The polling took place on 7.2.1997 and after counting<br \/>\nof  votes on 9.2.1997, respondent No.l was declared elected.<br \/>\nIn  view  of the limited nature of controversy\tinvolved  in<br \/>\nthis  appeal,  we  are relieved of the necessity  of  giving<br \/>\nbreak-up<\/p>\n<p>      of  votes\t or mention about other candidates, who\t had<br \/>\nalso contested the election.\n<\/p>\n<p>      The  appellant  filed an election petition seeking  to<br \/>\ndeclare\t the election of returned candidate void on  various<br \/>\ngrounds\t and for a further declaration that the appellant be<br \/>\ndeclared  duty elected as Member of the Legislative Assembly<br \/>\nafter  setting aside election of the returned candidate.  In<br \/>\nthe  election  petition,  two main  corrupt  practices\twere<br \/>\nalleged\t to have been committed by the returned candidate  &#8211;<br \/>\none   falling\tunder\tSection\t  123\t(1)(A)(b)   of\t the<br \/>\nRepresentation of the People Act, 1951 (hereinafter referred<br \/>\nto  as the Act) and the other falling under Section 123\t (4)<br \/>\nof  the Act.  The material facts and particulars  concerning<br \/>\nallegations  of corrupt practice insofar as corrupt practice<br \/>\nunder  Section\t123(1)\tis  concerned,\tare  contained\tfrom<br \/>\nparagraphs  28\tto.   39  of the  election  petition,  while<br \/>\nmaterial  facts\t and  particulars concerning  commission  of<br \/>\ncorrupt\t practice  falling under Section 123 (4) of the\t Act<br \/>\nare  contained\tin  paragraphs\t12 to  27  of  the  election<br \/>\npetition.\n<\/p>\n<p>      Mr.   Talwar,  learned  counsel\tappearing  for\t the<br \/>\nelection  petitioner  has  taken  us  through  the  election<br \/>\npetition.\n<\/p>\n<p>      Section 123(4) of the Representation of the People Act<br \/>\nprovides :\n<\/p>\n<p>      &#8220;The pub1ication by a candidate or his agent or by any<br \/>\nother person with the consent of a candidate or his election<br \/>\nagent,\tof any statement of fact which -is false, and  which<br \/>\nhe  either  believes to be false or does not believe  to  be<br \/>\ntrue,  i&#8217;n relation to the personal character or conduct  of<br \/>\nany  candidate,\t or  in\t relation  to  the  candidature,  or<br \/>\nwithdrawal,  of any candidate, being a statement  reasonably<br \/>\ncalculated  to\tprejudice the prospects of that\t candidate&#8217;s<br \/>\nelection,&#8221;\n<\/p>\n<p>      In  vain,\t have  we   searched  through  the  election<br \/>\npetition  and,\tparticularly  through paragraphs  12  to  27<br \/>\nthereof,  dealing  with\t the alleged commission\t of  corrupt<br \/>\npractice  which falls within the mischief of Section  123(4)<br \/>\nof  the\t Act,  for  any averment to  the  effect,  that\t the<br \/>\npublication  was  made\tby the returned candidate  or.\t his<br \/>\nelection  agent\t or by any other person with the consent  of<br \/>\nthe  candidate\tor his election agent&#8217; or any  statement  of<br \/>\nfact  which  is\t false and which he either beIieves  .to  be<br \/>\nfalse.\t or does not believe .to be true in relation to\t the<br \/>\npersonal character or conduct of the candidate.\n<\/p>\n<p>      The  election  petition -is singularly silent  of\t any<br \/>\nsuch  averment that the returned candidate, even &#8220;if, it  be<br \/>\nassumed\t for  the sake of the arguments, had  published\t and<br \/>\ndistributed  certain  documents, (Annexures A-1 to A-7),  as<br \/>\nalleged\t in the election petition either himself or  through<br \/>\nany  other  persons with his consent, that those  statements<br \/>\nwere  false and that the returned., candidate ..   eJ.the&#8221;&#8221;.<br \/>\nbe  I  i eved hem on be false or did not believe them to  be<br \/>\ntrue,  though in paragraph 9 of the election petition, which<br \/>\nhas  been verified as correct on the basis of legal  advice,<br \/>\nthis  requirement  emanating  from Section 123(4)  has\tbeen<br \/>\nmentioned  but\twithout\t any  assertion\t that  the  returned<br \/>\ncandidate  in  this  case  published  the  false  statements<br \/>\nknowing\t them  to be false and\/or not believing them  to  be<br \/>\ntrue.  The submission of Mr.  Talwar, that at the trial, the<br \/>\npetitioner could have said so in his evidence is futile.  It<br \/>\nis an established proposition that no evidence can be led on<br \/>\na  plea\t not raised in the pleadings and that no  amount  of<br \/>\nevidence can cure defect in the pleadings.\n<\/p>\n<p>      In  the  face of the pleadings, no charge\t could\thave<br \/>\nbeen framed insofar as corrupt practice under Section 123(4)<br \/>\nof the Act is concerned.  We need not detain ourselves to<\/p>\n<p>      consider\tthe &#8216;allegations&#8217; in this behalf, because of<br \/>\nthe absence of the essential averments to lay a charge under<br \/>\nSection 123(4) of the Act.  The requirement of making such a<br \/>\nstatement,  as referred to above by us.\t is mandatory and in<br \/>\nthe  absence of any such statement, the charge could not  be<br \/>\nput  to\t trial.