ABDUL REHIM, J\n                ------------------------------\n             WP(C) NO. 32810 OF 2010\n             ------------------------------------\n       Dated this the 29th day of October, 2010\n\n\n                       JUDGMENT\n<\/pre>\n<p>     Petitioner is aggrieved by non acceptance of motor<\/p>\n<p>vehicles tax due with respect to vehicle owned by him<\/p>\n<p>bearing No. KL-56-6570, insisting on production of proof<\/p>\n<p>regarding payment of contributions to the Kerala Motor<\/p>\n<p>Transport Workers Welfare Fund.            According to the<\/p>\n<p>petitioner the said vehicle was purchased by him and the<\/p>\n<p>registration was got transferred into his name only with<\/p>\n<p>effect from 11.05.2010. It is stated that the arrears of<\/p>\n<p>contributions, if any due for the periods prior to the said<\/p>\n<p>date need be cleared payment by the previous owner, the<\/p>\n<p>3rd respondent herein. Since the petitioner is not liable<\/p>\n<p>for payment of such arrears, the non-acceptance of motor<\/p>\n<p>vehicles tax on the ground of non-production of &#8216;No<\/p>\n<p>Objection Certificate&#8217; from the first respondent is highly<\/p>\n<p>unsustainable and unjustifiable, is the contention.<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><br \/>\nWP(C) No. 32810\/2010<\/p>\n<p>     2.     Considering the facts and circumstances of the<\/p>\n<p>case, I am of the opinion that the second respondent can be<\/p>\n<p>directed to accept motor vehicles tax without producing<\/p>\n<p>proof regarding payment of contributions, subject to the<\/p>\n<p>condition that the petitioner produce proof regarding<\/p>\n<p>payment of contributions for the period from 11.05.2010<\/p>\n<p>onwards, and subject to rights of the first respondent to<\/p>\n<p>take proper steps for realizing arrears if any due, either<\/p>\n<p>from the 3rd respondent or from the petitioner, whoever is<\/p>\n<p>liable in accordance with law.\n<\/p>\n<p>     3.     Learned standing counsel appearing for the first<\/p>\n<p>respondent Board submits that there is arrears of Rs.6,800\/-<\/p>\n<p>due for the period prior to the transfer. Referring to the<\/p>\n<p>provisions contained in the Kerala Motor Transport Workers<\/p>\n<p>Welfare Fund Act, it is pointed out that inspite of transfer of<\/p>\n<p>ownership the said amount will be a charge on the vehicle,<\/p>\n<p>under Section 10 (2).\n<\/p>\n<p>     4.     Under the above circumstances, the Writ Petition<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><br \/>\nWP(C) No. 32810\/2010<\/p>\n<p>is disposed of directing the second respondent to accept<\/p>\n<p>motor vehicles tax due with respect to vehicle bearing No.<\/p>\n<p>KL-56-6570, without insisting for production of proof<\/p>\n<p>regarding payment of contributions to the Welfare Fund,<\/p>\n<p>provided the petitioner produce proof regarding remittance<\/p>\n<p>of contributions for the period after 11.05.2010.<\/p>\n<p>     5.     It is made clear that the first respondent will be at<\/p>\n<p>liberty to take effective steps for realizing amount of arrears<\/p>\n<p>if any due for the period prior to 11.05.2010, as permissible<\/p>\n<p>under law by initiating appropriate steps.<\/p>\n<p>                                      C.K.
