In the<br \/>\nfacts and circumstances of the case and with the consent of the<br \/>\nlearned advocates for the respective parties, the application is<br \/>\ntaken up for final hearing today.\n<\/p>\n<p>2.0.\t\tPresent<br \/>\napplication has been preferred by the applicants herein-original<br \/>\npetitioners to extend the time to remove the construction in the<br \/>\nmargin land, which petitioners were required to remove on or before<br \/>\n15th July 2011<br \/>\npursuant to the order passed by this Court dated 6.4.2011 as well as<br \/>\nundertaking filed by the applicants.\n<\/p>\n<p>3.0.\t\tHaving<br \/>\nheard the learned advocates for the respective parties<br \/>\nand in the facts and circumstances of the case and considering the<br \/>\naverment in the application and subject to filing afresh undertaking<br \/>\nby the applicants that applicants shall remove the construction put<br \/>\nin the margin land of plot nos. 1 to 4 Final Plot No.162 of Town<br \/>\nPlanning Scheme No.2 of Karjan on or before 6.10.201, time to remove<br \/>\nsuch construction is hereby extended upto 6.10.2011. NO further<br \/>\nextension shall be granted on any ground. Fresh undertaking by the<br \/>\napplicants shall be filed with the Registry of this Court with a cop<br \/>\nto respondent no.2 within a period of one week from today, failing<br \/>\nwhich it should be construed that there is no extension in favour of<br \/>\nthe petitioners and the respondent shall be free to remove the<br \/>\nconstruction in question.
