JMFC, Surat convicted the accused<br \/>\nU\/s.138 of Negotiable Instruments Act and sentenced him to undergo<br \/>\nsimple imprisonment for one year and pay fine of Rs.5,000\/-, in<br \/>\ndefault, to undergo simple imprisonment for three months.\n<\/p>\n<p>2).\tThe<br \/>\naccused preferred Criminal Appeal No.49 of 2008 before the Ld. 3rd<br \/>\nAdditional District &amp; Sessions Judge, Surat against the order of<br \/>\nLd. JMFC, Surat, wherein the order of Ld. JMFC was quashed and set<br \/>\naside, against which order, the original complainant filed the<br \/>\npresent appeal before this Court.\n<\/p>\n<p>3).\tHeard<br \/>\nLd. Advocate Mr. Tulsi Savani for the appellant. He produced on<br \/>\nrecord a letter stating that settlement is arrived at between the<br \/>\nparties and the amount is paid.  In view of the settlement arrived at<br \/>\nbetween the parties, Ld. Advocate appearing for the appellant seeks<br \/>\npermission to withdraw this appeal.
