enhancement of the compensation awarded fot the
\ndeath of K.T.Shivappa,mwho ia the hgsba\ufb01d”of lst<\/p>\n
claimant and father of claimanta 2 to 4L’<\/p>\n
2. The  factS: of .the _caae data that, on
\n3.7.1999 a\u00a3hxaha\u00a7td’9;h\ufb01di\u00a7jm;;x the deceased
\nK.T.Shiva\ufb01nad:waa wdatr\u00a7i\ufb01\u00a7’_miihv on his bicycle
\nfrom Rajanahailiadtocd\ufb01atihar. While he was<\/p>\n
proceeding neat Kodi\u00a7af”Hospet, a lorry baaring<\/p>\n
3No,TLS\u00a7\u00a70?5. came “from’ opposite direction in a<\/p>\n
hash and negiid\u00e9nt manner and dashed against the<\/p>\n
vcycie;”FAa’aff\u00e9ault of which he fell down, the<\/p>\n
said i\u00e9rpygya\ufb01 over the head of K.T.Shivappa, he<\/p>\n
M\ufb02ddied*at the spot of accident.<\/p>\n

d”\u00bbhefore the claims Tribunal seeking compensation<\/p>\n
:for the death of K.T.Shivappa. The said<\/p>\n

petition was filed against the driver, owner and<\/p>\n
insurer of the lorry bearing No.TLS-3075. In tner,<\/p>\n

No.1\/Driver is dismissed, respondent Ne Z\ufb01ewner<\/p>\n
remained exparte and respondent ‘\ufb01o;3finsurerV,_f<\/p>\n
entered appearance and filed_written statement;<\/p>\n

\ngot himself examined as”?W}1 and ne get examined<\/p>\n

seeking \u00abin .ali a\ufb01-ceepensation in a sum of
\nRs.1o,16}oo9\/~v sits ‘itta\u00a3e\u00a7t’ at 18% p.a.. from<\/p>\n
the date ‘.gf,V petition’ till the date of<\/p>\n
erealisation of coepensation. The respondent No.3<\/p>\n

if. and the .Couit below ought to have taken the<\/p>\n

i ineteed”of Rs.60\/~ per day while calculating the<\/p>\n
ilioss\ufb02iof dependency. If the income ;of the<\/p>\n
hVeideceased is taken as Rs.80f- per day and<\/p>\n
:considering his age as 35, by applying the<\/p>\n

to his personal use, the loss of dependeh\u00a2ystofhV<\/p>\n

entitled to is Rs.3,28,000\/~ instead of<\/p>\n
Rs.2,18,000\/-. Accordingly, the aforesaid p<\/p>\n
amount of Rs.3,28,000\/- is awarded to  %h%\ufb01;’m<\/p>\n
claimants in this appeal. In so far\u00bb as “theA<\/p>\n
other aspects, the judgment and mewaidiiof. the ,_f<\/p>\n
Tribunal remains unaltered. _<\/p>\n
