A No.347 of 2003\n            ------------------------------------------------\n           Dated this the 22nd day of September, 2008\n\n                          JUDGMENT\n<\/pre>\n<p>Koshy, J<\/p>\n<p>      The appellant at the age of 53 sustained<\/p>\n<p>serious   injuries          in      a      motor         accident   on<\/p>\n<p>22\/07\/98. He filed a claim petition claiming<\/p>\n<p>Rs.5 lakhs as compensation. Tribunal awarded<\/p>\n<p>only an amount of Rs.1,24,500\/- with interest<\/p>\n<p>including reimbursement of medical expenses<\/p>\n<p>after   holding        that         the        first        respondent<\/p>\n<p>driver-cum-owner             of         the           vehicle      was<\/p>\n<p>responsible for the accident. The offending<\/p>\n<p>vehicle was insured by the second respondent\/<\/p>\n<p>Insurance Company. Only dispute is regarding<\/p>\n<p>the quantum of compensation.\n<\/p>\n<p>      2. With      regard          to      the       injuries,    the<\/p>\n<p>Tribunal has referred the injuries in para 8<\/p>\n<p>of the award as follows:-\n<\/p>\n<p><span class=\"hidden_text\">M. F. A No.347 of 2003                 -2-<\/span><\/p>\n<blockquote><p>                      &#8220;As per the medical records, it is proved that<br \/>\n              in the accident, the petitioner sustained head<br \/>\n              injury, fracture (R) clavicle, IIIrd nerve palsy (R)<br \/>\n              side, multiple fractures of bony walls of both<br \/>\n              maxillary areas, homosines and soft tissue<br \/>\n              swelling (L) orbital region, contusion of brain<br \/>\n              parenchyma (R), recurrant attack of giddiness,<br \/>\n              infarction (R) superior mid parietal cortical region<br \/>\n              and (R) mid superior parietal parasagittal region,<br \/>\n              contricular system shows dilatation with cortial<br \/>\n              atrophy, contusion (R) parietal and occipital<br \/>\n              region, dearness (R) ear and mal united fracture<br \/>\n              (R) clavicle. As per Exts.A8 &amp; A9 C.T. Scan<br \/>\n              reports, it is noted that the petitioner sustained<br \/>\n              fracture of bony walls of both maxillary areas,<br \/>\n              fracture (L) zygomatic arch, fracture (R) squamous<br \/>\n              temporal bone, fracture (L) frontal bone and<br \/>\n              fracture both parietal bones, There is soft tissue<br \/>\n              swelling and scalp haematoma over the (R)<br \/>\n              tempero parietal region and (L) parieto occipital<br \/>\n              region and swelling over (L) orbital region. The<br \/>\n              petitioner was admitted in the Medical College<br \/>\n              hospital, Thiruvananthapuram on 22\/07\/98 treated<br \/>\n              and discharged on 24\/09\/98. Thereafter he was<br \/>\n              admitted and treated in the Southern Railway<br \/>\n              Hospital from 29\/01\/99 to 11\/02\/99 and thereafter<br \/>\n              from 17\/03\/99 to 25\/03\/99. Subsequently, he was<br \/>\n              treated in the Government Ayurveda College<br \/>\n              Hospital, Thiruvananthapuram as inpatient from<br \/>\n              09\/03\/2000 to 16\/05\/2000. On 07\/08\/98, the<br \/>\n              petitioner was developed weakness of (L) side.<br \/>\n              E.N.T consultation done to him. The petitioner<br \/>\n              was treated with figure &#8216;8&#8217; bandage and audiogram<br \/>\n              done to him.&#8221;<\/p>\n<blockquote><p><span class=\"hidden_text\">M. F. A No.347 of 2003                 -3-<\/span><\/p>\n<\/blockquote>\n<blockquote><p>              3. The Tribunal found that he is disabled<\/p>\n<p>       by 25%. It is the case of the petitioner who<\/p>\n<p>       was an employee in Indian Railways that his<\/p>\n<p>       services        were    terminated       with   effect  from<\/p>\n<p>       13\/04\/1999        as    he   is    medically     unfit.  His<\/p>\n<p>       contention is that as he was unable to work,<\/p>\n<p>       he is entitled to compensation for 100% loss<\/p>\n<p>       of      earning       capacity.        In    view   of   the<\/p>\n<p>       contentions so raised, we have referred him<\/p>\n<p>       for medical examination by a Medical Board<\/p>\n<p>       constituted by the Government Medical College<\/p>\n<p>       Hospital,         Thiruvananthapuram.           The  Medical<\/p>\n<p>       Board certified that there is 40% disability.<\/p>\n<p>       Medical Board certified that the appellant has<\/p>\n<p>       the following defects:-\n<\/p><\/blockquote>\n<blockquote><p>                      &#8220;1. Induced bleed into air sinuses, right<br \/>\n              third (N) palsy, mild deafness and severe mental<br \/>\n              depression.