Justice PIUS C.KURIAKOSE\n\n Dated :01\/02\/2007\n\n O R D E R\n                        PIUS C.KURIAKOSE, J.\n\n                       ----------------------------------\n\n                    W.P.(C)NO. 21528  of    2006\n\n                       ----------------------------------\n\n              Dated this 1st day of   February , 2007\n\n\n                                JUDGMENT\n<\/pre>\n<p>      Ext.P5   order   passed   by   the     Ombudsman   for   Local   Self<\/p>\n<p>Government Institutions, is under challenge.   Ext.P5 is a general<\/p>\n<p>order   wherein   the   Ombudsman   ordered   that   providers   of   teli<\/p>\n<p>communication   service   shall   produce   no   objection   certificate<\/p>\n<p>from   the     Automic   Energy   Commission   so   as   to   enable   the<\/p>\n<p>Panchayat   to   issue   licence   to   them   for   installation   of   mobile<\/p>\n<p>tower and for  energizing the same.\n<\/p>\n<p>      2.Heard   Sri.A.M.Shaffique   the   learned   Counsel   for   the<\/p>\n<p>petitioner, Sri.P.V.Kunhikrishnan, the learned Standing Counsel<\/p>\n<p>for   the   Panchayat   and   Sri.Mathew   G.Vadakkal,   the   learned<\/p>\n<p>Government Pleader for the 4th  respondent. Even though the 3rd<\/p>\n<p>respondent   had   filed   complaint   regarding   the   installation   and<\/p>\n<p>commission   of   the   mobile   tower   by   the   petitioner   he   has   not<\/p>\n<p>entered   appearance   before   this   court   for   resisting   this   writ<\/p>\n<p>petition.   My   attention   was   drawn   by       Sri.A.M.Shaffique   to   the<\/p>\n<p>judgment   of   the   Division   Bench   of   this   court   in     Reliance<\/p>\n<p><span class=\"hidden_text\">WPC No.21528\/2006                        2<\/span><\/p>\n<p><a href=\"\/doc\/1305317\/\">Infocom Ltd. v. Chemanchery Grama Panchayat<\/a> ( 2006 (4)<\/p>\n<p>KLT 695).   Paragraphs 5 and 8 were highlighted before me by<\/p>\n<p>the   learned   counsel.   I   notice   that   the   issue   is   decided   by   the<\/p>\n<p>Division Bench in favour of the petitioner.\n<\/p>\n<p>      3.   Having   regard   to   the     principles   laid   down   in   Reliance<\/p>\n<p>case ( supra), Ext.P5 cannot be sustained at all.  Ext.P5 therefore<\/p>\n<p>will   stand   quashed.     However,   it   is   made   clear   that   all   the<\/p>\n<p>observations and direction in paragraph 8 of the   Reliance Case<\/p>\n<p>which I quote as follows;\n<\/p>\n<blockquote><p>                 &#8220;We   notice   that   the   Panchayat   has   as   on<\/p>\n<p>          today   no   scientific   data   or   relevant   materials   to<\/p>\n<p>          cancel   the  licence   already  granted   on   the   ground<\/p>\n<p>          that the installation of the Tower would cause any<\/p>\n<p>          health   hazards.          Licence   granted   has   been<\/p>\n<p>          cancelled   by   the   Panchayat   based   on   an<\/p>\n<p>          apprehension that the  radiation  may cause health<\/p>\n<p>          hazards     to   the   people   of   the   locality.   Further<\/p>\n<p>          Ext.P5   also   says   that   installation   of   generator<\/p>\n<p>          would   cause   sound   pollution.     Petitioner   has   not<\/p>\n<p>          installed   any   generator   as   on   today   and   if   the<\/p>\n<p>          installation   of   generator   would   cause   any   sound<\/p>\n<p>          pollution,   evidently   Pollution   Control   Board   can<\/p>\n<p>          give   appropriate   direction   and   the   petitioner   will<\/p>\n<p>          have   to   obtain   necessary   consent   from   the<\/p>\n<p>          Pollution   Control   Board   for   installation   of<\/p>\n<p>          generators,   so   that   it   would   not   cause   any   sound<\/p>\n<p>          pollution.   So also, if the installation of Tower and<\/p>\n<p>          the   emission  of elctromagnetic waves causes any<\/p>\n<p><span class=\"hidden_text\">WPC No.21528\/2006                       3<\/span><\/p>\n<p>          air pollution, affecting human health the Pollution<\/p>\n<p>          Control   Board   can   take   appropriate   measures<\/p>\n<p>          under   Air   (   Prevention   and   Control   of   Pollution)<\/p>\n<p>          Act 1991&#8243;.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>shall be binding on the writ petitioner also.\n<\/p>\n<p>       The   writ   petition     stands   allowed       subject   to   the   above<\/p>\n<p>quoted directions and observations.\n<\/p>\n<p>                                             PIUS C.KURIAKOSE<\/p>\n<p>                                                          Judge<\/p>\n<p>dpk<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Tata Teleservices Limited vs The Ombudsman For Local Self on 1 February, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 21528 of 2006(K) 1.
