Justice V.GIRI\n\n Dated :23\/07\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                   W.P.(C).22088\/2008\n                       --------------------\n            Dated this the 23rd day of July, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>     The petitioners were initially         appointed as CLR<\/p>\n<p>Operators and they were brought into the NMR category<\/p>\n<p>on 1.4.1984. The first and second petitioners are still in<\/p>\n<p>service and the third petitioner retired from service on<\/p>\n<p>30.11.2007. The petitioners point out that the petitioners<\/p>\n<p>and similarly placed persons were brought into regular<\/p>\n<p>establishment service pursuant to a decision taken by the<\/p>\n<p>Government in 1983 that all the NMR employees of the<\/p>\n<p>erstwhile Public Health Engineering Department should<\/p>\n<p>be brought into regular establishment,           when    they<\/p>\n<p>complete five years of NMR service.           The petitioners<\/p>\n<p>submit that several other NMR workers were brought into<\/p>\n<p>regular establishment on completion of five years of<\/p>\n<p>service, exempting them from technical and general<\/p>\n<p>qualifications and age limit and their pay was also fixed<\/p>\n<p>notionally, without arrears. Apparently, the petitioners<\/p>\n<p>are not given the benefit of the said decision. They point<\/p>\n<p>out that similarly situated persons had approached this<\/p>\n<p>W.P.(C).22088\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Court and their claim was directed to be considered<\/p>\n<p>under Exts.P3 and P4 judgments. Petitioners claim that<\/p>\n<p>they are similarly situated.\n<\/p>\n<\/p>\n<p>2.   I heard learned counsel for the petitioners and the<\/p>\n<p>learned Government Pleader as also the learned<\/p>\n<p>Standing Counsel for the Water Authority.<\/p>\n<p>3.   In the result, writ petition is disposed of directing<\/p>\n<p>the petitioners to approach the first respondent with<\/p>\n<p>their claim, as mentioned above.      If they file such a<\/p>\n<p>representation     within one month from the date of<\/p>\n<p>receipt of a copy of this judgment, first respondent shall,<\/p>\n<p>after hearing the petitioners,    take a decision on the<\/p>\n<p>claim    made     by the petitioners for   absorption into<\/p>\n<p>regular service with effect from the date on which they<\/p>\n<p>complete five years as NMR operators.
