Appellant Nos.4 and 5 are reported<br \/>\nto have expired, whose heirs are already on record as appellant Nos.1<br \/>\nto 3.  It is also reported that respondent No.2 &#8211; original<br \/>\nowner has also expired and no steps are taken by the appellants to<br \/>\nbring the heirs of respondent No.2 &#8211; original owner on record,<br \/>\ndespite sufficient time having been granted.  Hence, present Appeal<br \/>\nis dismissed as having been abated so far as respondent No.2 &#8211;<br \/>\noriginal owner is concerned.  Respondent No.1 is reported to be<br \/>\nunserved.  No steps are taken to serve the unserved respondent No.1.<br \/>\nHence, present Appeal is dismissed as having been abated so far as<br \/>\noriginal respondent No.1 is concerned.  Consequently, when the Appeal<br \/>\nqua respondent No.2 is<br \/>\ndismissed as having been abated, there cannot be any liability of<br \/>\nrespondent No.3 &#8211; insurance company hence, the present<br \/>\napplication deserves to be dismissed so far as respondent No.3 is<br \/>\nconcerned.  If any application is submitted by the appellants to set<br \/>\naside the abatement qua respondent<br \/>\nNo.2 &#8211; original owner<br \/>\nand in case it is granted, it will be open for the appellants to<br \/>\nrequest to revive\/restore the main appeal qua respondent<br \/>\nNo.3, which shall be considered in accordance with law on merits.\n<\/p>\n<p>2.\tWith<br \/>\nthis, present First Appeal is dismissed as having been abated so far<br \/>\nas respondent No.2 is concerned and consequently dismissed against<br \/>\nrespondent No.3.
