Justice S.SIRI JAGAN\n\n Dated :17\/07\/2008\n\n O R D E R\n                       S.SIRI JAGAN, J\n                ==================\n                  W.P(C)No.13940 of 2008\n                ==================\n          Dated this the 17th day of July, 2008.\n\n                       J U D G M E N T\n<\/pre>\n<p>     The petitioner&#8217;s daughter&#8217;s birth was not registered by<\/p>\n<p>the Registrar of Births and Deaths due to some reason<\/p>\n<p>which the petitioner says was beyond the control of the<\/p>\n<p>petitioner. For getting the same registered, orders of the<\/p>\n<p>Revenue Divisional Officer is to be obtained. The petitioner<\/p>\n<p>approached the Revenue Divisional Officer along with<\/p>\n<p>documents relating to the birth of the petitioner&#8217;s daughter.<\/p>\n<p>By Ext.P6 order the Revenue Divisional Officer rejected the<\/p>\n<p>same on the ground that there is discrepancies between the<\/p>\n<p>two documents submitted by the petitioner regarding the<\/p>\n<p>date of birth. The petitioner challenges Ext.P6 and seeks<\/p>\n<p>the following reliefs:\n<\/p>\n<blockquote><p>          &#8220;i)   Issue a writ of mandamus or any other<br \/>\n     appropriate writ, order or direction commanding the 2nd<br \/>\n     respondent to issue necessary orders to the 2nd<br \/>\n     respondent to register the birth of the petitioner&#8217;s<br \/>\n     daughter forthwith in the light of Exhibits P1, P2 and P7;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P(C)No.13940 of 2008            &#8211; 2 &#8211;<\/span><\/p>\n<blockquote><p>           ii)    issue a writ of certiorari or any other<br \/>\n     appropriate writ, order or direction quashing Ext.P6 to<br \/>\n     the extent it adversely affect the petitioner;&#8221;<\/p><\/blockquote>\n<p>     Under the Registration of Births and Deaths Act, it is<\/p>\n<p>compulsory that every birth and death has to be registered.<\/p>\n<p>That being so, the birth of the petitioner&#8217;s daughter also has<\/p>\n<p>to be compulsory registered. Since there was delay on the<\/p>\n<p>part of the petitioner in registering the birth of petitioner&#8217;s<\/p>\n<p>daughter, the petitioner invoked the jurisdiction of the<\/p>\n<p>Revenue Divisional Officer under Section 13(3) of the Act.<\/p>\n<p>The Revenue Divisional Officer cannot refuse to exercise the<\/p>\n<p>same on the mere ground that there are discrepancies<\/p>\n<p>regarding the date of birth. Since the Revenue Divisional<\/p>\n<p>Officer has jurisdiction in the matter, he has to consider the<\/p>\n<p>sufficiency of the reasons stated by the petitioner, and pass<\/p>\n<p>appropriate orders thereon unless he is of opinion that the<\/p>\n<p>birth itself has not taken place. If the birth has actually<\/p>\n<p>taken place and has not been registered earlier, the<\/p>\n<p>Revenue Divisional Officer can decide the date of birth of<\/p>\n<p>the petitioner&#8217;s daughter, for which he has to cause<\/p>\n<p><span class=\"hidden_text\">W.P(C)No.13940 of 2008        &#8211; 3 &#8211;<\/span><\/p>\n<p>necessary enquiries to be made and ascertain the actual<\/p>\n<p>date of birth of the petitioner&#8217;s daughter. He cannot simply<\/p>\n<p>reject the application on the ground that there is<\/p>\n<p>discrepancy in the documents produced by the petitioner<\/p>\n<p>regarding the date of birth of his daughter.<\/p>\n<p>      Accordingly, Ext.P6 is quashed and the 2nd respondent<\/p>\n<p>Revenue Divisional Officer is directed to pass appropriate<\/p>\n<p>orders in the matter in accordance with law and the<\/p>\n<p>observations herein, as expeditiously as possible, at any<\/p>\n<p>rate, within one month from the date of receipt of a copy of<\/p>\n<p>this judgment.
