Petitioner is aggrieved by Ext.P9 order of<\/p>\n<p>assessment issued under the provisions of the Kerala<\/p>\n<p>Building Tax Act, 1975.             Petitioner is the builder and<\/p>\n<p>promoter of a multi storied residential apartment complex.<\/p>\n<p>Contention of the petitioner is that the apartment complex<\/p>\n<p>contain 80 independent residential flats which are owned by<\/p>\n<p>distinct allottees who had been transferred with undivided<\/p>\n<p>share in the land and the cost of construction was met by<\/p>\n<p>each such allottees pursuant to specific agreement executed<\/p>\n<p>with the builder. It is the contention of the petitioner that in<\/p>\n<p>view of the settled legal precedents of this court                  in<\/p>\n<p>M\/s.Bawasons Construction Company Vs. Thahsildar<\/p>\n<p>[2007(2)    KHC     409]       and      in     Provincial     Superior,<\/p>\n<p>Franciscan Clarist congregation of nuns Vs. State of<\/p>\n<p>Kerala [2009(1) KHC 611], if distinct apartment contain in<\/p>\n<p>residential complex is owned by difference persons and if<\/p>\n<p>W.P(C) No.24242 of 2009<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>the cost of construction of such apartment was met by each<\/p>\n<p>such owners, then the building will fall within the definition<\/p>\n<p>of Section 2(e) Explanation &#8211; II of the Act, and the same<\/p>\n<p>need be assessed separately against each such individuals<\/p>\n<p>owners.    It is the complaint of the petitioner that the<\/p>\n<p>assessment order is issued without taking note of any such<\/p>\n<p>contention.\n<\/p>\n<p>     2.   It   is  noticed  that,  before     finalising   the<\/p>\n<p>assessment, the first respondent had issued Ext.P8 notice to<\/p>\n<p>the petitioner calling for production of documents if any,<\/p>\n<p>available. It is submitted by the petitioner that all relevant<\/p>\n<p>documents pertaining to transfer of undivided share in the<\/p>\n<p>land, agreements executed between individual allottees and<\/p>\n<p>the builder, evidence regarding expenses of construction<\/p>\n<p>met by each such allottees etc; were produced before the<\/p>\n<p>first respondent. It is contended that the first respondent<\/p>\n<p>without accepting those documents and without adverting<\/p>\n<p>to the contentions had unilaterally issued Ext.P9 order of<\/p>\n<p>W.P(C) No.24242 of 2009<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>assessment, treating the entire plinth area of the building<\/p>\n<p>as a single unit. But at the same time the assessment order<\/p>\n<p>is issued to the petitioner and 79 others, whose names are<\/p>\n<p>not mentioned therein.\n<\/p>\n<p>     3.   On a perusal of Ext.P9, it is noticed that it is a<\/p>\n<p>cryptic order passed in a printed form.       Ext.P9 will not<\/p>\n<p>reflect any application of mind of the assessing authority. It<\/p>\n<p>is not evident as to whether any of the contentions raised<\/p>\n<p>by the petitioner has been adverted to by the assessing<\/p>\n<p>authority vested with powers for assessment under a<\/p>\n<p>physical statute is exercising a quasi-judicial function, and<\/p>\n<p>such authorities are expected to pass speaking orders which<\/p>\n<p>will reflect application of mind and advertence to the<\/p>\n<p>objections of the assessee. Ext.P9 cannot be characterized<\/p>\n<p>as an order which is passed after application of mind on<\/p>\n<p>adverting to the contentions raised by the assessee, or after<\/p>\n<p>perusing any of the documents proceeds in support of such<\/p>\n<p>contentions. Hence Ext.P9 is prima facie unsustainable in<\/p>\n<p>W.P(C) No.24242 of 2009<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>the eye of law.\n<\/p>\n<p>     4.   Accordingly writ petition is disposed of quashing<\/p>\n<p>Ext.P9.   The first respondent is directed    to pass fresh<\/p>\n<p>orders after affording an opportunity to the petitioner and<\/p>\n<p>the owners of the individual apartments, to produce<\/p>\n<p>necessary documents and also an opportunity or personal<\/p>\n<p>hearing.
