Justice KURIAN JOSEPH\n\n Dated :20\/12\/2006\n\n O R D E R\n                            KURIAN JOSEPH, J.\n\n                           ----------------------------\n\n                       W.P.(C).No.29291 OF 2003\n\n                           -----------------------------\n\n             Dated this the 20th day of December, 2006\n\n\n                               J U D G M E N T\n<\/pre>\n<p>     The writ petition is filed with the following prayers:<\/p>\n<p>     i)       A   writ   of   mandamus   or   any   other   writ,   order   or<\/p>\n<p>     direction   directing   the   respondents   to   provide   the<\/p>\n<p>     contracted load of 37KW to the Karavaloor Telephone<\/p>\n<p>     exchange   for   which   sanction   was   accorded   as   per<\/p>\n<p>     Ext.P3 forthwith.\n<\/p>\n<\/p>\n<p>     ii)      A writ in the nature of a writ of certiorari or any<\/p>\n<p>     other   writ   order   or   direction   quashing   Ext.P10,   P14<\/p>\n<p>     invoices   issued   by   the  respondent  board   and   Ext.P13<\/p>\n<p>     order passed by the 4th respondent.\n<\/p>\n<\/p>\n<p>     iii)     A   writ   of   prohibition   or   any   other   writ   order   or<\/p>\n<p>     direction   directing   the   respondents   not   to   take   any<\/p>\n<p>     coercive steps to disconnect the present supply to the<\/p>\n<p>     Karavaloor Telephone exchange.\n<\/p>\n<\/p>\n<p>     iv)      Direct the 1st  respondent to grant interest at the<\/p>\n<p>     rate   of   12%   per   annum   on   Rs.   6,32,106\/-   in   deposit<\/p>\n<p>     with   the   1st  respondent   Board   and   adjust   the   same<\/p>\n<p>     towards   the   future   bill   till   a   37KW   connection   is<\/p>\n<p>     provided to the petitioner as contracted.<\/p>\n<p>     It   is   seen   that   there   is   an   interim   order   dated   16.9.2003<\/p>\n<p>which reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>     &#8220;There   will   be   an   interim   stay   of   disconnection   on<\/p>\n<p>     condition   that   the   petitioner   deposits   Rs.   30,000\/-<\/p>\n<p>     within two months from today&#8221;.<\/p><\/blockquote>\n<p>     Since   the   4th  respondent   has   already   considered   the   issue<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.29291\/2003                         :2:<\/span><\/p>\n<p>and since he being appellate authority it is only appropriate that<\/p>\n<p>the   4th  respondent   considers   the   entire   issue   with   notice   to   the<\/p>\n<p>petitioner.  There will be a direction to the 4th respondent to look<\/p>\n<p>into  the   dispute  as  raised   in  the   writ   petition  with   notice   to   the<\/p>\n<p>petitioner and take appropriate action thereon in accordance with<\/p>\n<p>law   to   settle   the   whole   issue.
