BurJ.n'  'g i:hc  \ufb01nal' --  V t11e prosecution examm ed\nPWS 1   and  ihe\ufb02\ufb01evixvience got maxkcd the documents\n    1 to 3. The statement of the\n\n [US 313 Cr.P.C. He has taken the\n\nVdefence \"of eienial and has not lead any defence\n\n\"  tnal' Court on appreciation of the material on\n\n convicted the accused for the o\ufb01ence pumsh' abk:\n\n (I) and Sec.448 of IPC and ordered to undergo\n\n 'eimeprisonment for \ufb01ve years for the o\ufb01imce punishable U \/S\n\nS \"V304 part one IPC and to pay \ufb01le of Rs.1,(}0O\/--~ and for the\n\n;&gt;Z,\n\n\n\nVPW.4, 1\u00a7o\u00ab...oth;\u00e9r \ufb01ii\ufb01csscs have supportad the version of the\n\"   in the absence of any corrobomtieon, he\nV   the ctmviction of the appellant is illegal and\nV H  So also, it is his conteniion that the aliegation\n 'a\u00e9\u00e9\u00e9inst the accused is that he slapped on thy: chceks of the\n\nS deceased and thereby, she fell down and thcxewer, the\n\n'3\n\neffcncc punishable 11\/8 448 of IPC ordcr\ufb01 to \nimprisonment for six months and to pay \ufb01ne of \nAggricved by the conviction and sentence the    \n\nappmachcd this Court in appeal.\n\n4. I have heard 11.16   ' \"f\ufb02lffithc\nappellant and the learned   AA \n\n5. The point'     is:\n\"Whether \u00a3:cnv1ct1o' ' n\nof the  iifor \"-the. 'o\ufb02bizmsz punishable\nU\/S:\u00a5\u00a7_30\"i\"(l)v\";\u00e9\u00ab:1sc1i\"'S\u00a2c,:448 -'of IPC and the\n\nsentencg th\u00a21*eI\"1.t11e ofthe \"deceased were found and therefore, he\n\ns{\u00a7i2133\u00a7t\u00e9\"  has been corroborated by the\n\n\n\n7. The perusal of the evidence led \n\npmsecution reveals that apart from PW s.4Hgn;1d 14.;  * _  '4  \n\nand 12 are the eye witnesses   \n\nbut they  not supported the pit-3__ccuti1\u00e9&gt;:a_ 'and   .\n\ntreatcti hostile. It is in th'm  \nthe evidence of PW's.4 and   of\nassault on the deceased by th c_   \n\n8. So far  fd,\nPW.4, Pw.14    it is not m\ndispute.     of_  that his father\nVcz1kataPPa   to the: accused for m\namount of --Rs:1,(;()(\\._[f  death and that IPWA had\n   of  - to the accused am took back\n\nthef'  them was strained relationship\n\n-- hemre\u00e9njile  \u00a3nembers of accused and PW.4. It is also\n\nith\ufb01' 'version' _of. the prosecution that since a\ufb01cr fht': sale\n\n   the accused used to quarrel with the\n\nV\"  and the family members for no xmscn and that\n\n were scared of the accused and never \ufb01led my\n\n  ,\"compia:i:at against the accused in that behalf. So far as the\n\n94\n\n\n\nVtalmn. loefom oix\u00e9imina\ufb01on and infact, the prosecution has\n\n_,  touch c\ufb01orts to obtain the finger prints to taliy\n\ufb02\ufb01ngcr prints of the accused. But any how, the\n\nH  vcrsia-11 of Pws.-4 and 14 reveals that the accused\n 'si\u00e9ipped on the left check of the deceased and when she fell\n\n \"wdown, he kicked hm\" on the abdomen. So the medical\n\nsame manner with regard to tho slap by the accuscdoii   -5 \u00e9 \n\ndeceased and kicking on the abdomen.\n\n9. If the evidence of PWs.4 gnd \nthe context of the evidence of PW.  \npost mortem examination on  thc \"of  \nissued the post mortcm _\u00a7\u00a7':x';-2\u00a7'_.v  there\nwere \ufb01nger marks over the   'olackhsh in\ncolour and     So far as\nthe cause of of opinion that the\ndeath is doe  oboe}: due to re\ufb02ex vagal\n\ninhibition. *r1:\u00a7.e..15acu5'r&lt;   that the izxjuzy is\n\nsimple, b\u00a71t&quot;thc doa\ufb02&#039;1 is du\u00e9 to neumgcmlc shock. No doubt\n   PW.1, an c\ufb01brt has been made\n\nby   as to whether the \ufb01nger prints were\n\n9;,&#039;\n\n\n\n   .,c_injt1;tiesv-.--..ixxc1usivc of a Iacerated wound\n\n   x 2 cm. on the left cheek mad reduces\n teeuderiyxesexf over the Je\ufb01: mammary regima and\n\nV    the superior aspect of left shoulder joint.\n\nX    has certi\ufb01ed that these injuries are simple in\n  and even in his evidence, PW.2, the Doctor has\n\n  to these injuries. The injury certi\ufb01cate itscif reveals\n\n14. The prosecution has examined PW2   A&#039; \nKumar, who examined the accused and it is  \ncomplaint Ex.P.4 that after the assault Zen  , \nthe accused and after the death of    \nreturned to the house, he told the   \na complaint against the  foif  ct the\ndeceased and at that time,  fitlcstioned\nPWA xegatding   for&#039;   it is\nalleged that  a club and in\nsuch    by 1=w.2 and\nthe injuiy   The perusal of the\n\ninjury  accused has sustaizeeti as\n\n on the mrieto occipital region and an\n\n51.,\n\n \n\n\n\n-- VTEXJ3. 10 for the seizure of M03. 1 to 3 (the\n:c;:\u00ab:\u00a7.:mg. en &#039;e;__\u00a7I\u00a5 body of the deceased) a\ufb01er the postmortem\n P&#039;Ws.8 and 13 have been examined to prove\nV. the spot mahazazr and as there is no mcnmma&#039; &#039; &#039; ting\n\n Aciefeuznstanee in Ex.P.6, I do not think that the evkieme of\n\nthat the assault on the accused was by PW.-4 Munitajei ..\nthe presence of the accused at the time of the    \nbeen corrohcrahed by the evidence of  asit   \nthe assault on the accused was on 25.  f&quot;T~A\nat about 8.30 am. It could be   by \n\nthe act of the accused in cayxsing  daihis &#039;::i1o&#039;#1,1e1\u00a7 \nassaulted the accused with v\u00e9&#039;%c1a;y morning\n\nof the incident.  P&#039;W.3 the\nPolice Sub Inspgttef   and sent\n\nthe    the Magistrate\n\nand PW25  &#039;.1:l__1e shifting of the deceased\n\nin the autoxieiisiiaxv  whereas, PWs.6 am 12\n\nare the atf&#039;.es&#039;-.ti_x.xg   see inquest Ex.P.9 and it also\n  finger  on the cheeks of the tied\n\ndue  The prosecution examm ed PW.?e the\n\n94\n\n \n\n\n\n \n\nI9\n\nORDER\n<\/pre>\n<p>The appeal is a\ufb01owed in part. The     &#8221;<br \/>\nacquitted d&#8217; the changes under Section&#8217; 433   A&#8217; V<br \/>\nand he is held gukly for the offence    H<br \/>\nIPC.
