Orders<\/div>\n<div class=\"doc_title\">Chhote Lal Upadhyay vs The Bihar State Electricity Bo on 20 April, 2011<\/div>\n<pre>                  IN THE HIGH COURT OF JUDICATURE AT PATNA\n                            CWJC No.2343 of 2008\n                            CHHOTE LAL UPADHYAY\n                                   Versus\n                       THE BIHAR STATE ELECTRICITY BOARD\n                                -----------\n<\/pre>\n<p>2.   20.4.2011           Having   heard   counsel   for    the<\/p>\n<p>                 parties at length this Court would find it<\/p>\n<p>                 necessary to give a further opportunity to<\/p>\n<p>                 the   counsel     for   the   Board        to    explain    the<\/p>\n<p>                 rationale of continuing with the practice of<\/p>\n<p>                 not     considering     the     adopted         son    in   the<\/p>\n<p>                 category    of    dependent         for    appointment       on<\/p>\n<p>                 compassionate ground even when the Board had<\/p>\n<p>                 all along been treating them to be eligible<\/p>\n<p>                 for appointment on compassionate ground in<\/p>\n<p>                 view of its standing order No. 9B\/D.E.M.\/<\/p>\n<p>                 3021\/89-733       dated       13.7.1991          which      got<\/p>\n<p>                 amended subsequently by the standing order<\/p>\n<p>                 No. 18\/D.E.M.-3035\/93\/749 dated 21.4.1993 on<\/p>\n<p>                 the sole ground that the State Government in<\/p>\n<p>                 its policy vide circular of the Personnel<\/p>\n<p>                 and Administrative Reforms Department dated<\/p>\n<p>                 5.10.1991     had     taken     a    decision         for   not<\/p>\n<p>                 including the adopted son among the category<\/p>\n<p>                 of       dependent        for         appointment            on<\/p>\n<p>                 compassionate ground.\n<\/p>\n<p>                             The     rescinding        of    the       standing<\/p>\n<p>                 order    dated      13.7.1991       of     the    Board     was<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>            infact based on              aforementioned Government<\/p>\n<p>            circular      dated         5.10.1991         and    when      the<\/p>\n<p>            Government         itself       has    withdrawn        the   said<\/p>\n<p>            provision of the circular by issuing a fresh<\/p>\n<p>            circular on 12.5.2005 following the law laid<\/p>\n<p>            down    by   this       Court    in     the     Division      Bench<\/p>\n<p>            judgment in the case of Kamal r1 vs. State<\/p>\n<p>            of Bihar &amp; ors., reported in 1994(2) PLJR<\/p>\n<p>            536, it would be necessary for the Board to<\/p>\n<p>            explain the circumstances in which the said<\/p>\n<p>            non-existing        Government          decision        is    still<\/p>\n<p>            being     made          applicable        for     denying       the<\/p>\n<p>            compassionate            appointment         to   the     adopted<\/p>\n<p>            son?\n<\/p>\n<p>                         List        this      case       accordingly        on<\/p>\n<p>            29.4.2011 at the top of the list to enable<\/p>\n<p>            the learned counsel for the Board to file a<\/p>\n<p>            supplementary            counter       affidavit        as     also<\/p>\n<p>            produce      the    original          file    from   which      the<\/p>\n<p>            standing      order        dated       21.4.1993        had   been<\/p>\n<p>            issued.\n<\/p>\n<p>                         Let a copy of this order be given<\/p>\n<p>            to Mrs. Nivedita Nirvikar, learned Counsel<\/p>\n<p>            for the Bihar State Electricity Board.<\/p>\n<p>                                                  (Mihir Kumar Jha,J.)<\/p>\n<p>Surendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
