\n\tlearned advocate for the petitioner.\n<\/p>\n
The
\n\tpetitioner, by way of this petition, under Article 226 as well as
\n\tunder Article 227 of the Constitution of India, approached this
\n\tCourt for the following prayers :\n<\/p>\n
“(A)
\nThis Hon’ble Court may be pleased to admit and allow this petition;\n<\/p>\n
(B)\tThis
\nHon’ble Court may be pleased to issue writ of mandamus or any other
\nappropriate writ, order or direction, quashing and setting aside the
\ncommunication dated 9.8.2011 issued by respondent No.2 to the Police
\nSub-Inspectorshri, Gadhada;\n<\/p>\n
(C)
\nThis Hon’ble Court may be pleased to issue writ of mandamus or any
\nother appropriate writ, order or direction, directing respondent No.1
\nto hear and decide the revision application as well as the
\napplication for interim relief as expeditiously as possible,
\npreferably within a period of one month;\n<\/p>\n
(D)
\nPending admission hearing and final disposal of the petition, be
\npleased to stay execution, implementation and operation of the
\ncommunication dated 9.8.2011 addressed by respondent No.2 to the
\nPolice Sub-Inspectorshri, Gadhda;\n<\/p>\n
(E)
\nPending hearing and final disposal of the petition, be pleased to
\ndirect respondent No.1 to hear and decide the revision application as
\nwell as the application for interim relief as expeditiously as
\npossible and preferably within one month;\n<\/p>\n
(F)
\nThis Hon’ble Court may be pleased to grant any other and further
\nreliefs, as the nature and circumstances of the present case may
\nrequire.”\n<\/p>\n
\tThus,
\nwhat is essentially challenge is communication dated 9.8.2011 from
\nMamlatdar to P.S.I , Gadhda and an additional prayer is made seeking
\nsome direction to the respondent No. 1 i.e Deputy Collector for
\nexpeditious disposal of the petitioner’s revision.\n<\/p>\n
Learned
\n\tadvocate appearing for the petitioner contended that the
\n\tcommunication of Mamlatdar is nothing but over stepping of the power
\n\tas could be seen from the provisions of Section 21 of the
\n\tMamlatdar’s Court Act, 1906. The petitioner’s advocate has further
\n\tsubmitted that Sub-section (4) of Section 21 also provides penal
\n\taction for flouting the order and in view thereof, the concerned
\n\tMamlatdar was not justified in issuing such a communication, which
\n\totherwise would render the petitioner’s revision application as well
\n\tas stay application pending before the Deputy Collector infructuous.\n<\/p>\n
This
\n\tCourt is of the view that present petition required to be dismissed
\n\toutright for the following reasons namely:\n<\/p>\n
The
\n\tpetitioner is admittedly under an order of competent Court which
\n\tcarries direction to him to remove the artificial wall and the
\n\tpetitioner has filed Revision Application against said order, though
\n\tthe petitioner has not been successful in obtaining any orders from
\n\trevisional authority, meaning thereby, the petitioner today is
\n\tguilty of non-compliance with the order of Mamlatdar, which is an
\n\torder of Court as could be seen from the provisions of Mamlatdar’s
\n\tAct, 1906.\n<\/p>\n
The
\n\tpetitioner has not moved any application seeking either early
\n\thearing or invited order of the Deputy Collector on such
\n\tapplication, whereon, he could have some justification for
\n\tentertaining petition alleging in action on the part of Deputy
\n\tCollector.\n<\/p>\n
The
\n\tpetitioner has filed this petition under Article 226 and also under
\n\tArticle 227 of the Constitution of India. In my view, petition under
\n\tArticle 226 is not maintainable as not an iota of submission, either
\n\twritten or oral, is canvassed indicating justification for invoking
\n\tjurisdiction under Article 226 of the Constitution of India. The
\n\tcourt hastened to add here that petitioner, who is under an
\n\tobligation to obey the order passed by Mamlatdar, today he cannot
\n\thave been permitted to file petition under Article 226 for invoking
\n\tinherent jurisdiction to perpetuate his flouting of the order of
\n\tsub-ordinate court.\n<\/p>\n
The
\n\tpetition is essentially filed under Articles 226 and 227 of the
\n\tConstitution of India, but unfortunately, the petition is filed
\n\twithout joining the ‘State’ as a party respondent. Now, it is
\n\testablished principle of law, which does not require any elaborate
\n\tdiscussion, the petition which is filed without joining the ‘State’
\n\tas a party or which is filed without joining ‘State’ in any manner,
\n\tis not maintainable at first instance. Therefore, on this count
\n\talso, petition deserves to be rejected.\n<\/p>\n
The
\n\tpetitioner has set out Section 21 on page-11, whereunder these words
\n\tare required to be noted <\/p>\n
“(1)
\n\tWhere the Mamlatdar’s decision is for removal of an impediment or
\n\tfor awarding possession or restoring a use, he shall give effect
\n\tthereto by issuing such orders to the village-officers, or to any
\n\tsubordinate under his control, or otherwise, as he thinks fit:”\n<\/p>\n
\t                  (emphasis
\n\tsupplied)<\/p>\n
The
\n\temployment of phrase “or otherwise, as he thinks fit” in
\n\tmy view, give ample room to learned Mamlatdar in issuing direction
\n\tand seeking appropriate help of officers, of having his order
\n\timplemented.\n<\/p>\n
Thus,
\n\tin my view, the petition being hopelessly merit less, deserves
\n\trejection and is rejected accordingly. However, there shall be no
\n\torder as to costs.\n<\/p>\n
