The accusation made in the<br \/>\n\tcomplaint is that the accused in the complaint are running<br \/>\n\tpathological laboratories without holding requisite qualification<br \/>\n\tand, therefore, the offence under Section 30 read with Section 33 of<br \/>\n\tthe  Gujarat Medical Practitioner<br \/>\n\tAct has been committed.  The additional allegation in the complaint<br \/>\n\tis that merely because the accused are holding certain qualification<br \/>\n\tfor laboratories technicians, the same is not sufficient to run<br \/>\n\tpathological laboratory\/centre and, therefore, the damage is being<br \/>\n\tcaused professionally to the complainant and the members of the<br \/>\n\tassociation of the complainant and is also cheating the patients and<br \/>\n\tthe public at large and, therefore, the offences are committed under<br \/>\n\tSections 465, 468 and 420 of IPC.  It appears that the learned<br \/>\n\tMagistrate directed for investigation of the complaint under Section<br \/>\n\t156(3) of Cr.P.C.  Under these circumstances, the present petitions<br \/>\n\tfor quashing of the complaints concerned in the respect petitions.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.B.P. Tanna, learned Counsel appearing with Mr.Bhatt, learned<br \/>\n\tCounsel for the petitioners, Mr.Saiyed, learned Counsel for original<br \/>\n\tcomplainant and Mr.K.P. Raval, learned APP for the respondent State<br \/>\n\tand Police Officers.\n<\/p>\n<p>None<br \/>\n\tof the complaints has been filed by any patient or any person, who<br \/>\n\twas made to believe that the accused were holding necessary<br \/>\n\tqualification for running pathological laboratories, which has led<br \/>\n\tthe patient or the person concerned to engage him for getting<br \/>\n\tservices of the pathological laboratories, nor there is any<br \/>\n\tallegation in the complaints that any patient or the person was<br \/>\n\tissued a certificate of pathologist, which was signed by any of the<br \/>\n\tpathologists.  Mere allegation of adverse effect on the profession<br \/>\n\tof the doctors, who are holding the degree of pathologists or<br \/>\n\toriginal complainant association would not be sufficient to attract<br \/>\n\tthe provisions of Sections 465, 468 and 420 of IPC.  Since the<br \/>\n\tcomplaint is not filed by or on behalf of any person, who has been<br \/>\n\tcheated, nor there is any allegation in the complaint that the<br \/>\n\tCentre or any pathologist is not genuine when a certificate issued<br \/>\n\tby such pathological laboratory, it can be said that the allegation<br \/>\n\tin the complaint, if considered as it is, would not constitute the<br \/>\n\tcommission of offence under Sections 465, 468 and 420 of IPC.<br \/>\n\tTherefore, the complaint to that extent deserves to be quashed and<br \/>\n\tconsequently the investigation so ordered by the learned Magistrate<br \/>\n\tqua that part of the complaint also would not survive, if the<br \/>\n\tcomplaint to that extent is quashed.\n<\/p>\n<p>However,<br \/>\n\tso far as the accusation made in the complaint<br \/>\n\tfor running of the pathological laboratories by the accused for the<br \/>\n\toffence under Sections 30 and 33 of the  Gujarat Medical<br \/>\n\tPractitioner Act is concerned, the learned Counsel appearing for the<br \/>\n\toriginal complainant relied upon the decision of the Apex Court in<br \/>\n\tthe case of Medical Council of India v. State of<br \/>\n\tRajasthan, reported in 1996(7) SCC, 731 (AIR 1996 SC 2073)<br \/>\n\tand another decision in the case of Mukhtar Chand v. State<br \/>\n\tof Punjab and Haryana, reported in 1998(7)SCC, 579 (AIR 1999 SC,\n<\/p>\n<p>\t468) and also the decision of<br \/>\n\tHigh Court of Madhya Pradesh in the case of Smt. Kamla<br \/>\n\tPatel v. State of M.P. &amp; Ors., reported in AIR 2004 Madhya<br \/>\n\tPradesh, 159 and the interim<br \/>\n\torder dated 28.4.2004 passed by the High Court of Allahabad in Civil<br \/>\n\tMisc. Contempt Petition No.820 of 2002 in the case of Rajesh<br \/>\n\tKumar Shivastav v. Shri A.P. Verma &amp; Ors.,<br \/>\n\tand it was contended that in all the matters, the observations were<br \/>\n\tmade to the  effect that if one is to run an independent<br \/>\n\tpathological laboratory, it has to be in the supervision of doctor<br \/>\n\thaving degree of M.D. Pathology and mere degree of laboratory<br \/>\n\ttechnician, who is not<br \/>\n\tregistered under the provisions of Gujarat Medical Practitioner Act<br \/>\n\tis not sufficient.  It was submitted that the directions were also<br \/>\n\tissued by the other High Court in the respective States for<br \/>\n\tverification of the said aspects and the consequential orders and,<br \/>\n\ttherefore, when the matter is at the stage of investigation by the<br \/>\n\tpolice under Section 156(3) of Cr.P.C., this Court may not exercise<br \/>\n\tthe power for quashing of the complaint under Section 482 of<br \/>\n\tCr.P.C., and at that stage qua the allegation, offence under Section<br \/>\n\t30 read with Section 33 of the Gujarat Medical Practitioner Act.\n<\/p>\n<p>Whereas<br \/>\n\tthe learned Counsel appearing for the petitioners, contended that<br \/>\n\tthe petitioner-accused are not practising any medicines and they are<br \/>\n\tonly conveying the laboratory analytical reports to the person, who<br \/>\n\ttakes their services.  In the submission of the applicants, such<br \/>\n\twould not constitute offence under Sections 30 or 33 of the  Gujarat<br \/>\n\tMedical Practitioner Act, since no opinion is given by them for any<br \/>\n\tmedicines or on the results of the machines.  Therefore, it was<br \/>\n\tsubmitted that this Court may quash the complaint, even for the<br \/>\n\talleged offence under Sections 30 and 33 of the  Gujarat Medical<br \/>\n\tPractitioner Act.\n<\/p>\n<p>\tIt<br \/>\n\tappears that whether the accused are giving opinion about the<br \/>\n\tanalytical report of the machines or not and whether the accused are<br \/>\n\trunning analytical centre or pathological laboratory or not is an<br \/>\n\tessential aspects, which may be required to be investigated.<br \/>\n\tFurther, if the accused are running pathological laboratories<br \/>\n\tindependently where there is supervision of a doctor having<br \/>\n\tqualification of M.D. Pathology or not will also be an aspect to be<br \/>\n\texamined in the investigation.  It is only after the investigation,<br \/>\n\tthe matter can be concluded as to whether the offence under Section<br \/>\n\t30 or Section 33 of Gujarat Medical Practitioner Act prima facie is<br \/>\n\tcommitted or not. Under these circumstances, I find that it would<br \/>\n\tnot be a case for exercise of the power to quash the complaint at<br \/>\n\tthis stage for the alleged offence under Section 30 and 33 of the<br \/>\n\tGujarat Medical Practitioner Act.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, the complaint is quashed in part for the alleged<br \/>\n\toffence punishable under Sections 465, 468 and 420 of IPC, but the<br \/>\n\tprayer for quashing of the complaint for the alleged offence<br \/>\n\tpunishable under Sections 30 and 33 of the Gujarat Medical<br \/>\n\tPractitioner Act is not granted.\n<\/p>\n<p>\tThe<br \/>\n\tpetitions are partly allowed to the aforesaid extent. Rule made<br \/>\n\tabsolute to the aforesaid extent only.
