In these appeals,  are\"  The\ncheques which were  to cornvplainant\nwere in respectof to have been\nentered   on\n2.10.99,  accused so also the\ndefence' -. complainant is cornrnon.\n\nTherefore';   axifoidlrepetition and overlapping of\n\n M facts, these  together taken for disposal by\n\n'V ' this. judgment.\n\nA  3v__;'i' learned counsel for complainant as also the\n\nit   learned\u00bb counsel for accused are absent.\n\n4. In View of the judgment of the Supreme Court\n\nreported in 2008 AIR SCW 357. I have perused the\n\nrecords and taken up these appeals for dis posal on\n\n \n \n\nmerits.  \n\n at \n\n\n\n__. 4-} \n5. On consideration of the averments made in the\n\ncomplaint, the evidence adduced by complainantand\n\naccused, I find, by and large, the facts are \n\ndispute. The disputed facts lie in a narrow':icovinpasslhe V'\n\nTherefore, it is 1'1\u20acC\u20acSS8I'y to state-'admitted \n\nare as follows.\n\n6. The complainant  his\" faxnilyg rr1ei1*ib'ers\nconstituted a partnership firm ovifned  small\n\nscale industry under   Cam Max\n\n or A. \"scale industrial unit),\nsituate    Industrial Estate, Peenya\n\nEl Stage,  Post, Bangalore. The\n\n..pphadlVhj'rpothecated the machinery of the\n\nllplantl  \"   M \/ s Shyamrao Vittal Co--operatiVe\n\n._  Bani~:__ and 'raised a loan of Rs. 15,00,000\/-.\n\nT 7';f\"oN 2.10.1999, complainant and second\n\n jaeu--seud[M.Loganathan) entered into an agreement of\n\n  sale whereby the complainant agreed to sell Cam Max\n\n\" Engineering in favour of accused for total consideration\n\nRs.25,00,000\/- which included the liability of\n\nJ-\\?'  I\/K-\ufb013\"\u00ab1\/'\\\u00ab&amp;;(. I\n\n\n\n8\n\nthe foiiowing documents to substantiate their\n\ncontentions.\n\n12. In the notice dated 5.3.2009 at Ex.D4,\"i'ssiLie:\u00e9iv.y4\n\nby the of\ufb01ce of the Asst. Commissioner of  9'\n\nTaxes, Sirsi Circie, Bangalore, it:-is\"'show;'rA1 for 'thex'=\nassessment year 1997-98, My\/s Cam Max x. -A\"}iab1e_ to '\n\nHa 'I\nL\u00bb,\n\npay sales tax and surcharge :' \nof EX.D8, which is a letter d\"ate'd-.9141211212000'\"addressed\n\nby M \/s Shamrao Vittal  Cam Max.\n\nthe complainant\u00ab\u00aby:._a'vaiiedg 1earfefi\"--.Re;i1S.00,oo0\/-- by\n\nhypothecat.\/ionyivioffp:ian't'\u00bb_and' machinery and has also\n\navailed biiitycliscoigntingifaciiity of Rs.1,00,000\/~. The\n\n  has pro'daVce_\u00a7i':outstanding liability of M\/s Cam\n\n E1:g_i11eeri'ng which had accrued before 1.4.99 . in\n\nte1*ms.7of'E;:.IA)i4, Cam Max was due in a sum of\n\n.4 to M\/s Engineering Enterprises. In terms\n\n9' 'EX.i.\u00abDi5, M\/s Cam Max was due in a sum of\n\n\u00bb~ to 34\/5 Zylincirotek Systems. In terms of\n\n M\/S Cam Max was due in a sum of\n\nRs.19,357\/-- to NUS Metreat Products. In terms of\n\nEx.D17, M\/s Cam Max was due in a sum of Rs.19477\/--\n\n\u00bb\n\n5&amp;3 '  L :9\u00bb 'L  '\n\n\n\nto Industrial Enterprises. In terms of Ex.D18, M \/ s Cam\n\nMax was due in a sum of Rs.15.112\/-- to M\/s Qanara\n\nFasteners. In terms of Ex.DI9, M\/S Can  _\n\nin a sum of Rs.12,120\/- to M\/s AvasaraiaAititrofnationv;I  \n\nLimited. In terms of EXD20, M Can_.IMaX.'wasIIdii-e__ in_a_AI\n\na sum of Rs. 1,07 ,O00\/ -- to   \nIn terms of Ex.D21, M[s  was  agisum of\nRs.3,900\/w to NUS iiittggrattgcte' J.Pr'ecIision Tool Room\nPvt.Ltd. In termsof   was due in\n\na sum of  ._M\/sf vfd\ufb01earhead Marketing\n\nServices. IIII \"Int  Can Max was due in\na sum of  otto Biiz\ufb02ndia} Pvt. Ltd.\n\nIn terms of   Max was due in a sum of\n\n \"Rs.7I;---5OO')'-- to\u00e9A.B.I'I3ngineering works. These liabilities\n\n 1.<\/pre>\n<p>4.1999. These liabilities should<\/p>\n<p>  have-..__beenIuoiischarged by the complainant. The<\/p>\n<p>I.&#8221;I&#8221;-..Icomp1ain:-:int in his evidence has admitted that on<\/p>\n<p>  he had received a DD. for Rs.3,00,000\/&#8211; from<\/p>\n<p>  accused No.2 Loganathan. He has admitted i&#8221; : apart<\/p>\n<p>P<\/p>\n<p>I from this transaction, there were no other transactions<\/p>\n<p>between the accused and complainant.<\/p>\n<p><span class=\"hidden_text\">12<\/span><\/p>\n<p>complainant. The compiainant without performing his<\/p>\n<p>obiigations contained in the agreement cannot_&#8221;&#8221;\u00bbbe<\/p>\n<p>permitted to contend that second accused A&#8217; <\/p>\n<p>honour the cheques issued by him.
