S.J. MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nappeal has been preferred by the  petitioner &#8211; appellant against<br \/>\norder dated 22nd February, 2011, passed by the learned Single Judge,<br \/>\nwhereby and whereunder the writ petition preferred by the petitioner<br \/>\nhas been dismissed.\n<\/p>\n<p>2.\tThe<br \/>\naforesaid writ petition was preferred for a direction on respondent<br \/>\nAhmedabad Municipal Corporation to implement Town Planning Scheme No.<br \/>\n54 (South Isanpur) qua the petitioner&#8217;s land.\n<\/p>\n<p>3.\tPetitioner<br \/>\nclaimed that he purchased some portion of the land bearing Sruvey No.<br \/>\n533 paiki (part) from the original owner i.e. Maniben Becharbhai, and<br \/>\nis in possession of the same.  The land was subjected to Town<br \/>\nPlanning Scheme No. 54 (South Isanpur) and under final Town Planning<br \/>\nScheme, the original owner of the land bearing Survey No. 533 paiki<br \/>\n(part) were given O.P No. 46\/1 and 462 admeasuring 18,919 sq.meters<br \/>\nof land and Final Plot No. 48 and 71 totally admeasuring 14,231<br \/>\nsq.meters of land.\n<\/p>\n<p>4.\tLearned<br \/>\ncounsel for the appellant would submit that the land in question<br \/>\nbeing purchased from the original land owner, independent final plot<br \/>\nwould have been allotted in favour of the petitioner.\n<\/p>\n<p>5.\tLearned<br \/>\nSingle Judge found that petitioner purchased the land from the<br \/>\noriginal owner after Town Planning Scheme No. 54 (South Isanpur) was<br \/>\nfinalised and in view of the provisions, original owner has been<br \/>\nprovided with alternative land.  In this background, as already such<br \/>\nplot has been allotted to the original owner, petitioner cannot<br \/>\nderive any advantage of the subsequent sale.  There being no merit,<br \/>\nthe appeal is dismissed.
