JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 24\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;14)\tThe<br \/>\npetitioner, therefore, prays that this Hon&#8217;ble Court may be pleased<br \/>\nto issue a writ of mandamus or any other writ, order or direction:\n<\/p>\n<p>A)\tQuashing<br \/>\nand setting aside the letter dt. 7.11.2009 written by the Respondent<br \/>\nNo.3, and directing the respondent Nos.1 and 2 to decide the<br \/>\nrepresentation dt.5.4.2010 made by the petitioner, in consultation<br \/>\nwith each other as regards compassionate appointment in the light of<br \/>\nthe judgment dt. 14.12.2010 in Spl.C.A.NO.15955 of 2010.\n<\/p>\n<p>B)\tDuring<br \/>\nthe pendency and final disposal of this petition, the Respondent No.1<br \/>\nmay be directed to consider the case of the petitioner for<br \/>\ncompassionate appointment<\/p>\n<p>C)\tTo<br \/>\ngrant such and further relief as may be deemed fit and proper.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Mr. Samir B. Gohil, learned for Mr. A.S. Supehia,<br \/>\nlearned advocate for the petitioner states that the interest of<br \/>\njustice would be met, if respondent No.1 is directed to consider and<br \/>\ndecide the representation dated 05.04.2010, made by the petitioner,<br \/>\nin light of the judgment dated 14.12.2010, passed in Special Civil<br \/>\nApplication No.15955 of 2010.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed :-\n<\/p>\n<p>Respondent<br \/>\nNo.1 may consider and decide  representation dated 05.04.2010, made<br \/>\nby the petitioner, in light of the judgment dated 14.12.2010, passed<br \/>\nin Special Civil Application No.15955 of 2010, within a period of<br \/>\nthree months from the date of receipt of the copy of this order.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>4.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>  (Smt.
