Shri Suresh Kumar Ranga resident of Baljeet Nagar, New Delhi had complained to this Commission on 28th March 2006 alleging that the Container Corporation of India Ltd. (CONCOR) had refused to receive his applications dated 31.01.2006, 20.3.2006, 21.3.2006 and his appeals dated 17.3.2006 and 21.3.2006 to the First Appellate Authority. The Commission issued notice under the Section 19 of the Right to Information Act, 2005 to the Ms. P. Alli Rani, PIO, CONCOR and the Complainant Shri Suresh Kumar Ranga on 12th May, 2006 fixing hearing on the matter on 5th June 2006. On 26th May 2006 the General Manager of CONCOR sent their reply denying that CONCOR had refused to receive applications from Shri Ranga. He clarified that the organisation has a firm system in place to receive the applications under RTI Act and sending replies to the applicants. The reply further stated that out of 76 applications\/appeals received at the corporate office of CONCOR, 56 were from Shri Ranga and his companion Shri Sanjeev Kumar.\n<\/p>\n<p>2. A bench comprising Dr. O.P. Kejariwal and Dr. M.M. Ansari, Information Commissioners heard the matter. The Appellant Shri Ranga appeared in person and CONCOR was represented by Shri Rajiv Bhardwaj, Assistant Public Information Officer.\n<\/p>\n<p>Decision:\n<\/p>\n<p>3. Shri Ranga mentioned that CONCOR corporate office refused to accept his two applications for Information and three appeals to the first Appellate Authority. On an enquiry from the Commission as to the nature of information sought by Shri Ranga, he stated that he had asked for details of action taken by CONCOR on the orders of the Custom authorities and the list of employees dismissed from service etc. since 1988.\n<\/p>\n<p>4. The APIO of CONCOR contradicted his statement by producing a detailed list of cases with their status as on 5th January 2006 received by the organisation under the RTI Act. He produced copies of applications filed by Shri Ranga pointing out the deficiencies. The Commission was satisfied after their examination that the Appellant had not filed the applications in a proper manner and his charge on this account against CONCOR was very unfair.\n<\/p>\n<p>5. After hearing both sides, the Commission was satisfied that the Respondents were nowhere to be faulted regarding Shri Ranga&#8217;s applications\/appeals. On the specific issue of three applications and two appeals as raised by Shri Ranga, the Commission directed him to provide copies of his request to the Respondent who will dispose of his applications within 15 days of the issue of this order as per provisions of the Right to Information Act, 2005.\n<\/p>\n<p>6.
