\/p>\n<p>                 intimidate   the   prosecution   witnesses   nor<\/p>\n<p>                 shall he  attempt to tamper with the evidence<\/p>\n<p>                 for the prosecution.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              (c).     Petitioner  shall   not  commit  any  offence<\/p>\n<p>                 while on bail.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              (d).     Petitioner   shall   surrender   before   the<\/p>\n<p>                 Magistrate   concerned   and   seek   regular   bail<\/p>\n<p>                 in the meanwhile.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>B.A.1471\/2007<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>        4.    If  the petitioner  commits breach  of any  of the   above<\/p>\n<p>conditions,   the   bail   granted   to   him       shall   be   liable   to   be<\/p>\n<p>cancelled.\n<\/p>\n<p>        5.
