NO. 495 OF 2004\n             = = = = = = = = = = = = = = =\n          Dated this the 8th day of July, 2008.\n\n                        J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Kottayam in O.P.(MV)874\/97.     It<\/p>\n<p>is a petition filed for claiming compensation for the damages<\/p>\n<p>sustained to the vehicle which belong to the claimant. The<\/p>\n<p>claimant has been awarded an amount of Rs.86,240\/- as<\/p>\n<p>compensation.      The insurance company has come up in<\/p>\n<p>appeal.    The principal challenge is that after settling the<\/p>\n<p>amount with its own insurance company the claimant is not<\/p>\n<p>entitled to again get the amount from the insurance company<\/p>\n<p>involved in this case. The learned Tribunal relying upon the<\/p>\n<p>decision of the Delhi High Court reported in A.C. Mehra v.<\/p>\n<p>Behari Lal (1998 ACJ 379) held that the insurance<\/p>\n<p>company is not entitled to raise such a plea and therefore<\/p>\n<p>proceed to award the compensation. This point has been<\/p>\n<p>considered by this Court in a recent decision reported in<\/p>\n<p><a href=\"\/doc\/101211\/\">National Insurance Co. Ltd. v. Mohan<\/a> (2008 (2) KLT<\/p>\n<p>683). The learned Judge held that,<\/p>\n<p>M.A.C.A. 495 OF 2004<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>       &#8220;The insured is entitled to maintain an action<\/p>\n<p>       against the tortfeasor even if he had received<\/p>\n<p>       compensation from his insurer. But he cannot<\/p>\n<p>       appropriate that amount which he had received<\/p>\n<p>       from the company and he will hold that amount<\/p>\n<p>       as trustee of the insurer and he is answerable<\/p>\n<p>       and accountable to the insurance company to<\/p>\n<p>       that extent.     If the insurer after obtaining a<\/p>\n<p>       letter of subrogation from the first respondent<\/p>\n<p>       had filed an Original Petition or it had also joined<\/p>\n<p>       in filing the original petition it would have been<\/p>\n<p>       entitled to that amount.        Even assuming that<\/p>\n<p>       first respondent is entitled to receive the amount<\/p>\n<p>       he can only receive the same in trust. But the<\/p>\n<p>       insurer has not made any claim over the amount<\/p>\n<p>       though it is made a party to this proceedings.<\/p>\n<p>       So the first respondent cannot be allowed to<\/p>\n<p>       make any double benefit. So he is not entitled<\/p>\n<p>       to get any compensation in this proceedings.&#8221;<\/p>\n<p>      2.    In such cases the principle applied is that there<\/p>\n<p>cannot be two compensation for the same incident. Unless<\/p>\n<p>there are records to prove that the original claim has been<\/p>\n<p>satisfied as full and final settlement there is always a scope<\/p>\n<p>to claim for the balance amount against the tortfeasor.<\/p>\n<p>M.A.C.A. 495 OF 2004<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>Here, except for the averment in the appeal memorandum<\/p>\n<p>and the written statement that it was full and final<\/p>\n<p>settlement of the claim, nothing is forthcoming from the side<\/p>\n<p>of the insurance company to establish that fact. Therefore I<\/p>\n<p>feel this is a fit case where the claimant is entitled to claim<\/p>\n<p>the difference.      The Tribunal has awarded a sum of<\/p>\n<p>Rs.86,240\/- as damages whereas the claimant has already<\/p>\n<p>received a sum of Rs.77,900\/- from its insurance company.<\/p>\n<p>Therefore, the claimant will be only entitled to realise the<\/p>\n<p>balance amount of Rs.8,340\/- towards damages.               So<\/p>\n<p>applying the principles on the question of tortfeasor the<\/p>\n<p>maximum amount the claimant is entitled to will be only this<\/p>\n<p>amount in the absence of any evidence regarding the fact<\/p>\n<p>that the earlier settlement by the insurance company of the<\/p>\n<p>claimant was in full and final settlement.      Therefore the<\/p>\n<p>award passed by the Tribunal is modified and the claimant is<\/p>\n<p>awarded a compensation of Rs.8,340\/- with 6% interest on<\/p>\n<p>the said sum from the date of petition till realisation with<\/p>\n<p>costs of Rs.500\/-.\n<\/p>\n<p>M.A.C.A. 495 OF 2004<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>     It is submitted that Rs.43,000\/- had been deposited<\/p>\n<p>and the claimant has withdrawn the same. Therefore, the<\/p>\n<p>claimant is directed to redeposit the excess amount<\/p>\n<p>withdrawn. If he does not deposit, the insurance company can<\/p>\n<p>execute this award for realisation of the same.<\/p>\n<p>                           M.N.