\t  Paced\t with this  serious  lacuna  in\t the<br \/>\npleadings,  Mr.\t  Talwar sought to press the allegations  of<br \/>\nbribery under Section 123(1) as detailed in paragraphs 28 to<br \/>\n39 of the election petition.\n<\/p>\n<p>      Coming  now to the charge of corrupt practice  falling<br \/>\nunder  Section\t123(1) of the Act, for which material  facts<br \/>\nand particulars have been detailed in paragraphs 28 to 39 of<br \/>\nthe  election petition, we find that those allegations could<br \/>\nnot  be put to trial either.  There is no affidavit filed in<br \/>\nsupport of the allegations of corrupt practice of bribery.\n<\/p>\n<p>      Proviso  to  Section  83(1) of the Act lays  down,  in<br \/>\nmandatory  terms, that where a.n election petitioner alleges<br \/>\nany  corrupt  practice, the election petition shall also  be<br \/>\naccompanied  by\t an  affidavit, in the prescribed  form,  in<br \/>\nsupport\t of  the  allegations  of   such  practice  and\t the<br \/>\nparticulars thereof.  The affidavit, which has been filed in<br \/>\nsupport of the election petition, does not at all deal with<\/p>\n<p>      the charge of bribery falling under Section 123 (1) of<br \/>\nthe  Act.  Leaving aside the questions that the affidavit is<br \/>\nnot  even in the prescribed form &#8211; Form 25.  of the  conduct<br \/>\nof  Election Rules, the allegations of corrupt practice made<br \/>\nin  the election petition are not supported by the otherwise<br \/>\ndefective   affidavit  either.\t .All\tthe  names  of\t the<br \/>\ninformants  which have been given in the affidavit relate to<br \/>\nthe  corrupt practice under Section 123(4) and the affidavit<br \/>\nin   this   respect  is\t a  verbatum  reproduction  of\t the<br \/>\nverification  clause  of  the election\tpetition  concerning<br \/>\ncorrupt\t practice  under  Section 123(4).  No  name  of\t any<br \/>\ninformant  has been mentioned in respect of the\t allegations<br \/>\nof  corrupt practice under Section 123(1) in the  affidavit.<br \/>\nIn  the absence of the requisite affidavit filed in  support<br \/>\nof  the allegation of corrupt practice under Section  123(1)<br \/>\nof  the Act, as detailed in the election petition, no  issue<br \/>\ncould be raised for trial.\n<\/p>\n<p>      Section  83  of the Act is mandatory in character\t and<br \/>\nrequires  not only a concise statement of material facts and<br \/>\nfull  particulars of the alleged corrupt practice, so as  to<br \/>\npresent\t a  full  and complete picture of the action  to  be<br \/>\ndetailed in the election petition but under the proviso to<\/p>\n<p>      Section  83(1)  of  the  Act,  the  election  petition<br \/>\nlevelling a charge of corrupt practice &#8220;is required, by law,<br \/>\nto  be\tsupported  by an affidavit &#8220;in\twhich  the  election<br \/>\npetitioner  is obliged to disclose his source of information<br \/>\nin  respect of the commission of that corrupt practice.\t The<br \/>\nreason\tfor  i:,his insistence is obvious.  It is  necessary<br \/>\nfor  an election petitioner to make such a charge with\tfull<br \/>\nresponsibility and to prevent any fishing and roving enquiry<br \/>\nand  save  the\treturned  candidate   from  being  taken  by<br \/>\nsurprise,  in  the  absence  of\t proper\t affidavit,  in\t the<br \/>\nprescribed form, filed in support of the corrupt practice of<br \/>\nbribery, the allegation pertaining thereto, could not be put<br \/>\nto trial the defect being of a fatal nature.\n<\/p>\n<p>      We  also\twish  to note here that the  learned  Senior<br \/>\ncounsel\t appearing  for the election petitioner in the\tHigh<br \/>\nCourt  had  on 14.7.1998 made a statement in the High  Court<br \/>\nthat-  he was not pressing his prayer relating to recounting<br \/>\nof votes.  No other point was raised before us.\n<\/p>\n<p>      The  learned Single Judge of the High Court  dismissed<br \/>\nthe  election  petition\t on deciding Issue No.5,  which\t was<br \/>\ntreated as a preliminary issue and reads thus :\n<\/p>\n<p>      &#8220;Whether the election petition lacks in material facts<br \/>\nand particulars, necessary to constitute<\/p>\n<p>      complete\tcause  of action for setting as&#8221;&#8216;de  of\t the<br \/>\nelection  of  &#8216;the  respondent No.1, within the\t meaning  of<br \/>\nSection\t 83, read with Sections 100(1)(d)(1v) and 123 of the<br \/>\nRepresentation of People Act.?&#8221;\n<\/p>\n<p>      For  what.  we have said above, the order of dismissal<br \/>\nof  the\t election  petition, without putting  it  to  trial,<br \/>\ncannot be faulted with.\n<\/p>\n<p>      For our reasons) which are somewhat different from the<br \/>\nones  given by the High Court, we find that the decision  of<br \/>\nthe  High  Court  to  non-suit the  election  petitioner  by<br \/>\ndeciding  the preliminary issue against him is well merited.<br \/>\nThere  is no merit in this appeal.  It.\t consequently, fails<br \/>\nand  is hereby dismissed.
