Heard the learned  counsel<br \/>\nfor  the  parties.  The High Court by the impugned  judgment<br \/>\nand  order  dated 7.4.2000 has quashed the  detention  order<br \/>\ndated 16.10.1999 on the ground that there is non-application<br \/>\nof  mind  on  the part of the detaining\t authority  and\t has<br \/>\nmechanically  signed  the same because it is stated  in\t the<br \/>\ndetention   order   that   it\t be   served   through\t the<br \/>\nSuperintendent,\t Central Prison, Thiruchirapalli which would<br \/>\nmean  that the detaining authority was not aware of the fact<br \/>\nthat  the detenu was released on bail.\tThe learned  counsel<br \/>\nfor   the   appellants\tsubmitted   that  there\t  is   total<br \/>\nnon-application\t of mind by the High Court to the  detention<br \/>\norder.\t Detention order specifically mentions in the ground<br \/>\nNo.6  that  he\twas aware that detenu has been\treleased  on<br \/>\nconditional  bail by order dated 17.9.1999 in Cr.  M.P.\t No.<br \/>\n2138  of 1999 by the Judicial Magistrate-II, Mayiladuthurai.<br \/>\nIn  this set of circumstances, it cannot be said that  there<br \/>\nis non-application of mind by the detaining authority merely<br \/>\nby  mentioning\tthat  detention\t  order\t be  served  through<br \/>\nSuperintendent,\t Central  Prison, Thiruchirapalli.   In\t our<br \/>\nview,  it  appears  that  the\tlearned\t Judge\thas  lightly<br \/>\ninterfered  with the detention order without reading  ground<br \/>\nNo.6  which specifically recites that detenu was released on<br \/>\nbail  by  order\t dated\t17th September\t1999.\tFurther\t the<br \/>\ndetention  order  is addressed to the detenu mentioning\t his<br \/>\nresidential  address.\tTherefore, there was no question  of<br \/>\nserving\t the detention order through Superintendent, Central<br \/>\nPrison.\t  By  sending  copy to the  Superintendent,  Central<br \/>\nPrison\twould not make the detention order illegal.   Hence,<br \/>\nthe  impugned order passed by the High Court requires to  be<br \/>\nquashed\t and  set  aside  and  is  accordingly,\t set  aside.<br \/>\nLearned\t counsel for the appellant submitted that the detenu<br \/>\nshould\tbe  ordered  to surrender to undergo  the  remaining<br \/>\nperiod\tof detention.  For this purpose, he placed  reliance<br \/>\non  the\t directions issued by this Court in  <a href=\"\/doc\/382059\/\">Sunil  Fulchand<br \/>\nShah  v.  Union of India &amp; Ors.<\/a>\t [(2000) 3 SCC 409] which is<br \/>\nreproduced  hereunder:\t &#8211; 6.  The quashing of an order\t of<br \/>\ndetention  by the High Court brings to an end such an  order<br \/>\nand  if\t an appeal is allowed against the order of the\tHigh<br \/>\nCourt, the question whether or not the detenu should be made<br \/>\nto  surrender to undergo the remaining period of  detention,<br \/>\nwould  depend upon a variety of factors and in particular on<br \/>\nthe question of lapse of time between the date of detention,<br \/>\nthe  order  of the High Court, and the order of this  Court,<br \/>\nsetting aside the order of the High Court.\n<\/p>\n<p>      A\t detenu\t need  not  be\tsent  back  to\tundergo\t the<br \/>\nremaining  period of detention, after a long lapse of  time,<br \/>\nwhen  even  the\t maximum prescribed period intended  in\t the<br \/>\norder  of detention has expired, unless there still exists a<br \/>\nproximate  temporal  nexus between the period  of  detention<br \/>\nindicated  in the order by which the detenu was required  to<br \/>\nbe  detained and the date when the detenu is required to  be<br \/>\ndetained  pursuant  to the appellate order and the State  is<br \/>\nable  to  satisfy  the\tcourt\tabout  the  desirability  of<br \/>\nfurther or continued detention.\n<\/p>\n<p>      Applying the aforesaid ratio, in our view, this is not<br \/>\na  fit case for directing the detenu to surrender to undergo<br \/>\nthe  remaining\tperiod\tof detention.  Detention  order\t was<br \/>\npassed\ton 6th October, 1999 and hence, detention period  is<br \/>\nover.