\n<\/p><\/blockquote>\n<blockquote><p>                      2. Depressive disorder (severe).&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              4. He was examined by a panel of five<\/p>\n<p>       expert Doctors. Even though it is contended<\/p>\n<p><span class=\"hidden_text\">M. F. A No.347 of 2003            -4-<\/span><\/p>\n<p>       that he has 100% disability considering the<\/p>\n<p>       nature of injuries, we are of the opinion that<\/p>\n<p>       at    least     compensation  ought to have  been<\/p>\n<p>       granted for 40% disability.\n<\/p><\/blockquote>\n<blockquote><p>              5. Now the question is regarding the<\/p>\n<p>       amount he was earning at the time of the<\/p>\n<p>       accident. He produced Annexure-A Certificate.<\/p>\n<p>       The above is pay slip\/pay ticket. It shows<\/p>\n<p>       that        the  total   wages  for  20\/11\/97 is<\/p>\n<p>       Rs.4,580\/-. Out of which Rs.289\/- was paid for<\/p>\n<p>       house accommodation. In the Pay Slip it is not<\/p>\n<p>       stated that the above wages is for a month.<\/p>\n<p>       But the above pay ticket as well as Annexure-<\/p>\n<p>       A12 shows that he was employed in Southern<\/p>\n<p>       Railway. Taking all these aspects, we are of<\/p>\n<p>       the opinion that at least Rs.3,000\/- can be<\/p>\n<p>       taken as the monthly income. The accident<\/p>\n<p>       occurred at the age of 53 and the multiplier<\/p>\n<p>       applicable is 11 taking guidelines from the<\/p>\n<p><span class=\"hidden_text\">M. F. A No.347 of 2003            -5-<\/span><\/p>\n<p>       Second Schedule. If that be so, compensation<\/p>\n<p>       payable will be Rs.1,58,400\/- (Rs.3,000\/- x 12<\/p>\n<p>       x 40\/100 x 11). The Tribunal has awarded only<\/p>\n<p>       an amount of Rs.66,000\/- taking 11 as the<\/p>\n<p>       multiplier       and   Rs.2,000\/-  as  the  monthly<\/p>\n<p>       income.        Therefore,  additional  compensation<\/p>\n<p>       payable for disability and loss of earning<\/p>\n<p>       capacity will be Rs.92,400\/-. The Tribunal<\/p>\n<p>       found that he was unable to do any work for<\/p>\n<p>       five       months.   Considering   the   nature of<\/p>\n<p>       injuries,         Rs.10,000\/-   was    awarded   as<\/p>\n<p>       compensation.       Since  we   have increased  the<\/p>\n<p>       monthly income to Rs.3,000\/- he is entitled to<\/p>\n<p>       Rs.5,000\/-       more   for   the  actual  loss  of<\/p>\n<p>       earnings during the treatment period. It is<\/p>\n<p>       his case that after the accident, he was<\/p>\n<p>       continuously on leave and finally his services<\/p>\n<p>       were terminated as can be seen from Annexure-A<\/p>\n<\/blockquote>\n<blockquote><p>       (a). It is contended that the Tribunal awarded<\/p>\n<p><span class=\"hidden_text\">M. F. A No.347 of 2003            -6-<\/span><\/p>\n<p>       only Rs.3,000\/- as medical expenses since no<\/p>\n<p>       medical bills were produced by the appellant.<\/p>\n<p>       Perhaps it may be the reason that he being a<\/p>\n<p>       Railway employee, he might have been treated<\/p>\n<p>       only in the Railway Hospital and his bills<\/p>\n<p>       were already reimbursed. It has been stated<\/p>\n<p>       that he was treated about 160 days in Medical<\/p>\n<p>       College        Hospital,   Thiruvananthapuram   and<\/p>\n<p>       Ayurveda College Hospital, Thiruvananthapuram<\/p>\n<p>       apart from the treatment at Southern Railway<\/p>\n<p>       Hospital,       Chennai.   There   will   be   many<\/p>\n<p>       incidental expenses incurred by him during the<\/p>\n<p>       long       inpatient   treatment.  For   bystanders<\/p>\n<p>       expenses only Rs.5,000\/- was awarded by the<\/p>\n<p>       Tribunal.       So,  for  medical  and   incidental<\/p>\n<p>       expenses we award Rs.2,000\/- more. Thus, the<\/p>\n<p>       appellant is entitled to Rs.99,400\/- more than<\/p>\n<p>       what is awarded by the Tribunal. The above<\/p>\n<p>       amount of Rs.99,400\/- should be deposited by<\/p>\n<p><span class=\"hidden_text\">M. F. A No.347 of 2003      -7-<\/span><\/p>\n<p>       the Second Respondent\/Insurance Company with<\/p>\n<p>       7.5% interest from the date of application<\/p>\n<p>       till its deposit, over and above the amount<\/p>\n<p>       decreed by the Tribunal. On deposit of the<\/p>\n<p>       same the appellant is allowed to withdraw the<\/p>\n<p>       same.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                            J.
